    This document shows Archibald Job and John White Jr., as the Executors of John White Sr.'s will, upholding a descision for his widow Agnes to retain 1/3 of his estate as stated in John's will. But it removes the stiplation that she would return any portion to the heirs, should she die or remarry as stated in his original will. We have John's will, this final descision, but not the beginning court proceedings concerning this matter. We also don't have a record of this marriage yet. If we did we could come close to a death date for Mary Job White.

    These documents involve Archibald Job and James MacKay Jr. as the executors of John Hawthorne's estate. During his life, John Hawthorne sold property to John McKnight, but failed to record the transaction. This document makes it official. It is witnessed by Richard Bond, father of Morris Job's wife Lydia, and Timothy Kirk, son-in-law of Thomas Vernon Job's daughter Lydia who married Benjamin Willson...thier daughter Elizabeth married 2nd Timothy Kirk.

    These pages document the bond given for Archibald Job for his first term as High Sheriff of Cecil County. Notice the witnesses. Daniel Job and Sarah Job, his brother and his daughter! Yes, the Daniel could be his son, Daniel Defoe Job, but Daniel Defoe had just gotten married that year in Baltimore. So I speculate it was his brother who was closeby. Also because in the documents to come you will see Daniel the brother there. More speculation: Who is Margaret Campbell? Arch had a sister Margaret b. 1730 that we never found. Could she have married a Campbell?

    Know all men by these Presents that we Archibald Job James Boggs and Thomas Gilleland of Cecil County in the State aforesaid are held and firmly Bound to the State aforesaid in the full Sum and just Quantity of two Hundred thousand Pounds of good Sound Marchantable leaf Tobacco and Casks to be paid to the State to which payment well and truly to be made we bind ourselves and every of us, our and every of our Heirs Executors and Administrators Jointly and Severally for the whole and in the whole firmly by the presents Sealed with our Seals and Dated the Sixteenth day of November in the tenth year of our Independence Annoque Dominy 1785.

    The Condition of the above obligation is such that if the above bounden Archibald Job shall and do well and truly serve the State in the Office of Sheriff of he County of Cecil within the State aforesaid and in all things well and faithfully execute the same office and also shall render to the State and other the officers a true faithfull and perfect Account of all and singular the States rights and dues and to the Officers a true and just account of their fees that he shall of may be entrusted with by the State Governor and other his Officers within this State to receive and collect and his Account to the State and to the Governor and other his Officers within this State for the time being for fines and forfeitures, and other dues belonging to the State or Governor, as also his Account of all fees, dues, and Sums of Money or Tobacco due to any of the good people within the State for any Sum or Sums of Money or Tobacco wherewith the said shall be intrusted during the time of his sheriefalty And in all other things as Sheriff of Cecil County shall behave himself well and honestly towards all persons according to the best of his power skill and Knowledge then this obligation to be void and of no Effect or else to stand in full force Strength and Virtue

    I Archibald Job High Sheriff of Cecil County on the one part and George Bird of Cecil County on the other part witnesseth that wheras the Twenty Second day of November Seventeen Hundred and Eighty Five a certain Bond was perfected and entered into & signed by the said George Bird to the said Archibald Job for the fulfilling & performing the duties appreciating & attending to the duties of an under Sheriff of the said County, and on the back of which said Bond a Certain Instrument and agreement in writing was enforced into of the same date which said writing each of the parties did thereto sign their names of which said writing he the said Archibald Jobe promised to allow & pay to the said George Bird for & in consideration of the said writing he the said heretofore mentioned Bond & the writing theron one third of the profits arising from the Sheriffs office in and for Cecil County & one third of the (?goal) fees for the true performance of the said Bond & acting & doing the business of undersheriff in North Susquehanna South Susquehannah & Charles Town hundreds of doing the necessary writing required for the Sheriffs Office attending the general Court attending the business of the(?goal)& being at one third of the expence of (?goal) provision & wood & (?goalers) Salary & any damages or loss that might happen from or by said (?Goal) & one third Damages of & costs accruing to said office. Now this instrument of writing witnessed that for & in consideration of the said George Birds fully Complying with the contract as is above set forth, up to the thirteenth day of June (?Instant) from the day above mentioned for & in consideration of his faithful services in the duties as is mentioned in the said (?recived) writing as also for the posting & regulating the accounts which ought to be liquidation between us & the (?King) the ballance which have arose in the Sheriffs Office agreeable to the contract & agreement made between he thesaid Bird receving to himself one third part of the profits as is above mentioned & the said Archibald Job for the considerations as (?accrued) do hereby quit claim & release the said George Bird & his heirs from all manner of risques costs & damages that may arrise from & after the said thirteenth day of June (?Instant) as also do release him the said George Bird from the said writing dated the twenty second of November last after this day (?approved) &It is hereby particulary agreed that the said Bird is to be answerable for & liable to pay his proportion of all Damages Costs and charges of said Office up to the said Thirteenth of June (?Instant) if he receives the profits as is above mention & regulating the accounts appertaining to the said Office up to day last mentioned.

