LL/1836/47 - Dingestow - Edmund BLOWER Will and Codicil Proved 10 June 1836

In the Name of God, Amen. I Edmund BLOWER of the Parish of Dingestow in the County of Monmouth Farmer do make this my last Will and Testament. I give and devise all my Messuage Lands and Premises situate at Dingestow Bridge in the Parish and County aforesaid with the appurtenance (subject to two several mortgages of two hundred and fifty pounds and fifty pounds now charged thereon) and all other my Real Estate unto Walter NICHOLAS and William NICHOLAS both of the Parish of Cwmcarvan Farmers their heirs and assigns Upon Trust that they the said Walter NICHOLAS and William NICHOLAS and the survivor of them and the heirs and assigns of such survivor do as soon as conveniently may be after my decease (subject to the proviso hereinafter contained) either by Public Auction or Private Contract and together or in parcels as to them or him shall seem expedient absolutely sell and dispose of all my said Lands and Premises for the best price in money that can be reasonably obtained for the same, and to convey and release the same accordingly, and thereupon do out of the monies to arise by such Sale pay and discharge the said two several mortgage debts or sums of two hundred and fifty pounds and fifty pounds and all interest which may be due thereon unto the Person or Persons entitled to receive the same respectively, and then do out of the said monies so to arise as aforesaid pay the sum of one hundred pounds sterling unto my dear wife Mary BLOWER for her own use, and then shall divide all the rest of such monies so to arise as aforesaid between my three daughters, Ann NICHOLAS, Mary BLOWER and Temperance LANSMAN for their benefit respectively. And I do hereby declare that the Bequests so made to my said wife and children shall be vested interests in them respectively immediately on my decease, provided that my said wife shall have the full use and enjoyment of my said Messuage Lands and Premises at Dingestow for the term of one year from the day of my decease rent free and that any Sale thereof shall be made subject to this proviso. And I do hereby declare that the receipt or receipts of my said Trustees for the time being or the survivor of them for the money for which the said hereditaments hereby made saleable shall be respectively sold shall from time to time be a sufficient discharge to the purchaser thereof for his or her purchase money or for so much thereof as shall therein be acknowledged to have been received, and that such purchaser shall not be obliged to see to or be answerable for the application or misapplication of his or her purchase money. And I give and bequeath unto my said two daughters Mary BLOWER and Temperance LANSMAN all such of the household goods and furniture now in my possession as belonged to their late mother my former wife to be divided between them by my Executors hereinafter named. All the rest of my household goods and furniture I give and bequeath to my said wife for her own use, also the dairy and brewing utensils with the exception of what belonged to my former wife. And whereas I some time ago paid one Mary EVANS the sum of fifty pounds made payable to her by the Will of Ann MORGAN and charged upon premises in Mary Port Street in the Town of Usk wherein I have now a life interest, and the amount of which sum I consider I am still entitled to receive from and to be paid out of the said premises. Now I give and bequeath the said sum of fifty pounds and all my right and interest in the same sum unto my eldest daughter Elizabeth DAVIES for her own use together will all such powers as I now possess for enforcing the payment thereof, but it is nevertheless my Will that no interest on the said sum shall be claimed or received by her or any other person as interest due thereon prior to my decease. And it is my wish and desire that my Executors shall pay out of the sale of my Estate to two of my daughters such sums of money as may be due to them, viz £10 to Mary BLOWER and £12 to Temperance LANSMAN, which they have not received as part of a Legacy left to them some years ago by my late Stepfather Mr Thomas PRITCHARD. I also give and bequeath to my eldest son Walter BLOWER £5 and to my youngest son William BLOWER £10 to be paid to them by my Executors upon the sale of my house and lands. It is also my will and desire that my daughter Mary BLOWER should have her portion of the sale of my Estate paid to her at three shillings per week, and should she die before the whole is paid the remainder to be divided between her three surviving sisters, Elizabeth, Ann and Temperance. And as it is my wish that my wife should have the management of my funeral after my decease I hereby give and bequeath to her the cattle, hay, implements of husbandry etc for her use towards defraying the expenses thereof, Doctor’s Bill and Spirits etc. All the rest and residue of my Personal Estate and Effects whatsoever I give and bequeath unto the said Walter NICHOLAS and William NICHOLAS In Trust in the first place to pay all my just debts (except the said mortgages) and testamentary expenses, and after payment thereof to divide the remainder (if any) between my said three daughters Ann, Mary and Temperance for their own use. And I appoint the said Walter NICHOLAS and William NICHOLAS joint Executors of this my Will. And lastly I do hereby declare that the said Walter NICHOLAS and William NICHOLAS their heirs Executors and Administrators shall have and enjoy the usual indemnities and powers of reimbursement as are usually given to Trustees in cases of the like nature and shall be answerable for their own respective Acts and Deeds only.

And whereas I Edmund BLOWER did in this my Will and Testament bearing date this same day direct that the sum of fifty pounds should be paid to my daughter Elizabeth DAVIES, it is my will and desire that the sum be paid to my daughters Anne NICHOLAS and Temperance LANSMAN share and share alike, instead of to the above Elizabeth DAVIES, and I do hereby declare this present writing to be a Codicil to my said Will, and direct the same to be annexed thereto and taken as part thereof.
