RICHARD SMITH and ANNE TURNER
Of
Pickawaxen Parish, Charles County Maryland

From Bennie Lou Hook Altom's "SMITH Files"

RICHARD SMITH  of Pickawaxen Parish, Charles County Maryland married by 1688 ANNE TURNER, daughter of ARTHUR TURNER and his second wife MARGARET.   Richard Smith's name first appears in the records of Charles County as early as 1658  in a court case involving Arthur Turner (1622-1666) who eventually became Richard Smith's  father-in-law.  The tract of land called Pickawaxen  was granted  to Richard Smith on 13 Aug 1658.  This is explained in the deed record of 1756 when Richard Smith, Jr.  sold 100 acres of  Pickawaxen  to Charles Yates. [CCLR 1752-1756, p.494]  The last Smith family record of  the tract known as Pickawaxen is a 1770 deed where  Richard Smith  sells the last few acres to Hugh Mastin [CCLR S-3, P. 42]    Whether  Richard Smith of the 1658  record is the same Richard Smith, or the father of  Richard Smith, who married Anne Turner is not clear.  It  is clear, however, that parts of the Charles County Maryland land tract called Pickawaxen remained in this Smith family for over 100 years (1658-1770).

Children of RICHARD SMITH and ANNE TURNER from land records and from Early Charles County Maryland Settlers, Bates & Wright, 1995, P.255;  and Early Families of Southern Maryland, Vol. VII,  Elise Jourdan, 1999, P.204:
                1   Richard Smith, b. 1688 *
                2   Elizabeth Smith, b. 1690
                3   Arthur Smith, b. 1692
                4   James Smith, b. 1694

1-1   Richard Smith, b. 11 Jul 1688 (CCLR Q.14), d. ca 1762, s/o Richard Smith and Anne Turner, m. Mary ____.   Depositions made by Richard Smith in 1761 prove his age as 73 which is consistent with his 1688 d.o.b. (CCLR K#3 54.307).   Children:

    11-1   Richard Smith, b. ca 1726
    11-2   James Smith, b. ca 1727 [m/ SARAH TURNER] *

13 June 1748; James Baily to Richard Smith 35 acres of Long Point, and 4 acre tract called Bailey's Fancy,  originally called Douglass Delight adjoining Richard Smith [CCLR Z#2-P.269].

23 Jul 1748; Richard Smith to Thomas Hungerford, 3 tracts being contiguous in Wm. & Mary Parish;  26 acres of Longest Day, 4 acres of Baileys Fancy, 34 acres of Long Point, acknowledged by Mary Smith, wife of Richard Smith [CCLR Z#2.P.120].

20 Jun 1753; lease from Richard Smith to William Hungerford; tract called Lawger
 [Lugar], 100 acres for 10 years. [CCLR 1752-1756, P. 120]

21 Feb 1754 from Richard Smith, Sr. of Charles Co., planter, to his son, Richard Smith, Jr., part of 3 tracts near Pickawaxen Church called Longest Day, Second Thought, and Pickawaxen bounded by Lugar.  Ack. By wife of Richard Smith, Sr., Mary. [CCLR 1752-1756, P.189]

21 Apr 1756 - from Richard Smith of Charles Co., planter, to Charles Yates, 100 acre tract called Pickawaxen adjoining land formerly laid out for Richard Smith and granted to said Richard Smith's grandfather on 13 Aug 1658 (no ack. by wife, Mary).  [CCLR 1752-1756, P.494]

Among the numerous land records available on Richard Smith (1-1) is a land record dated:
21 Mar 1757 - which states Smith was asked to run by his conveyance a land boundary [CCLR 1752-1756, P.54].  Apparently, Richard Smith was a surveyor.  This skill was passed down in the Smith family for generations as James Norman Smith clearly details in his Memoirs how his father taught him techniques for surveying and had an old lock stock compass made for this purpose.  [Memoirs P. 196]

7 Mar 1761 - lease dated from Richard Smith, Sr. of Charles County to William Shaw part of a tract called Smith now in possession and occupation of James Smith, Sr.  (CCLR 1756-1761, P. 542.) The significance of this deed is that it proves James Smith and wife Sarah Turner were living in Charles County at this time.  While many Halifax County Virginia records prove the relationships between James Smith of Pickawaxen and the Turners of Prince William County, Virginia, the only record found of James and Sarah in Virginia prior to 1770  is the following:

22 April 1751  Robert Frogit of St. Mark's Parish, Culpeper CoVA, blacksmith, to James Turner of Hamilton Parish, Prince William CoVA, planter, mortgage for 24 pounds current money.  Signed: Robert Frogit. Witnesses: James Smith, Sarah Smith, Mary Turner.   [Culpeper CoVA Deeds 1749-1755, P.307]

Richard Smith, Sr. died about 1762 as evidenced by the following record along with the 1766 deed from James Smith, Sr. to Samuel Love, Gent., and William Courts, s/o William until William arrives at age 21, all land of said Smith in Pickawaxen Neck on east side of Smiths formerly called Bennet's Branch. [CCLR O#3, P.114].

