Murphy, 5 Apr 2001] Irbye from Murphy Deed This Indenture made this 15th Day of October in the year of our Lord Christ One thousand Seven Hundred & Seventy Nine, Between James Murphey of Pittsylvania County and State of Virginia of the one part and Charles Irby of Halifax County and State aforesaid of the other part WitneSseth that the said James Murphey for and in consideration of the Sum of Twelve Hundred Pounds Current Money of Virginia to him in hand paid by the said Charles Irby, the Receipt Whereof the said James Murphey doth hereby Acknowledge Hath Given Granted bargained & Sold, and by these presents doth Give Grant bargain Sell Alien EnSsoff[?] and Confirm unto the said Charles Irby his Heirs and aSsigns forever on Certain Tract or parcel of Land Lying and being in Pittsylvania County containing by Estimation One Hundred and Seventy three Acres being the same Moore or LeSs it being the Land that Nathaniel Terry conveyed to the aforesaid James Murphey by Deed recorded in the County Court of Pittsylvania the Twenty eighth day of March Anno Domi 1771, Reference being there unto had may move fully Appian[?] Which said Land the said James Murphey conveyed by a Deed of Trust & in consideration of Fifty pounds eighteen shillings and Nine pence half penny Virginia Money, to James Murphey hath paid to the Provision of Virginia as of receipt the 25th Day of February Ann. Dom. 1779. Agreeable to an act of ASsembly in that Case made and provided Which Land is bounded as follows to Wit, Beginning at a Red oak in Leaks line thence Nine Dividing Lines South eighty five degrees With one Hundred 467 and forty poles to a Hickory North Ten degrees West one Hundred and Ninety eight poles CroSsing the fork branch of Elkhorn Creek to pointers North Seventy five degrees East one Hundred and Sixty Six poles to pointers in GlaSscocks line thence along his line South ten degrees West Eighty three poles to a pine thence a Long Leaks Line South Ten degrees East one Hundred & twenty poles CroSsing the aforesaid fork branch of Elkhorn Creek to the beginning it being the Land where the said James Murphey Now lives To have and to hold the aforesaid Granted bargained premises With all and Singular the Rights, Benefits privaledges and appurenances thereunto Belonging to the paid Charles Irby to him his Heirs and aSsigns forever & the said James Murphey doth hereby these presents Warrant, and Will forever defend the aforesaid Granted & bargained Land and Premises, With all the appurtenances-- thereunto belonging unto the said Charles Irby his Heirs & aSsigns forever and to be at the time of Granting the same free and clean of and from all Manner of Incumbrances, and from the Just Claim of any person or persons Whatsoever In WitneSs Whereof the said James Murphey hath hereunto set his hand and affixed his Seal the day and Year above Written.
