The Last Will and Testament of Caleb Bales In the name of God Amen, I Caleb Bales of the County of Independence and State of Arkansas, being of sound mind and memory and considering the uncertainty of the frail and transitory life do therefore make, ordain and publish and declare this to be my last will and testament. That is to say, first after all my lawful debts are paid and discharged, the residue of my estate real and personal I give, bequeath, and dispose of as follows: "to wit" To my beloved wife Jane, the land and appartenances situated thereon, known and described as the E1/2 of SE1/4 of NE flys of the sec 2 and tho it mgr of NE1/4 sec 11 all in township fourteen North of Range 6 West, making in all aggregate 240-88/100 acres lying in the County of Independence and State of Arkansas together with all the stock of every kind and the increase thereof now possessed by me and all of which I may be possessed at the time of my decease during her widowhood, or the term of her natural life, and after her death to be divided equally among my heirs, except my daughter Susan. To her I give and bequeath the sum of Five Dollars. I give, bequeath and devise all the rest residue and remainder of my real and personal estate to my children now living or to their heirs who may be living at the time of the decease or mariage of my beloved wife Jane to be divided equally between them, share and share alike. Likewise, I make constitute and appoint my beloved wife Jane to be Executrix of this, my last will and testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto sibscribed my name and affixed my seal the 30th day of June in the year of our Lord, one thousand eight hundred and fifty-one. Caleb Bales (Seal) The above and foregoing instrument was subscribed by the said Caleb Bales in our presence and acknowledged by him to each of us and he at the same time published and declared the above instrument so subscribed to be his last will and testament and we as the testators request and in his presence have signed our names as witnesses (witnesses) and written opposite our nams our respective place of residence. The following is the Last Will and Testament of James Phipps (1751-1829), Guilford County, North Carolina on October 14 1829. Source of information: SLC F 502,409 Wills 1771-1859 (File #0617 p.395) In the name of God Amen, I James Phipps Senr being weak in body but sound mind and memory do make and ordain this my last will and testament in manner of form following. First all I give my soul to God who gave it to me and my body to the dust from whence it came to be buried in a Christian decent manner at the direction of my Executors and as to my worldly substance I leave in the following manner. Viz Item 1st - I will that my just debts be paid out of my Estate by my Executors Item 2nd - I will that my Executors after my decease to sell as much of my personal Estate as will pay my just debts and all expenses. Item 3rd - I will that my beloved wife Abrigail Phipps have all my real and personal estate during her life in widowhood and after her death a division as follows: Item 4th - I will that after my wife's death that my Executor proceed and sell the plantation and all the property left by my widow and divide as follows - Item 5th - I will that my beloved daughter Rachael Phipps rec Ten Dollars of my Estate Item 6th - I will and bequeath to my daughter Sally Phipps Ten Dollars Item 7th - I will and bequeath to my daughter Ann Mooney Ten Dollars Item 8th - I will and bequeath to my grandson Edward P. Gamble Five Dollars Item 9th - I will and bequeath to my son Benjamin Phipps One Dollar Item 10th- I will and bequeath to my son-in-law Garland Conrade Richardson One Dollar for his children, and after the above named term is passed, the balance to be divided as follows: equally between my son Joseph Phipps, Susanna Hagey (Heague), Abrigail Phipps, Rachael Phipps, Ann Mooney, Sally Phipps, Peggy Phipps and James Phipps. |
