May 12, 1682: [Irvine] Complaint by Sir George McKenzie of Rosehaugh, knight, his Majesty�s Advocate, as follows: - The burgh of Irving was of old erected into a royal burgh and in accordance with it�s privileges a yearly election of magistrates must take place, but by the failure of the magistrates to elect at Michaelmas last their right is dissolved and returns to his Majesty. James Boyle was at Michaelmas, 1680, elected provost, John and Hugh Montgomeries bailies, John Crawford treasurer, James Woodside dean of guild, and Robert Francis, David Buchannan, Henry Linn, Andrew Calderwood, William Swintoune, Robert [ �. ] and Robert Murchlane, councillors, but at Michaelmas, 1681, these persons refused to elect their successors, and the burgh has remained ungoverned. Charge having been given to them, and both parties compearing personally, the Lords find that the said James Boyle, late provost, did dutifully at Michaelmas last call the magistrates and council to proceed to an election, which they refused, and that because of this refusal, the election falls in this Majesty�s hands. They therefore nominate and appoint the said James Boyle to be provost, John Montgomery and James Fullartoun, bailies, James Woodside dean of guild, William Swintoune treasurer, Hugh Montgomerie, John Crawford, Andrew Calderwood, Henry Linn, Robert Francis, John Reoch, Hugh Garven, Robert Murchlin, Hugh Kilpatrick and James Millikin, councillors, until Michaelmas next, with power to those who accept to elect their successors at that time. Those present in town are to take the Test now before the Committee for Public Affairs, and the said James Boyle is to administer the same to the rest at home, and those who take the Test are empowered to replace with other magistrates those who refuse. Accordingly James Boyle and John Montgomerie compeared and signed the Test.

June 13, 1682: [Irvine] Obligation by James Woodsyd, merchant burgess of Irvine, principal, and James Mulliken and John Thomson burgesses of Irvine and cautioners, reciting that James Woodsyd, imprisoned in the tolbooth of Irvine by James Boyle, provost, and John Montgomerie and James Fullerton, baillies of the said burgh, for beating and wounding John Calderwood, sailor there; and in presence of the said provost and baillies in a Fenced Court, was freed until June 29, 1682, on condition of making this obligation to re-enter the tolbooth on the aforesaid date to undergo his punishment on pain 500 merks Scots. Woodsyd also obliged himself to keep his cautioners free of expense.

June 20, 1684: [Irvine] Bond by James Boyle provost of Irvine with James Millikin merchant burgess of Irvine as his cautioner to James Knock in Cunningham for the sum of sum 200 merks Scots barrow by James Boyle which he agreed to repay subject to the usual terms at Whitsunday and gives a surety his lands with clause of redemption. Subscribed at Irvine in the presence of Hugh Crawford of �Hingdog� and Moses Crawford writer in Irvine.

May 14, 1685: [Dumfries] Instrument of Sasine in favour of John Robson, son of John Robson, merchant in the Vennell, Dumfries, by Adam Sharp, merchant traveller in England, who disponed on May 6, 1685, to his nephew, John Robson, the south half of that tenement with a laigh booth/shop in what is called the Midraw at the Guttercalsy, bounded by the tolbooth on the north, the said Guttercalsay on the south, the street from the Fleshmarket to the Fishcross on the east, and the High Street on the west. Infeftment witnessed by William Craik, writer, Dumfries, Alexander Gibson, dean�s officer, David Gibson, burgh officer, Francis Dickson, apprentice writer. James Mulligan, merchant in Irvine acted as cautioner for Adam Sharp.

April 17, 1688: [Ayr] Letter of horning registered at Ayr, reciting that 'Thomas Millikine, Robert Mure and David Fergusone merchants in Ayr that whereupon the 25 day of November last bypast the said couples obtained ane decreet at the instance of the Sheriff of Air and his deputs against Hew Killpatrick merchant in Irving Agnes Shaw his servant Jonnet Boyd relict of umquhill Robert Stevenson skipper in Irvine decerning and ordaining them to make payment to the couples of the soumes of money and otheris ilk ane of you for their own pairt as before devysed viz. the said Hew Killpatrick and Agnes Shaw his servant conjunctly and severallie the soume of �90 Scots money as the pryce of ane hoghead of claret wyne with the soume of aught pounds of expenses of pleas: and the said Jonnet Boyd the soume of 48 pounds money foresaid of principall as the best of the pryce of two hog heads of French wyne with ten pounds of expenses of pleas'.