    This over-worded deed, yes it is a deed, straitens out 2 Wallace wills where Arch was Executor on both. It seems everyone died. This is a very tough read for even a seasoned genealogist to figure. I'll buy someone an ice cream to tell me the relationships between all the Wallaces mentioned! Is it 4 people? 5? There is a unique word used by Baruch Williams here that I have never seen before...enfeoffed & enfeoff. It means to invest with a feudal estate or fee, whatever that means. It is from the Middle Ages.

    ----transcriber Nancy Thompson writes:
    As best I can tell, Michael Wallace (1) in his will asked that wife Sarah Wallace and son David Wallace sell his plantation after he died. They didn't, so when David died, he appointed in his will Michael Wallace (2) and Thomas Wallace along with Archibald Job executors of his will and they finally got around to doing what Michael (1) wanted...selling his plantation. Michael Wallace (2) bought the property at auction. I can't tell how Michael (2) and Thomas Wallace were related to David; we'd have to research their relationships.

    As for enfeoff, it is indeed a French feudal term that I've generally taken to mean transferring possession of land.

    This involves the sale of reposessed land and tobacco once belonging to Stephen Porter.

    This Indenture made the fourteenth day of June in the year of our Lord one thousand seven hundred and eighty seven Between Archibald Job of Cecil County Esquire High Sheriff of the said County of the one part and James Gillespie of the same place yeoman of the other part Whereas the said James Gillespie in the County Court of the County aforesaid recovered Judgment against a certain Stephen Porter of the same County for the sum of two hundred pounds current money and eight hundred and fourteen pounds of Tobacco costs of such on which said judgement the full and just sum of seventy nine pounds seventeen Shillings & five pence was justly and bona fide due for the recovery of which last mentioned Sum of Money and the aforesaid cash of suit together with additional Cash thereon the said James Gillespie impetrated and sued out a writ of fieri facias directed to the Sheriff of the County afs. to levy the Debt and Costs aforesaid on the goods and Chattels Lands and Tenements of the said Stephen Porter which said Sheriff returned on the said fieri facias that he had levied the Debt and Costs aforesaid on the following granted lands of the aforesaid Stephen Porter but that the same remained in his Hands for want of buyers, Whereupon a Writ of venditioni exponas was directed to the said Archibald Job Sheriff Commanding him to sell the aforesaid lands as by the writ afs. will appear and whereas the said Archibald Job in persuance of the afs. writ of Venditioni exponas did sell the said Lands herein after granted to the aforesaid James Gillespie for the aforesaid Sum of seventy nine Pounds Seventeen Shillings and five pence and also for the further Sum of four pounds twelve Shillings and five Pence for fees due to the said Archibald Job as Sheriff for his services in about the execution of the process aforesaid Now this Indenture Witnesseth that the said Archibald Job for and in Consideration of the premises, and also for and in Consideration of the Sum of Eighty Pounds Current Money aforesaid to him the said Archibald Job in hand paid by the Said James Gillespie at or before the ensealing and delivery of these presents the receipt whereof he doth hereby acknowledge and himself therewith to be fully satisfied Hath granted bargained Sold aliened released enfeoffed and Confirmed and by these Presents doth hereby grant bargain sell alien release enfeoff and Confirm unto the said James Gillespie his Heirs and Assigns forever all that parcel of Land Beginning at a Spanish Oak standing on the Bank of a branch called Greens being the second Corner of a beach

    This Indenture made this fifteenth day of June in the year of our Lord One thousand seven Hundred and Eighty seven Between Archibald Job Esquire Sheriff of Cecil County and Abraham Broom of the said County in the State of Maryland of the one part and William Matthews of Baltimore Town in Baltimore County and State aforesaid Merchant of the other Part Witnesseth that whereas a certain Abraham Broom was lawfully & rightfully seized of a certain Lott of Land lying in the Village of Elk in Cecil County and state above said being part of a Tract of Land called Friendship and one moiety of a Lott of one half Acre conveyed by Col Henry Hollingsworth to a Certain Samuel Carter by Deed as will appear in the records of Cecil County in Liber BYN 4 folio 90 & 91 and the moiety of which Lot was Conveyed by the said Samuel Carter to the said Abraham Broom on the sixteenth day of May One thousand Seven Hundred & Eighty five and recorded in Liber BWN 4 Page 541 ____ The Boundaries and Courses of which said moiety are as follows to wit Beginning for this present Conveyance at the Beginning of said Lot and runing thence South Eighty eight degrees West eleven Perches & eight feet then North two degrees West three and a half Perches then North Eighty eight degrees East Eleven Perches & eight feet to the main road or Street then with a straight line drawn with said main road or Street to the place of Beginning Containing one Quarter of an Acre of Land And Whereas the said Abraham Broom & a certain John Johnson was Indebted to the above named William Mathews in the sum of One Hundred Pounds which the said William Mathews lately in Cecil County Court obtained Judgment of Condemnation by Default against the said Abraham Broom and John Johnson as also the Sum of Eight hundred and Ninety two Pounds of Tobacco Costs & Charges by him about his suit in that part Expended and Whereas afterwards by writ of Fieri facias Issued on the above Judgment out of Cecil County Court dated the fifth day of October in the Year of our Lord Seventeen Hundred & Eighty five It was Commanded that the said Archibald Job Esquire that of the goods and Chattels Lands & Tenements of the said Abraham Broom and John Johnson should be made & Levied the Debt Damages Costs & Charges aforsaid and that he should have that Sum of Money and Tobacco Before the Justices of the

