Jonathan Harty Administrater of the Estate of Dorothy Harty deceasedAnd now at this day came the petitioner and this cause coming on to be heard and the petitioner having in vacation filed his petition praying for letters of administration upon the Estate of Dorothy Harty deceased and the same having been regularly advertised as required by law and there being no objections filed or made in this Court on motion of said petitioner it is ordered that letters of administration issued to said applicant upon his entering into bond as required by law in the sum of four hundred dollars.
Whereupon the said Jonathan Harty appeared in open court and tendered his bond in the sum of four hundred dollars with John Harty and James Gilliam as his securities who each severally signed sealed and acknowledged the same in open court for the sum of four hundred dollars conditioned for the faithful performance of his duties as administrater of said estate which being upon motion of said administrater was approved by the court whereupon the court administered the oath prescribed by law to said Jonathan Harty as administrater of said estate. It is therefore ordered by the court that said bond be filed and that letter of administration issue which was done accordingly. And upon motion of said administrater it is ordered James A. Kinkn, Jesse Walker and Andrew J. Titus be and they are hereby appointed appraisers to view and appraise all property belonging to said estate and that they report their proceedings at the next term of this court and it is further ordered that said administrator report his proceedings at the next term of this court.

County of Cass)An agreement had made and entered into by and between John Harty, Jonathan Harty, James B. Henderson assignee of the right title and interest of Cynthia Harty who resides in the County of Cass in the State of Texas, and Andrew S. Beard and his wife Mary Ann Beard formerly Mary Ann Harty who resides in the County of Hopkins in the State of Texas, all heirs, legatees and only representative of Dennis Harty late of the County of red River deceased. Witnesseth that whereas the above named parties are the only heirs and representatives of Dennis Harty late of County of Red River and now deceased all of whom are twenty-one years of age – that James B. Henderson is the rightful and legal assignee of Cynthia Harty who is also one of the heirs of said decedent and at the date of all her assignment of right title and interest as heir aforesaid in and to the hereinafter described land, over the age of twenty years as also witnesseth that the said Dennis Harty died intestate leaving the hereinafter described lands belonging to his estate and the aforesaid parties have this day agreed and by these presents do agree that the following described lands lying being and situate in the County of Red River in the State of Texas be divided by and between each other according to the following plat and survey of said lands to wit.
The foregoing plat represents the headright survey of Dennis Harty living in the County of red River sixteen miles W of DeKalb on the road leading to Clarksville containing 2044 acres which was divided at the request and by the agreement of the aforesaid parties by M.I. Knight surveyor as follows to wit:
Lot No 1 beginning at the NE corner of the original survey thence W 1344 vrs a stake of the original survey, whence a post oak brs S 86 E 9-1/2 vrs marked X with pointers Thence & 1344 vrs a stake whence a red oak brs N 38 E 25 vrs marked X with pointers thence E 1344 vrs a stake on the W boundary line of W Young Headright Survey whence a red oak N 13 E 6 vrs with pointers thence N with Young 1344 vrs to the beginning.
Lot No 2 begins on the west boundary of Lot No 1 159 vrs N of the SW corner at a stake whence a R.O. brs W 8 vrs Mk B thence west 2053 vrs a stake on the W boundary of the original survey whence a P.O. brs N 15 E 16 vrs Mkd B Also pointers thence N 1185 vrs to the NW corner of the original survey thence E 2053 to the beginning.
Lot No 3 begins at the SW corner of Lot No 2 thence E at 1100 vrs a stake whence a R.O. brs S of W 4 vrs mkd H thence S 2212 vrs a stake in the original S boundary whence a black brs N 5 vrs Mkd H thence W 1100 vrs the SW corner of the original survey thence N 2212 vrs to the beginning.
Lot No 4 begins at the SE corner of Lot No 3 thence E 2297 vrs to the SE corner of the original survey thence N 2053 vrs to the corner of the original survey thence N 2053 vrs to the SE corner of Lot 1 thence W with said lot 1344 vrs to the SW corner of sd lot thence N 159 vrs to the SE corner of Lot 2 thence W 953 vrs to the NE corner of Lot 3 thence S with same 2212 vrs to the beginning.
Lot No 1 not being a part of the property of Dennis Harty is not divided as above but lot no 2 described as above. Each of the aforesaid parties relinquishes in consideration of the premises all their right title and interest to the same to Andrew S. Beard in right of his wife Mary Ann Beard formerly Mary Ann Harty to Lot No 3 as aforesaid the above named parties relinquishes for and in consideration of the premises all their right title and interest in and to the same to James B. Henderson as assignee of Cynthia Harty to one half of Lot No 4 as above described the aforesaid named parties relinquishes for and in consideration of the premises all their right title and interest and to the same to John Harty and to the other half of said Lot 4 they the aforesaid named parties for and in consideration of the premises relinquish all their right title and interest in and to the same in and to Jonathan Harty each respectively to have and to hold their respective lots or parcels of ground as above set forth free from the claim of any of the aforesaid named parties forever And the aforesaid parties hereby bind themselves their heirs executors administrators and assigns to forever stand by confirm and agree to the aforesaid division of the said land of the said Dennis Harty as being equal just and equitable between the aforesaid parties in witness whereof they the said parties have hereunto set their hands and affixed their scrawls by way of seals on this the 29th day of Sept 1858.

County of Cass)Know all men by these presents that we John Harty and my wife July Ann Harty and Jonathan Harty and Mary Harty for and in consideration of the sum of Twelve Hundred and Ninety-three Dollars to us in hand paid John C. Garland have this day bargained sold conveyed and released and by these presents do bargain sell convey and release unto the said John C. Garland of the County of Bowie and State of Texas the following described tract or parcel of land lying and being situated in the County of Red River ten miles west of the Town of DeKalb and a part of the Headright Certificate of Dennis Harty decd. Situated and described as follows in Red River County about 17 miles S 70 E from the Town of Clarksville by virtue of Certificate No 123 issued by the Board of Land Commissioners of Red River County on the 3rd day of February 1838, patented on the fourteenth day of July AD 1857 at the City of Austin described as follows. Commencing at the south east corner of the two thousand and forty four acres on survey of Dennis Harty Thence North 2053 varas Thence to a stake North 15 varas E 6 V Bearing trees at Red Oak Thence West 1344 Varas at stake another Red Oak bears N 38 E 25 varas Thence N 157 vara to a stake Thence W 953 varas a stake Thence S 2212 varas to the original line a stake Thence E 2297 varas to the place of beginning containing 862 eight hundred and sixty-two acres of land more or less Together with all and singular the rights members and hereditaments to the same belonging or in anywise decident or appertaining To have and to hold to the said John C. Garland his heirs and assigns forever and we do hereby bind ourselves our Executors Administrators, or assigns to warrant and defend the above described land unto the said John C. Garland his heirs and assigns against all persons claiming legally or to claim the same or any thereof.

Garland a Citizen of Red River Co and State herein mentioned for all the uses purposes and considerations herein stated and contained. Juliana Harty wife of John Harty and Mary Harty wife of Jonathan Harty separately examined and sayeth that they assigned the same of their own free will and accord.
