In the Grace of God of Great Britain France of Ireland King Defender of the Faith for and in the year of our Lord 1774. Between Simion Murphy of the Province of South Carolina Planter of the one part and Patrick McGarity of the Province aforesaid Planter of the other part. Witnesseth for in consideration of the sum of 5 Shillings of lawful money of Great Britain by the said Patrick McGarity to the said Simion Murphy in hand paid at and before the sealing and delivery of these presents the receipt whereof whereby acknowledged and for kivers good cause of consideration the said Simion Murphy thereunto moving He the said Simion Murphy bargained and sold and by these presents doth bargain and sell unto the said Patric McGarity all that tract of land containing 200 A situated and being on the south side of Tyger River in the province of South Carolina aforesaid. Beginning at a Gum on Tyger River then running south 30 degrees East to a Cahito Oak then south 60 West to a stake then north 30 degrees west to a stake on Tyger River then down River side to a Station including the above mentioned 200 A of land more or less. together with all and singular the houses, out houses Ediffico Building and Barn, Stables, yards, gardens and orchards, pastures, feedings and common Timbers.Item: Trees, woods, underwood, 10 dyes, Lakes, Fishing, water, water courses, Libalities, privilidges, Easements, profits, commodities, Endownments, advantages of Heriditiments whatsoever to said tract of Land belonging or in any wise appurtances or accepted, reported taken known and enjoyed he! ld, occupied. Leased or demised as past parcel or members of the same and the revision and revisions of remainder or remainders, rents, issues, profits of all and singular the said premises of every part or parcel thereof. To have and to hold the said tract of land and all and singular the premises herein before mentioned or intended to be hereby bargained & sold with their of every one of these appurtenances unto the said Patrick McGarity his heirs administrators and assigns from the day next before the date of the term of these presents for an denouncina and unto the full and time from a whole year. From thence next originating and fully to be completed and ended. Yielding and paying therefor unto the said Simion Murphy his heirs and assigns the last of one payment only on the last day of the said term of the same. Respectfully demanded to the contents, intent and purpose that by force and virtue of these presents, bargain and sell of the Statue for transforming uses possession the said Patrick McGarity may be in the actual possession of the said premises thence by enable to accept a Grant of release of the revision and inheritances therof to him the said Patrick McGarity his heirs and assigns forever. By indentures intended to be made between the said Known Murphy of the one part and the said Patrick McGarity of the other part and to be dated the day next after the day of the date of these presents. C. Ninety Six District of the one part and Ambrose Ray of the province and District aforesaid of the other part. Witnesseth that the said Patrick McGarity for in consideration of the sum of Ten Shillings common and Lawful money in the province afoaresaid to him in hand well and truly paid by the said Ambrose Ray at & before the sealing an delivery of these presents, the receipt who so ever is hereby acknowledged. He the said Patrick McGarity hath bargained sold and by these presents doth bargain, & sell unto the said Ambrose Ray all that plantation or tract of 200 A of Land, situated on the south side of Tygar River and bounded on the North side by said River. East bounded by Murphy Land and southernly on Bobo Land and on all other sides by Vacant Land. Together will all & singular the house, gardens, archards, woods, Timber, Lumber timbers, water, water courses, Liberties, profits, hereditaments, rights, members and appurtenances whatso ever thereunto belonging or any wise appertaining and reversion of reversions, commands or commanders unto issues and profits there of an of every part and parcel thereof. To have and to hold the said plantation or tract of 200 A of Land. Whereas the premises and appurtenances thereunto belonging unto the said Ambrose Ray, his heirs, Executors, and Administrators and assigns from the day next before the day of the date of these presents for and during the fall end and term from whole year. From thence next ensuring & fully to be complete and ended. Yielding and paying therefore unto the said Patrick McGariety and posses can for rent on the last day of the said term, if the same shall be lawfully commanded to the intent and purpose that by virtue of these presents for transforming of uses unto possession by force of the statue he the said Ambrose Ray may be actual possession of all and singular the premises above mentioned with every of the appurtenances thereunto beloning and thereby be the better enable to have taken and receive the reversion and inheritance thereof which is intended to be to him and his heirs granted and released by another Indenture or tended to be made and dated the day next after the day of the date hereof. Patrick McGarrity Recorded 5th September 1796 [Shawn's NOTE: This is the same Patrick McGarity that was born 11/5/1745 in Surry Co., VA, son of John and Mary Murphy McGarity. He is mentioned in his father's will. The Murphy's were in Surry Co., VA and I wonder if the Ray family was also from Surry Co., VA.
