Coun. 450 Ordered that a warrt issue agt Robert Troope to appeare att the next Proall Cort that in the Interim Morris Murfee remayne with Capt Luke Gardner Cott Evans & Richd LLoyd according to the former order of the Councell --------------- Aprill the 10 1662 To the honnorable Gouernor and Councell The humble petition of Maurice Murffee. Sheweth That wheare as your Petitioner hath receiued much dammage to his person with hazard of his life Receiued by Captn Robert Troope whereby hee is made in capable of gettinge a liuely- hood, and by which meanes his Cloathes and what goods hee brought into the Province weare carryed a way by the vessell in which hee was imported. Wells said Winter and Roper went away with Clarke That if they went to plunder a Town Clarke was to be Commander on Shore That Clarke would make Money enough and that they would have their Laps full and plunder the Spanish Towns and to that End would get a Vessel and Ammunition as soon as they could. Stimpson asked the Sailor his Name who replyed he was nameless. Daniel Wells said That if Clarke came up to Annapolis, he would find as many Friends as any Body. Thomas Peacock declares That Mr Garrett's Servant, William Cooper proposed to him to run away and told him of Thomas Harvey, John Murphy, Richard Williams, John Keyton and Richard Hickcock who had agreed to do the like Richard Williams named two more. Peacock asked their Names, to which Cooper made Answer what signi- fied it he should know when they came The Time intended was Sunday the sixteenth of March In- stant. They proposed to take Mr Bruff's Boat or any other Vessel. John Keyton declares That Cooper asked him to go a Priva- teering down to the Whore Kills and said John Murphy and Mr Edwards Man had agreed to go with him on Sunday next That Murphy would get two Gallons of Rum for their Voyage understood that that they were going down to the Whore Kills in order to join Daniel Wells and others who they heard were there and a Privateer bound to the Spanish West Indies William Cooper told him that Stimpson lay at a House over the Bay where Clarke had lain some Time before who said he would bring a Vessel with Guns and blow up the Town and that the Privateer was an Artist. Richard Williams the Taylor upon his Examination denied every Thing but was confronted by the Oath of Thomas Harvey who declared that Richard Williams asked him to go a Privateering and told him one William Mon- mouth had acquainted him of a Privateer setting out and that they would go to Carolina. p. 132 William Pearson says that Cooper asked him to go with him to which he agreed and that he had got Provisions. That he went to the Water Side but not finding Cooper there he re- turned. John Murphy says That being much in Debt in fear of being arrested he had Thoughts of running away that he discoursed Cooper about it and that Stimpson was privy to their Intentions. William Cooper declares that he had agreed to run away with Peacock, Afterwards Hickcock and Pearson agreed to go with them after that John Keyton who asked them if he and Stimpson designed to go a Privateering whereto he ans- wered he knew not but if he would come to Town a Parcel of them had agreed to go together. These Eleven actions are continued untill next Court ----------- p. 241 [1679] Edward Leach agt Robert Murphy =============================== Proceedings of the Provincial Court 1679 - 1680/1 p. 88 Edward Leach agt Robert Murphy Robert Murphy late of Talbot County was At- tached to Answer unto Edward Leach of a plea of trespas upon the case And whereupon the said Edward Leach by Rob- ert Carvile his Attorney saith, that whereas the said Robert Murphy upon the fourteenth day of May Anno Doni one thousand six hun- dred seaventy eight had bought & received of the said Edward by the hands of Thomas Hinson Attorney of the said Edward Leach one thousand seven hundred & ffifteene yards of lining att five pounds & an halfe p yard which comes to nine thousand f cure hundred thirty two pounds of tobacco And also Eleaven yards of broad cloath att forty pounds tobacco p yard which comes to foure hundred & sixty pounds of tobacco, which stud Gumcs amount in the •whole to the sume of nine thousand eight hundred seventy & two pounds of tobacco In consideration whereof the said Robert did assume upon himself & to the said Edward did faithfully promise that he the said Robert the said Sume of nine thousand Eight hundred seventy & two pounds of tobacco to him the said Edward when he should be there- unto requested would well & truely satisfie & pay. Yet notwithstand- ing the said Robert his promise & assumption aforesaid little re- guarding but deviseing & fraudulently intending him the said Edward in this behalfe craftily & fraudulently to defraud & deceive, the said Sume of nine thousand Eight hundred seventy two pounds of to- bacco to him the said Edward though often thereunto requested hath not paid or satisfied, but the same to pay and satisfie hath hitherto denyed & refused & still doth deny and refuse to the damage of the said Edward Sixteene thousand pounds of tobacco, & there- upon he bringeth his suite And the said Robert by Christopher Rousby his Attorney com- p. 89 Provincial Court Proceedings, id/p/o'o. 89 eth & defendeth the force & injury when &c and prayeth liberty to imparle hereunto untill next Provintiall Court & itt is granted unto him, the same day is giuen to the plt also Now here att this day to witt the Sixteenth day of ffebruary in the fifth yeare of the Dominion of the right Honble Charles Lord Baltemore &c Annoq Doni 1679 came the said parties by their At- torneys aforesaid And the said Robert by his said Attorney saith, that he the said Edward his action aforesaid against him the said Robert ought not to haue because he saith, that he the said Robert the said Sume of nine thousand Eight hundred Seaventy two pounds of tobacco nor any part thereof unto the said Edward to pay when thereunto required did not assume upon himselfe & to the said Ed- ward faithfully promise in manner & forme as in the said declara- tion is suggested, which the said Robert is ready to aver r And of this he putts himselfe upon the Countrey, & the plt also Therefore itt is comanded the Sheriffe of St Maryes County that he cause to come here twelve &c by whom &c And who neither &c to Recognize &c because as well &c on which said sixteenth day of ffebruary in the yeare aforesaid came the said parties by their Attorneys aforesaid And the jurors impannelled being called likewise came to witt Robert Ellys, Wm Thomas, Henry Exon, James Veitch, Tho: Beale, Tho : Hussy, Wm Bawdon, Tho: Alcock, Bernard Johnson, Tho: Allan- son, Edward Sise & Daniel docker who being Elected tryed & sworne {Liber W. C.} to say the truth in the prmisses Upon their Oaths doe say, that the said Robert Murphy did assume & promise in manner & forme as the said Edward Leach hath alleadged And they assesse the damage of the said Edward to nine thousand eight hundred Seventy & two pounds of tobacco.
