Know all men by these presents that I, Joseph Elder of the township
of Ligonier,
County of Westmoreland and State of Pennsylvania, being weak in
body, but of sound mind,
memory and understanding, blessed be God for his mercies, do make
and publish this my last
will in manner and form following to wit, First, It is my will and
I do order and direct that all my
present debts and funeral expenses be duly paid and satisfied as
soon as conveniently can be
after my decease. Second, I give and bequeath to my wife Eliza
the use and occupation of my
plantation as long as she remains my widow. Third, It is my will
and desire that when my wife
ceases to be my widow, either by death or marriage, then my real
estate shall be sold, and the
proceeds equally divided among my four children to wit, my daughter
Mary now married to John
G. Lowry, my daughter Margaret Jane, now married to Thomas J. Smith,
my daughter Elizabeth
and my son William A., my son John M. Elder having received all
I intended to give him, I leave
him nothing more. Fourth, It is my will and desire, that my
personal property be sold, and the
proceeds applied to the payment of my just debts, by my executors
hereinafter to be named, and
lastly I nominate constitute and appoint John McFarland and Thomas
J. Smith to be the
executors of this my last will and testament. In witness whereof
I have hereunto set my hand and
seal the 24th day of June one thousand eight hundred and sixty eight.

Petition of Margaret Jane Smith to Judge of the Orphans Court of
Westmoreland County.
1. Joseph Elder of Ligonier Twp. died on 27 June 1868 owning a tract
of land adjoining the lands
of Samuel Elder, Thomas Dunn, Ligonier Valley RR, Myers Clifford,
W.P. Ambrose and M.B.
Smith containing 145 acres
2. Will grants wife Eliza use and occupation of plantation as long
as she remains his widow.
3. Upon Eliza's death or marriage, Will of Joseph Elder requires
land to be sold and equally
divided among his four children; Mary married to John G. Lowry,
Margaret Jane married to
Thomas J. Smith, daughter Elizabeth (now married to W. A. Shoup),
son William A.
4. Eliza Elder died on 22nd Sept. 1889.
5. Said children are now living and of age.
6. Will failed to grant authority to sell land.
7. Executers John McFarland and Thomas J. Smith having died, Court
issued Letters of
Administration to W. A. Shoup.
8. Petitioner desires sale of land and requests that court appoint
W. A. Shoup as Trustee for sale.
Nov. 16th 1889 petition granted, sale ordered for 21st Dec. 1889

Jan. 31st 1890 Trustee reports to court that land not sold due to
lack of buyers.
Nov. 15th 1890 Court orders new sale for 27th Dec. 1890.
3rd Jan. 1891 Trustee reports sale of land on 27th Dec. 1890 to
