Know all men by these presents that we John Harty, JA Harty wife of John Harty of the County of Cass & State of Texas for and in consideration of the love and affection that we have for our daughter Paralee Penny we have this day bargained sold released and conveyed and confirmed all the right title and interest that I have in a certain tract or parcel ... in the County of Cass and State of Texas ... containing in all Seventy four acres more or less ...In testimony whereof we hereunto set our hand and seal this the 19th day of September 1874.

Item 3rd: I give bequeath and demise to my minor children John Henry and Ellen Cornelia forever two certain treacts of land one being a tract of 75 acres my homstead a part of the Joseph Wood Survey, and bounded and described as follows to wit: Bounded on the West by a 50 acre tract of the said Wood Survey and now owned by Ben Young and on the North by two tracts of land one owned by my daughter Rebecca Tennessee Harty and deeded by me to her and the other owned by my daughter Julia Ann Harty and deeded by me to her both off of said Wood survey, and on the East by a tract of the said Wood Survey deeded by me to Sarah Jane Harty and on the South by the South Boundary line of said Wood survey and the other tract containing 68 acres of the said Wood Survey and bounded and described as follows to wit: Bounded on the West by said Julia Ann Harty tract and on the North by a tract of said Wood Survey known as the Elijah Powell place and on the East by a tract of the said Wood Survey deeded by me to my daughter Paralee Penny and on the South by a tract deeded by me to my daughter Dorothy Harty together with all and singular the wrights members and appurtenances to the same in any manner belonging free from all charges or limitations whatever in fee simple to dispose of as they may wish. I also give and bequeath to my two minor children John Henry and Ellen Cornelia Harty forever in the same unreserved manner the farming tools used on and belonging to both of said tracts of land with all horses, cattle, hogs, Corn fodder and other produce with all house hold and kitchen furniture. The condition of the foregoing 3rd item is designed to be in lieu of and a bar against all other and further rights benefits and claims of my said minor children to my estate either Real or personal except as are hereinafter mentioned.Item 4th I desire and direct however that my invalid daughter Virginia Harty, now with me shall receive for her support during her natural life time one half the rent from the tract of land now occupied by me as a homestead.
Item 5th: Having given each of my children named below that is say Sarah Jane, Paralee, Augustus Rufus, Rebecca Tennessee, Dorothy and Julia and a fair and just portion of my estate in Land and Stock Consisting of horses and cows, I further give and bequeath to each of them the sum of $1.00 one dollar...... real and personal. Wherever and whatever it may be including that given to my two minor children John Henry and Ellen Cornelia forever and I hereby appoint my beloved son A.R. Harty Guardian of the persons and property of my said children.