    This deed is a Sheriff's sale of confiscated land once owned by Robert Alexander, who was convicted of treason. Then sold again for non-payment

    "Fieri Facias" is Latin for "that you cause to be done". A Fieri Facias was a writ issued by the Assembly for the High Sheriff to take action against someone who owed debts that could not be recovered in the normal way. "Venditioni exponas" is Latin for "that you expose to sale". A writ of Venditione Exponas directed the High Sheriff to take the specific action of selling land, goods, etc. that he was ordered to take action on by a writ of fieri facias. In this case, the lands of Leonard Strows were sold by Archibald Job, High Sheriff.

    This Indenture made this Eighth Day of August in the year of our Lord one thousand seven Hundred and Eighty seven between Archibald Job Esq High Sheriff of the County of Cecil of the one part and Doctor George Wallace of Cecil County State of Maryland of the other part Witnesseth that whereas by an Act of Assembly entitled a Supplement to an Act to raise Rents the Commissioners appointed in said Act for the preservation and Sale of Confiscated property more directed amongst other things to sell at auction for Current money two thirds of the Lands of Robert Alexander late of Cecil County who was convicted & attainted for Treason at May Term One thousand seven Hundred & eighty including one Hundred acres next adjoining the Town at the Head of Elk and the said Commissioners in Virtue of the said Act and the power by Law in them vested did sell and dispose of the same at Public Vendue at which Sale a certain Leonard Strows became the purchase of a Lot known & distinguished on the plot by Number Twenty Six he being the highest Bidder whereby the said Leonard Strows became indebted to the state of Maryland in the sum of Forty five pounds current money which the said Strows neglected paying or giving his obligation for payment agreeable to the Terms of sale whereupon a Fieri Facias according to a late Act of Assembly in such cases lately made and provided was Issued against the property of said Leonard Strows directed by Cecil County Court the thirtieth of October seventeen hundred and Eighty six and on the return of said writ on the Monday before the second Tuesday of March seventeen Hundred and Eighty seven a Writ of Venditioni exponas was issued by said Cecil County Court the thirteenth day of April seventeen Hundred and eighty seven and by Virtue of said Writ the said Archibald Job Esq did expose the said Lott to open& public Sale when the said George Wallace was the highest Bidder for the same as it appears by the return f said Archibald Job Esqr made to Cecil County Court. Now this Indenture Witnesseth that the said Archibald Job Esqr high Sheriff as aforesaid for and in consideration of the sum of Twenty seven pounds five shillings current money being the highest sum bidder to the said Archibald Job in Hand paid by the said George Wallace at or before the ensealing and delivery of these presents the receipt whereof and payment the said Archibald Job doth hereby acknowledge to be fully discharged exonerated and acquitted have granted bargained aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien release enfeoff and Confirm unto the said George Wallace his Heirs and assigns forever all that Lot of ground being part of the Lands of the aforesaid Robert Alexander and confiscated by the Legislature of the State of Maryland and sold by the Commissioners aforesaid and known & distinguished upon the plot of said Lands by number Twenty six with the appurtenances situate lying & being at the Head of Elk in Cecil County Maryland aforesaid Beginning at a Stone marked GW standing on the North said of Gay street being the new Road leading from the town of Elk to Christiana Bridge and the Eastermost Corner of Lot numbered Twenty seven then running with the said street North seventy Degrees East one hundred Feet to Lot numbered Twenty five then North twenty Degrees West Four hundred and thirty five Feet and six Tenths of a Foot to a Stone on the South side of back Street & from thence by and with Back street South seventy Degrees West one Hundred feet unto the Corner of Lot numbered Twenty seven then by a Direct line to the place of beginning containing One acre of Land more or less together with all and singular the rights & appurtenances there unto belonging and the reversion & reversions remainder & remainders of all the premises hereby granted or intended to be granted and all the right Title Intrest Claim & demand in Law or Equity of in & to the Same To have and to Hold all and singular the said Lands & premises together ! with their & every of their appurtenances to the said George Wallace h is Heirs & assigns for ever to the only proper use & behoof of the said George Wallace his Heirs and Assigns for ever and to no other use Interest or purpose whatsoever And the said Archibald Job high Sherriff aforesaid on Behalf of the State do by these presents warrant defend and secure the above described Lot or parcel of ground & premises with the appurtenances unto the said George Wallace his Heirs & Assigns for ever in the Quiet & peaceable possession and enjoyment of the same against all manner of person or persons whatsoever In Witness whereof I have hereunto set my hand and affixed my Seal the day & year above written