June 9, 1691: [Irvine] �The testament dative and inventar of the goods gear debts and soums of money which pertained to umquhill Hugh Kilpatrick merchant in Irvine who deceased in the moneth of - - 1600 and nyntie ane years. Given up by William Stivensone merchand in Irvine, present Kirk treasurer of the said burgh of Irving as assigney and lawfull creditor to the defunct in maner under written in so far as the defunct was justly adebted and owand the soumes of money under written to the persons following viz. In the first in so far as the defunct was justly adebted and owing to William McTaggart there Keeper of the Mortcloth in name and behalf of the session of Irvine for the use of the poor of the said parochine and to his successors in office the soum of �180 principall 40 pounds of penalty and haill bygone annual rents of the principall soum restand owand unpaid And in tyme comeing dureing the not payment of the said principall contained in an bond granted be Robert Murchland merchant in Irvine And the said deceast Hugh Kilpatrick conjunctly and sverally to the said William McTaggart and his successors in office Kirk treasurer of the burgh of Irvine daited the 18 day of Feb 1681 years, registered in the toun Court Books of Irvine upon the 12 day of July 1688 years. Item in so far as the defunct was adebted and owand to David Sneed taillor in Irvine the soum of �45 Scots money of principall and haill bygone annual rents of the said principall soum contained in ane bond granted by the defunct to the said David Sneed daited the 19th day of October 1685 years. In and to the quilk soum and annual rents thereof bygone restand unpaid and intyme comeing during the not payment thereof, the said David Sneed by his assignation subscribed with his hand of the date the 22nd day of May 1691 years made and constitute the said William Stevensone his lawfull cessioner and assigney as the saids two bonds and assignations in themselves at more length bears and quilk William Stevensone as lawful Creditor to the defunct in maner above written is executor dative surrogat in place of Charles Stewart procurator fiscall depute to the Commissariot of Glasgow. It narrates that �Sir Robert Montgomerie of Skelmorlie baronet acknowledges that by these presents he has borrowed and received from James Millikin [sic] Surveyor in Dumfries �140 Scots� with conditions for repayment, and suggests that they be put in the Books of Council and Session. Written at Edinburgh on March 15, 1703, and witnessed by John Barron servant to Adam Fullerton writer hereof.

May 1711: [Dumfries] Testament dative of James Mulligan sometime surveyor in Dumfries, who died in the month of August 1707, faithfully made and given up be Hugh Mulligan merchant in Glasgow lawful son to the defunct and executor dative qua nearest of kin decerned by decreet of the commissary of Dumfries, confirmed May 1711. There was no inventory given, save the following: �There was owing to James Mulligan be Sir Robert Montgomerie of Skelmurly �104 Scots of principall with penaltie and annual rent from Mertynmes 1703 years till August 1707 years being the tyme of the defunct's decease conforme to bond granted to the defunct on March 15, 1703 years.� Summa of the inventar of the debts owing to the dead �104. The clause of confirmation confirms Hugh Milligan [sic] as only executor, Thomas Bridges merchant in Dumfries became cautioner at Dumfries on May 28, 1711.

April 4, 1711: [Largs] Instrument of Renunciation by Sir Robert Montgomery of Selmorlie in favour of Hugh Montgomerie of Busby. It was made because Sir Robert was in debt and the estate was burdened with debt, such as the payment to Lady Margaret Montgomerie his mother of 2000 merks Scots yearly in a tack dated March 29, 1704, and a bond to Sir James Smollet of Bonhill one of the commissars of Edinburgh of 25, 000 merks. It recites that Hugh Montgomery of Busby, his uncle, and cautioner for his mother�s annuity has consented to oversee the management of his nephew�s affairs. Therefore, for his security (his uncle�s), Sir Robert Montgomery has sold annulled and disponed to Hugh Montgomery the eight pound land of old extent of Lochlibosyde? and Hartfield in the parish of Neilstoune and Paisley, Renfrewshire, and the �10 land of old extent of Skelmorlie and the lands of Ormsheugh in the bailiary of Cunningham and sheriffdom of Ayr. Also the two and half merkland of old extent of Boutryshirll with the mansion house and yards, and three parts of the common moor in the Lordship of Cunningham and sheriffdom of Ayr, to be held by two several infeftments of Sir Robert, but under revision. However, if the debts are too much, he has permission to sell some of the land. Sir Robert enumerates a debt of his father�s and also another debt of one hundred and forty pounds Scots money of penalty with an annual rent from Martinmas 1703 the penalty contained in a bond granted by himself to �James Milliekin� surveyor in Dumfries dated the fifteenth day of March 1703. Both these debts and annual rents and penalty are to be paid out of the said estate as well as the other debts contained in the said list.
