Ann was born September 16, 1797 East Nottingham, Cecil Co., Maryland and died May 1886 Cecil Co., Maryland. She lived near the 'Brick Meeting House'. She lived with her sister, Hannah and they manufactured carpets. She was unmarried!

    I Ann Kirk of Cecil County and State of Maryland enjoying perfect health of body and a sound and disposing mind, memory and understanding. Considering the Certainty of Death and the uncertainty of the time thereof, do therefore make and publish this my last Will and Testament in the manner and form following. That is to say.

    1st. I give and bequeath unto my Neice Lydia Ann Brown (wife of Clemson Brown) all of my clothes and wearing apparel.

    2nd. I give and bequeath unto my Sister Hannah Kirk, all of my right and interest in the property and Estate, real and personal (which her and I now jointly own and possess.) during her natural life time, with full power to sell and convey the same or any part thereof.

    3rd. And at the decease or death of My said Sister Hannah Kirk, it is My wish and request and I hereby order and will that the following distribution of the property and Estate remaining be made. To Wit.

    4th. I give and bequeath unto My nephew William K. Griffith One Hundred dollars.

    5th. I give and bequeath unto My Neice Hannah A. Griffith Twenty five dollars.

    6th. And unto the Children of My Brother Jacob J. Kirk, I give and bequeath as follows (Namely) to Lydia Emma Kirk his daughter I give and bequeath twenty-five dollars, in money, one bed two pair of blankets two pair of sheets bolster and pillow cases, one Bureau, and one table all of her own choice. and all of My reading Books.__Unto Samuel Job Kirk his son, I give and bequeath Twenty five dollars.___Unto Archabald Allen Kirk his son I give and bequeath Twenty five dollars.___and unto Slater Lewis Kirk his son I give and bequeath Twenty five dollars.

    7th. I give and bequeath unto Mary A. Brown (daughter of Clemson Brown and Lydia A. Brown) all of the articles marked (M B) which formerly belonged to Mary Job, such as bureau Table chairs, spoons and pewter ware.

    8th. The rest and residue of My estate real and personal I give and bequeath unto My Nephews and Neices (Namely) William K. Griffith Lydia Ann Brown (wife of Clemson Brown) Job M Griffith and Hannah A. Griffith (children of Nathan & Mary Griffith) Lydia Emma Kirk. Samuel Job Kirk, Archabald Allen Kirk, and Slater Lewis Kirk (who are the children of Jacob J. Kirk) share and share alike.

    9th. And lastly I do hereby constitute and appoint William K. Griffith Executor of this my last Will and Testament revoking and annuling all former wills by me heretofore made, rattifying and confirming this and no other to be my last Will and Testement in testimony whereof I have hereunto set my hand and affixed my seal this Sixth day of November, in the Year of our Lord one thousand Eight Hundred and sixty three

    ----Codicil to Will

    Codicil

    Whereas I Ann Kirk of Cecil County, Maryland have made and duly executed my Last Will and Testament bearing date the sixth day of November in the year one thousand eight hundred sixty three which last will and Testament and every clause and bequest dressed therein I do hereby ratify and confirm except the appointment of my Nephew William K. Griffith as my Executor which appointment I hereby revoke and anull and appoint my Nephew Job W. Griffeth sole Executor instead of my Nephew William K. Griffith and I do therefore hereby make this my Codicil which I will and direct shall be taken and held as a part of my last Will and Testament in testimony I have hereunto set my hand and seal this twentieth day of March in the year one thousand eight hundred and seventy eight

    ----Witness Testimonty to authentication

    CECIL COUNTY, ss:
    May 31 188?

    Then came William Kirk and Wilson D. Pierson the subscribing witnesses to the foregoing instrument of writing, and severally made affirmation in due form of law, that they did see Ann Kirk the Testatrix therein named, sign and seal the same; that they heard her publish, pronounce and declare the same to be her so doing she was to the best of their apprehension and belief of a sound and disposing mind, memory and understanding; that the severally subscribed their names as witnesses thereto, in the presence, at the request, of said Testatrix and in the presence of each other.--and in the presence of David Wherry the other subscribing witness and that he signed in their presence.

    Then came Ellis Brown one of the subscribing witnesses to the foregoing instrument of writing and made affirmation in due form of Law that he did see Ann Kirk the testatrix therein named sign and seal the same, that he heard her pronounce and declare the same to be her last Will and Testament, and at the time of her so doing she was to the best of his apprehension and belief of a sound and disposing mind memory and understanding that he subscribed his name as witness thereto in the presence, at the request of said testatrix and in the presence of each of the other subscribing witnesses, and that they signed in his presence and at the same time personally appeared Wilson D. Pierson who made affirmation in due form of law that he is well acquainted with the handwriting of Ellis G. Chandler one of the subscribing witnesses to the said Will, now deceased; that he has frequently seen him sign his name, and that his signature to said Will is genuine and in his proper handwriting; and that the said John W. Ireland the other subscribing witness to said Will has removed from this County.
