Murphy, 12 Jun 2006] At a Superior Court of Chancery, holden at the former Capitol. in the City of Williamsburg, the 19th day of July, 1826 George Gurley, Executor of Josiah, dec’ed. AGAINST Henry Briggs. Adm. of Samuel Calvert. dec. surviving Ex'or. of Simon Murfee, James D. Edwards, Sheriff, and Committee ofthe estate of Richard Murfee, dec’d. Simon Murfee, Francis Murfee, Burwell Murfee. Drewry Murfee, Willis Murfee, Abraham Gardner & Thomas Ridley, Committee of the unadministered estate of Simon Murfee, dec. Defts. THIS [illeg.] in which the Bills of the Plaintiff hath been taken for confessed as to the Defendant Henry Briggs, on whom the decretal order for that purpose appears to have been duly executed, and as to the Defendant Drewry Murfee, who is out of the Country, against whom the Plaintiff appears to have proceeded in the mode prescribed by law, and he still failing to file his answer, the Court doth take the bills for confessed as to that Defendant, and the cause coming on to be heard on the bills, answers of the other Defendants, and exhibits, was argued by Counsel: On consideration - whereof, the Court doth Adjudge, Order & Decree, That a Commissioner of this Court take the following accounts, that is to say 1st no account ascertaining the amount of the Plaintiffs demand; 2nd, that the Deft. Briggs, Administrator of Samuel Calvert, render an account of said Calvert’s transactions as Ex’or of Simon Murfee, dec.; 3rd. that Thos. Ridley render an account of his transactions as Committee and Admr. de bonis non, &c. of the said Simon Murfee, dec., paid since his death bound his heirs; and the Court without now deciding that the Defendant Abraham Gardner is responsible for the Plaintiffs demand, or any part thereof. doth further Adjudge, Order & Decree, that the said Commissioner also make and possessed, or otherwise entitled, and which came to the hands of the Defendants, or either or them, shewing the fee simple and probable annual values thereof, and report what am’t. of debts binding the heirs, has been paid out of the personally, and liberty is reserved upon the usual terms to the other creditors of the said Simon Murfee, to show & prove the claims to which they are respectively entitled which said several accounts the Commissioner is directed to examine, state and settle, and to the Court report, with any matters specially stated, deemed pertinent by himself, or which may be required by the parties to be so stated.
