  Jonathan Day was born Abt. 1770, and died Abt. 1838 in Wilkinson Co., MS (Probable). He married (1) Miss Trice, daughter of John Trice and Elizabeth Unknown. He married (2) Celia or Cathy Oglesby 20 May, 1810 in Amite Co., MS.

Children of Jonathan Day and Miss Trice are:

1. Sally Day, born Bet. 1800 - 1805 in State of Georgia; died Aft. 1870. She married Thomas Ashley 04 May, 1820 in Amite Co., MS.

2. Rebecca Day, born Abt. 1794 in State of Georgia; died in Amite Co., MS. She married Isham Randall 10 December, 1810 in Amite Co., MS.

3. Mary Polly Day, born Abt. 1794 in State of Georgia. She married (1) Thomas East 20 August, 1812 in Amite Co., MS. She married (2) John H. Shropshire 15 December, 1816 in Amite Co., MS.

4. Tabitha Day, born Abt. 1798. She married Walter Shropshire 18 December, 1817 in Amite Co., MS.

 

Children of Jonathan Day and Celia Oglesby are:

1. Jonathan Jefferson Day, born Abt. 1815; died Abt. 1884. He married Jane Ashley 25 March, 1838 in Wilkinson Co., MS.

2. Melinda Day, born Abt. 1817; died Abt. 1902. She married Julian Parker 28 August, 1837 in Wilkinson Co., MS.

3. David Day, born 17 January, 1818; died 12 December, 1903. He married (1) Mahala Arsilla Byrd 10 July, 1838 in Wilkinson Co., MS. He married (2) Mary Indiana Hastings 17 December, 1878 in Wilkinson Co., MS.

It is probable that Jonathan’s parents were Robert Day and Elizabeth Adams.

There is some relationship to Robert Day, Sr. and wife Fanny of Amite Co., MS, and probably the same as at Warren Co., GA Baptist church below.  Robert is probably a brother to Jonathan, Sr.

27 Aug 1800: State vs John Little, incident assault; The defendant came into court with Jonathan Day his security who acknowledged themselves bound to his Excellence the governor and his successors in office in the sum of one hundred dollars each, to be levied fo their respective chattles, and land but to be void on condition that the said John Little shall make his personal appearance at the next Superior court for the county of Hancock, abide the order of determination there of not depart without leave taken and acknowledged in open court this 26 th day Aug 1800. signed by John Little and Jonathan Day.

Jasper Co., GA Will BK 2, page 308: 30 Jan 1807: Whereas I have sold the chances of my draws in the present land lottery to Ephriam Ellis and am about to remove away, I appoint Joseph Baker my Lawful Atty. that if my Land should be drawn in my name he may take out a grant or grants and execute title to Ellis.  signed Jonathan Day.  Witness: Margit Baker, Robert Flournoy, JP; recorded 23 Jul 1810.

A Jonathan Day is found in the church membership of Long Creek Baptist Church, formed in 1786, in Warren Co., GA.  The records of his membership cover the years 1786-1797 under the minister Rev. Jeptha Vining.  Listed in the same record with Jonathan are: Robert Day, Sr. and Jr. and Fanny Day (thought to be the wife of Robert, Sr.) ; also John Trice, Sr. and Jr. and Sarah and Frances Trice.  A Robert Day, Sr. and wife Fanny and a Robert Day, Jr. also appeared in Amite/Wilkinson County, MS at the same time that Jonathan did.  Robert Day, Sr. and wife were charter members of Zion Hill Baptist Church in Amite County.

Jonathan Day, Sr. is listed in the will of John Trice, Sr. as an heir; Will BK 1809-51, pp. 13 & 14, Jones Co., GA.

Cherokee Indian Agency Passports, page 119, Chickasaw Agency; 01 Jun 1807:

Sir-A traveller, by the name of Jonathan Day reported to me, a few days since, on his way to Natchez, that he had lost a bay mare near the mouth of Tellico River on the 20th April...The owner, Mr. Day, is a poor man with a family and the loss of his horse would injure him materially.

 

Jonathan has a land record in Mississippi # 326; 25 Aug 1808 for 320 acres on Beaver Creek in Wilkinson County; American State Papers II, pp. 248.  This land is very near the Amite/Wilkinson County borders. He was a charter member, along with 2nd wife Oglesby, of Galilee Baptist Church, Gloster, Amite Co.,  MS which was constituted 14 Aug 1824.  He was elected Clerk of the Church in 1829 and served from then until December 1836 when "found to be in a poor state of health."

Jonathan may also have had other children as an early census shows him with two sons and five daughters. Possibilities for these children are: Robert(who stood bond for several of the known daughters marriages), Fanny  who married Richard Oglesby, Amite Co., MS and Tiller or Siller who m. Henry Melton, Amite Co., MS.

"To Hiram Ashley, Wm. Floyd and Joseph McCearly; greeting; to jointly appraise goods and chattels and personal estate of Jonathan Day, late of WILKINSON County, deceased "  09 Jul 1838.

The estate of Jonathan Day, deceased, was appraised 11 Aug 1838 by : Joseph McCearley, Hiram Ashely and William Floyd.  11 Aug 1838 Notarized by John Ashley, J.P.

The estate of Jonthan Day, deceased, was sold by order of the court, 22 Jan 1839 for $430.59.

