Murphy, 27 Mar 2001] 373 This Indenture made on this fifteenth Day of July in the year of Christ one thousand seven hundred and seventy three Between James Murphey of the County of Pittsylvania of the one part and Thomas Murdoch for James Murdoch & Co. of said county of the other part WitneSseth that for and in consideration of the sum of Fifty nine Pounds Eighteen shillings and nine pence 1/2 penny Current Money which the said James Murphey justly Indebted to the said Thomas Murdoch & Co. and Honestly desire to secure and pay to them for and in the farther consideration of the sum of five shillings like money to the said James Murphey in hand paid by the said Thomas Murdoch at and before the sealing and Delivery of this the Receipt whereof he doth hereby acknowledge and thereof and of every part thereof doth Exonerate and Discharge the said Thomas Murdoch his Heirs Excrs and Admrs the said James Murphey hath Granted Bargained Sold & confirmed and by the presents doth Grant Bargain Sell and Confirm so the sd Thomas Murdoch his Heirs an aSsigns forever Two hundred acres of Land in Pittsylva. County and Lying upon a Branch of Elkhorn Creek and Joining the Lands of James Leak Senr. and Thomas GlaSscock being the Plantation whereon the said James Murphey now lives with all the appurtanences belonging or in any wise appurtaining to the Premises hereby Granted or intended to be Granted and the Reversion and Reversions Remainder and Remainders and all services, Benefits and Profits of the said Land and Premises and all his Rights claims Interests and securities Relating to the same To have and to hold the said Land and other Premises unto the Thomas Murdoch his Heirs and aSsigns forever to the only Proper use and behalf of him the said Thomas Murdoch his Heirs and aSsigns forever and the said James Murphey doth hereby Grant for himself & his Heirs that he the said James Murphey and his Heirs and every of them shall and will Warrant and forever Defend the said Land and other Premises and every part and forever Defend the said Land and other Premises and every part and article thereof with all and Singular their Rights and appurtanences unto the said James Murphey and his Heirs and every of them and against every other person whomsoever upon Trust NevertheleSs that the said Thomas Murdoch his Heirs Exers Admrs or aSsigns shall after the Twenty fifth Day of December in the year of Christ one thousand seven hundred of seventy four or as soon as the said Thomas Murdoch his Heirs Exers Admrs or aSsigns shall think proper or the said James Murphey shall Request them which ever of these two circumstances shall 374 shall first happen. Sell for the best price that can begotten after Giving ten Days Publick notice the said Land and Premises and out of the money arising from such sale discharge pay and satisfy themselves the above mentioned Sum of Fifty nine Pounds Eighteen shillings and nine pence half penny with Lawfull Interest form the fifteenth Day of July One thousand seven hundred and seventy three untill the same shall be fully Discharged and the expenses attending the Draws and Recording this Indenture and the contingent charges of the sale as aforesaid and other neceSsary expences that shall attend the securing and obtaining the above mentioned money or Performing any thing that is or shall be neceSsary Relative to the intent of this Indenture and that the said Thomas Murdoch his Heirs Exers admrs or aSsigns shall pay or cause to be paid the overplus if any remain from such sale to the said James Murphey his Heirs Exers Admrs or to his as their order.
