[Deed from Smiths to Eugenia Bass & Emedicus Murphy, 1853] [Washington Co. MS, from TN State Library & Archives, Nashville] [Provided by Nancy Hunt, transcribed by Mark Murphy, 11 Jan 2002] This Indenture made and entered into this 26th Dec 1853 between Abram F. Smith and Sally Myra Smith his wife of the first part and Eugenia P. Bass and Emedicus Murphy of the second part both parties of the county of Washington & State of Mississippi. Witnesseth that for and in consideration of the sum of two thousand dollars to the party of the first part in hand paid, the receipt thereof is hereby acknowledged and and for the further consideration of two Bills of Exchange of this date one for the sum of four thousand two hundred and forty dollars, the other for the sum of six thousand three hundred and sixty & drawn by C.R. Bass in favour of said Murphey and accepted by Wright Williams & Co. payable the first of January 1855 and for the further consideration of the promissory note of the said C.R. Bass and Murphey for the sum of two thousand dollars executed to the said Smith payable the first part of January 1856 and bearing interest from the first of January 1854 at six percent per annum. The parties of the first part have bargained & sold and by these presents doth bargain, sell align[?] and convey to the said Eugenia P. Bass and Emedicus Murphy the following tract or parcel of land lying being & situated in the county and State aforesaid and described as follows to wit= Lots three, four, five six seven & eight of section seven Lots one, two, three & four of section eight Lot two of section Twenty-six and so much of Lots one & three of section Twenty-six as lies on the West side of Roll's Bayou, containing in all about Eight hundred & thirty seven acres more or less, all in Township Fourteen Range, nine West- To have and to hold the said tract or parcel of land wuth all and singular the appurtenances thereunto belonging to the said Eugenia P Bass and Emedicus Murphey and their heirs forever as tenants[?] in common[?] and [written sideways across first page] I hereby release all my rights title and interest to to[sic] the within Deed as a mortgage having received from the parties[?] the purchase money secured by this Deed. Smith who aknowledged that he signed and sealed the above release as his voluntary act and deed on the day of the date thereof for the[?] sefness[?] purposes therein specified. Smith, who acknowledged that he signed, sealed, and delivered the foregoing Instrument of Writing as his act and deed And the said Sally Myra his wife, upon a private examination by me, separate and apart from her said husband, aknowledged that she signed sealed and delivered the foregoing Instrument of writing as her voluntary act and deed without any fear, threats or compulsion on the part of her said husband and that she does not wish to retract from the same- Given under my hand and seal this 26th Dec 1853- David L.