    This had to be a tough day for Archibald. He was selling property once owned by Elisha (Jr.) and Jeremiah Gatchell (father and son). Elisha's father, Elisha Gatchell Sr., served with Andrew Job Jr. in the Legislature. Two of Arch's uncles married into this family. Brothers Enoch and Abraham Job married sisters Abigail and Sarah Gatchell...thier brother is Elisha Gatchell Jr. Now, the debt was owed to Jacob Haines, father of Rachel who married Archibald's nephew Daniel...still with me? It is being bought by Elisha Jr.'s first cousin Jacob Gatchell Jr., son of Jacob, brother of Elisha Gatchell Sr.

    NOW THIS INDENTURE Witnesseth that the said Archibald Job for and in Consideration of the sum of One Hundred and thirty Pounds current money being the (?puie) bid for the said Land and Premises above discribed to him in hand & paid or served to be paid by the said Jacob Gatchell the receipt Whereof he doth hereby Acknowledge and thereof from every Part and Parcel Thereof doth hereby Suport exonerate and discharge the said Jacob Gatchell his Executors Administrators or Assigns Hath given granted bargained and Sold aliened released Enfeoffed and Assigned and Transferred and by these Presents and hereby Give grant Bargain and Sell alien Release enfeoff assign and transfer unto the said Jacob Gatchell his heirs and assigns all the before described Tract or Parcel of Land lying and being as aforesaid and Containing One hundred and Thirty five Acres as aforesaid.     THIS INDENTURE made this twenty ninth day of December in the Year of our Lord one Thousand seven hundred and Eighty seven, Between Archibald Job High Sheriff of Cecil County and State of Maryland of the one part and Baisil Williams of the same County and State aforesaid Farmer of the other part, and Whereas Archibald Job did on the fourth day of October in the Year of our Lord one thousand seven hundred and Eighty seven by Virtue of a Writ of Venditioni Exponas Issued out of Cecil County Court at the suit of Patrick Hamilton and to the said Archibald Job directed expose to Sale at Public Vendue all those parts of three Tracts of Land lying and being in Elk River neck in the County and State aforesaid belonging to Jacob Sum called St Johns Manor Sum's Venture and Stony Range, And wheras it appears that at the time of the Sales of the aforesaid Tracts of Land, that Bisil Williams was the highest bidder for the same which according was struck off to him NOW THIS INDENTURE Witnesseth that the said Archibald Job for and in consideration of the sum of three hundred pounds current Money to him in hand paid at or before the ensealing and delivery of these Presents the receipt whereof the said Archibald Job doth hereby Acknowledge and himself, therewith to be fully contented and paid, Hath granted Bargained, Sold Aliened, Released Enfeoffed and confirmed and by these Presents, doth grant, Bargain Sell, Alein Release, Enfeoffed confirm unto him the said Basil Williams, his Heirs and Assigns all those Parts of three Tracts of Land which belonged to Jacob Sum, and which the said Archibald Job sold at Public Vendue by Virtue of a Writ of Venditioni exponas obtained by Patrick Hamilton called St Johns Manor, Sums Venture and Stony range lying and being in Elk River Neck Cecil County Maryland and contiguous to each other, Begining at a Chesnut Post standing near Elk River side known by the name of Hitchcock bounded Post, runing thence right up into the woods as far as which Division Line was fixed and ascertained by the Will of Michael Sum father to the said Jacob Sum which directed that his Son Jacob Sum should have all the Lands of the aforesaid three Tracts of Land to the Southward of the said Line and his Son Michael to have all the Land of the said three Tracts of Land to the Northward of the same line severally to them and their Heirs and Assigns forever as by the Will of the aforesaid, Michael Sum reference being thereto had will more fully and amply appear containing three hundred and fifteen Acres and half an Acre of Land more or less together with all and singular the Houses, Buildings, Woods, Fences, improvements, Advantages and appurtenances to the same belonging or in anywise appertaining and the Reversion, and Reversions, Remainder and Remainders, Rents Issues and Profits thereof and of every part and Parcel thereof with the Appurtenances, To have and to hold the said Lands and Premisses with the appurtenances unto him the said Basil Williams