Jonathan Day, Jr. (may be Jonathan Jefferson Day) applied to court for Walter Shropshire to show cause where he, Jonathan, Jr., the lawful heir should not be the administrator.  It was supposed to be presented in the August Term of Court, but all pages from that term missing from the book when it was checked.

On the application of Walter Shropshire it is ordered that letters of administration be granted him on the  estate  of Johnathan Day decd.  on his entering into bond in the sum of sixteen hundred dollars with David Pool  and Benjamin White as his securities, bond taken and oath administered.

On the Application of Walter Shropshire it is ordered that Hiram Ashley, Wm. Floyd and Joseph McCurley be   appointed appraisers on the estate of Johnathan Day dec.

On the application of Walter Shropshire admt of the estate of Jonathan Day decd.  it is ordered that said Admt   have leave to sell the personal property belonging to said estate on a credit of six months complying in all ways respects with the statute in such case made and provided.

On the application of Johnathan Day Jr. it is ordered that a citation issue to Walter Shropshire to shew cause if  any he can why the letters of admt granted him by the  court on the estate of Johnathan Day Sr. decd. should not be revoked and granted to Johnathan Day Junior the person entitled by law to said  Administration.    the above was recorded a second time on 11 July 1838.

On the suggestion of Walter Shropshire admt of the estate of Johnathan Day died that it would be to the advantage of said estate to sell the land belonging to said estate it is therefore ordered that a citation issue to all persons interested to appear before said court on the first day of the next November term there of to show cause if  any they can why said land should not be sold  An inventory and appraisement of the estate of Johnathan Day was returned to court by W. Shropshire admt  which was recd, approved and ordered to be recorded.  The above two items above were  re-entered on page 41, 12 Sept 1838

Whereas a notice of citation having been published in the Woodville republican and Liberty advocate according to law that Walter Shropshire admt of the estate of Johnathan Day decd.  would atthis term apply for an order of  sale of the real estate of said decd. and no person having appeared to make objection it is therefore ordered that said admt have leave to sell the real estate of saiddecd. on a credit of twelve months complying in all respects with the statute of such case made and provided.

Upon the application of Walter Shropshire administrator of the estate of Jonathan Day deceased, it is ordered that he publish in the Woodville Republican for six weeks unceasingly that he will the nextSeptember term of this  court present his accounts with said estate for final settlement and allowance.

A final settlement of the estate of Jonathan Day deceased was presented to court by Walter Shropshire the Adm.  and it appearing that publication had been made according to Law and no person appearing to make objections the  same was examined allowed and ordered to record and it is further ordered and decreed that said admt pay the Heirs  respectively mentioned in said settlement the sum of fifty one dollars and seventy five cents each and it is further ordered that said admt and his securities be  discharged from any further liability on his administration bond. The estate of Jonathan Day was sold by order of the court, 22 Jan. 1839 for $430.59.

Wood working tools, by name, grind stone, Traps, Hides, set of saws, hoes, plows, harrow, posts, Eastern Ware, 3 sets of books, skillet, clock, 4 beds, set of stone ware, trunk, one hat,  lot of clothing, set of shoe maker tools, one table, one pail, set of pales and bottles, set of chairs, one(unreadable),  one Waggon, set of Oxen, one steer, 6 sets of cows and calves, two cows, 1 lot of cattle,  one saddle and bridle,  1 lot of hogs, Cash $93.12, total estimate of $791.81. 

Bill of Property appraised the 22nd Aug 18389, estate of Johnathan Day dec.d. ,included, 2 yoke of oxen, 35 head of cattle, one lot of hogs, one clock, Beds and furnyture, steds and cot. , one table and furniture, kitchen furniture, 7 chairs, shoe maker punch and tolls, one lot of tools, one Hone, Razor and Box, one pail 2 buckets, lot of stone ware, Trunk, working tools, 2 beaver traps, 1 lot ofhides, grind stone, Saddle and Bridle, 2 ploughs and 1 harrow, 1 mare.  valued at $947. 6?.

1838 July 14: WALTER SHROPSHIRE, admit of the JONATHAN DAY  estate will sell all the personal property.

Sept 15: Land of JONATHAN DAY  is to be sold.

Oct 13: Lands of JONATHAN DAY to be sold by WALTER SHROPSHIRE, administrator of the   estate.

Dec 29: WALTER SHROPSHIRE, adm'r. of the JONATHAN DAY estate will sell land belonging to the estate.

1840  page 29 Vol. 2  T. Molleman vs. Thomas King and WM. TILLERY.

120 acres on Foster's Creek and bounded  by lands formerly belonging to JONATHAN DAY,  is to be   sold to cover claims and cost.

1841 June 5: Theodore Molleman vs. King &  TILLORY  all interest in

170 acres on Foster's Creek bounded by lands formerly owned by J. DAY.  Land levied on the property  of Thos. King, one of the defendants.

1841 July 17: WALTER SHROPSHIRE adm't of the JONATHAN DAY estate.

1842 March 19: N. Scudder, adm'r., of the Arthur Daniel estate will sell 20 acres which includes  the Tan Yard, one  tract settled by JONATHAN DAY,  dec'd., on which he resided at the time of his death, one 900 acre tract, four grown Negroes, together with all the other personal property of said estate.