2 May 1761 - from Richard Smith, Sr. of  Charles County, planter, to his son, James Smith, of Charles County, tract where I now dwell in William and Mary Parish called Smith lying on the north side of the Potomac; containing 100 acres; excepting 60 square feet containing graveyard; Richard Smith reserves use for his natural life.  [Charles County Land Records 1756-1761, p. 539]

11-1 - RICHARD SMITH, JR.  remained in Charles County Maryland.  Numerous land records are available, however,  none mention a wife or children.

14 May 1765 - from Richard Smith, planter, to Richard Lee, Gent. Part of two tracts called Longest Day and Biter is Bitt in Wm & Mary Parish [CCLR L#3, P. 689].

14 May 1765 - from Richard Smith, planter to Richard Lee part of three tracts in Wm. & Mary Parish near Pickawaxen Church called Longest Day, Second Thought, and Pickawaxen, containing 100 acres conveyed from Richard Smith (now dec'd) to his son the said Richard Smith by deed of gift (CCLR A#3, P. 191), excepting that portion of Longest Day which the said Richard Smith sold the said Richard Lee [CCLR L#3, p. 692].

30 Jul 1770 - from Richard Lee to Richard Smith part of three tracts called Longest day, Second Thought, and Pickawaxen containing 100 acres; except that part of Longest Day conveyed to said Lee by deed dated 14 May 1765 containing 21 acres [CCLR S#3, P. 10].

15 Aug 1770 - from Richard Smith, planter to Huse [Hughs] Mastin, 4 tracts called Longest Day, The Biters Bitt, Pickawaxen and Second Thought in Wm. & Mary Parish bounded by Lugar containing 73 acres and 27 perches.  No acknowledgement by wife. [CCLR S#3, P.42].

15 Aug 1770 - from John Baulhope, attorney for Charles King and Sarah his wife of VA, to Richard Smith, two tracts in Wm. 7 Mary Parish called Wakefield and Ratsdale, containing 73 acres [CCLR S#3, 58; S#3, P.148].

22 Oct 1770 - from Edward Smoot to Richard Smith, tract called Wakefield and part of a tract called Ratsdale, containing about 73 acres, whereupon Abednego Jenkins dwells, bounded by Esq. Lee's Second Purchase and land of Wornall   [CCLR S#3.62].

11-2 - JAMES SMITH  m. Sarah Turner, d/o James Turner, formerly of King George CoVA and Kerenhappuch Norman of  Spotsylvania CoVA.  This family connection is proven by deeds of  Halifax VA 1770-1785 and Richmond NC 1785-1815.

[Other Sources:  Southerland Latham and Allied Families, by Edward Kinsey Voorhees, 1931, (LDS);  Memoirs of  James Norman Smith (1870) available in the American History Archives of the University of Texas at Austin; Normans of Normandy Hall, 1976, Dr. Lois Norman, (LDS); History of the Culpeper Normans, Nellie Norman, Culpeper VA,  1966; Early Families of Southern Maryland Vol. VIII, by Elise Greenup Jordan, 1999 and numerous DAR member application records. ]

3 June 1766 - from James Smith, Sr. [of Charles County MD] to Samuel Love, Gent. And William Courts, all land of said Smith in Pickawaxen Neck on east side formerly called Bennett's Branch now called Smiths for 50 pounds gold and silver.  [Charles County Land Records O#3, P. 114]

Note:  The above 1766 deed reflects the time when James Smith of Charles County Maryland sells the property he inherited from his father and moves to Halifax, Virginia.  However, James Smith  returns to Charles County MD on two later occasions in 1770 and again in 1783.

2 Feb 1770 - JAMES SMITH of HALIFAX VA, planter, to Barnet Barber of St. Mary's Co.MD, for 3,000 pounds tobacco, part of tract of land in Charles CoMD called Live Oak Swamp adjoining Batchelor's Delight (formerly in possession of  Barton Hungerford) containing about 15 acres.  [CCDB O#3, P. 666].
13 Sep 1783 - from JAMES SMITH of Halifax VA to John Bateman of Charles Co MD, planter, two parts of tracts in Wm. & Mary Parish called Wakefield and Ratsdale, containing 73 acres, bounded by Esq. Lee's Second Purchase and the land of Warnal [CCLR 1782-1786 P. 36].
Sylvestor Chunn is significant to James Smith in Charles CoMD, Halifax CoVA, Richmond CoNC, and Maury CoTN .   According to James Norman Smith's Memoirs, Sylvester Chunn was the SMITH Family -Overseer- for most of his life.   The following deed represents the actions of  Sylvester Chunn on 13 September 1783 in Charles CoMD just as the preceding two deeds reflected the actions of James Smith of Halifax VA on the same day.

13 Sep 1783 - from Sylvester Chunn of Halifax CoVA to Levi Chunn and Edward Garner of Charles CoMD for 125 pounds about 100 acres on west side of Wiccomocco River, being part of tract called Wiccomocco Fields.  Also conveyed to Levi Chunn and Edward Garner is all said Sylvester Chunn's right to the personal estates of Joseph and Catherine Chunn of St. Mary's CoMD, dec'd [CCLR 1782-1786, Page 19].

10 Sep 1767 - Patent - Halifax CoVA, 400 acres on branches of Buffalo Creek bounded by [James Smith's] own corner line, Echol's line [Joseph Echols] and Francis Luck's line.  [VA Land Office Patents- 37, P. 214].
