November 15, 1679
On this day, 257 Covenarters were herd out of Edinburgh�s Greyfriar�s kirdyard, where they had been imprisoned since their capture after the battle of Bothwell Bridge in June of that year. They had been sentenced to deportation to Barbados. From Leith they boarded a The Crown of London, which on November 27, finally set sail passing up the east coast of Scotland towards Orkney, where tragedy struck. The vessel, which had been anchored of the Mull Head of Deerness sank in the midst of a storm.

Only one survived John Milligan the wreck. What became of him the three remaining survivors from Nithsdale, John Murdoch, John Smith and William Ferguson, all from Glencairn, remains unknown.

The Privy Council of Scotland ordered a public inquiry into the skirmish at Enterkin Pass, with orders given that all men over fifteen years of age were to appear in arms to assist the soldiers in their search for those responsible. The Ministers of seven the Nithsdale parishes, Kirkbride, Durisdeer, Morton, Glencairn, Keir, Penpont and Tynron, read out warnings from the pulpit, declaring that any person over 15 years was to answer on oath any questions put to them by the soldiers and those absent from the church were searched. Commissions were given to Sir Robert Delzeil and Sir Thomas Kirkpatrick of Closeburn, sheriff of Dumfries, to interrogate the parishioners of Kirkbrdie and Durisdeer; the laird of Stanehouse, Craigdarroch, Mawelton, Crawfordtown and the sheriff to interrogate the parishioners of Glencairn and Tyrnon; the lairds of Capinoch, Eccles and Enoch for the Penport and Keir. For the next few months, depositions were taken from parishes and a number of other parishes.

Compeared �James Milligane in Know of Capenoch, aged 40 or therby, mared, suorn, depones that in Apryle last he mett with a quarter of ane mile of his hous four rebells armed with suord and pistole, tuo quherof enquired the deponent wher he lived quho answered that he lived under Capinoch, and that therafter they threattned him, if ever he divulged them or any of them, they should be revenged of him, quhich wes the deponents reasone that he did not inform against them att the tym, but depones that he kneu non of the saids rebels, nether quher they had bein or whither they went, but that they wer coming from Penpunt. Item. The deponent addes that, about the begining of June last, he, about the said place, met with William Milligan, rebell, but knous not wiether he wes armed not, with quhom he declares he did not commune but went by him, only he enquyred att him for quhat neus occurred in the countrey, quho ansuered him that he kneu noe neus but quhat wes vulgar and so left him, and that he kneu nether quher he had bein nor whither he wes going, and knous noe more of the haill interrogators as he shall answer to God, and declares he cannot wryt.�

Charged �James Milligan in Burn, for meeting and confering with William Milligan, declared fugitive, about the beginning off May last within a quarter off a myle of his own house and in not delating the same, as alseo in the begining of Aprile last for not delating off four rebells quhom he then mett armed coming from Penpunt. For probation repeits his deposition, which alsoe contains that tuo off the said 4 rebells asked him quher he duelt, quho answered that he lived under Capinoch, and that therefter they threatned him, if he ever divulged them or any of them, they should be revenged of him.�

Compeared �Thomas Milligane in Glenstoben, aged about 20 or therby, maried, sworn and interrogat, depones that in winter last ther came to his hous the number four rebells and stroak open the doores, quho were Thomas Hunter in Dunduff, James Douglass, Gilbert Gilchrist, but kneu not the fourth persone, neither knew quher they had bein nor quheither they went, but depones that they received nether meatt nor drink in his hous, neither ouned there, and this is truith, as he shall ansuer to God and knous noe more, and declares he cannot wryt.�

Compeared �Thomas Miller in Glengarr, aged 40, married, suorn, depones that about the beginning of May last, he being informed by Elspeth Fergusone, his spous, that Thomas Hunter in Brekensyde, rebel, should have bein once in his hous and this is truith and knous noe more, as he shall ansuer to God. And compeared the said Elspeth Fergusone, quho being suorne, depones that the said Thomas Hunter cam to her hous about the said tym quhom she gave meat and drink and also that in the hous of Thomas Kirkpatrik, her neighbour, att that same tym ther entered Thomas Hunter in Woodend and on McTurk, rebels, and knous noe more, as shall ansuer to God.�

Compeared �Thomas Kirkpatriik above-designed, aged 40, married, suorne, depones that about the beginning of May last ther came to his hous, under clould of night, the tuo Thomas Hunters and on McTurk, rebels, quho stroak open the doors of the hous.� And compeared �Janet Milligane, spous to the said Thomas Kirkpatrik, being suorn, depones that the said rebels cam to her hous att the same tym and stroak open the doors and therafter came in, to quhom she gave them milk after she wes threattned to that effect, but withal depones that Elspeth Milligane, spous to Walter Smith, a repute rebel, informed her that the rebels had a particular designe to have bein in her hous to the effect that they might als guyltie as the neighbours, and this is truith and knous noe more, as she shall ansuer to God.�

Compeared James Clerk of Trolesse in the parish of Durisdeer, residenter in Chappel, aged 40 years or thereby, married, solemnly swore and intorrageted, despones as he was informed by Patrick Mulligane in Thornhill that the rebels were between twenty and thirty persons in number; and further depones that that, immediately after the assult at Enterkin, the party, having come down again the length of the Chappel where the deponent lives, that James Douglas, younger of Morton, came to the deponent and desired him take some with him and take of the corps of the deceased Thomas Smith, and thereafter the deponent went with James Douglas to Sergeant Currie, commander of the party, and the said sergeant gave him the same order, and that, according to the said order, the deponent went and some countrymen with him and brought down the said deceased Thomas Smith his corps to the Muirhill.

Compeared John Mulligane servitor to John Houatsone, aged 20 years, solemnly swore and interrogate anent the assault made by the rebels upon the King�s forces at Enterkin on the 29th July 1684, and asked if he knows who reset or converse with these or any other rebels, depones the following: That in February last, he being dwelling with James Tait in Chanlockhead, saw Thomas Hunter, younger in Woodend, rebel, come in to James Tait�s house in the day time with three or four other men, whom he knew not, and further depones that a little after Whitsunday last, he being with John Hoatson in Laught, he saw Alexander Nivison and John Clerk, rebels, go into the house of John Hoatson in Laught.

At Dumfries, compeared John Milliquen in Burne and Alexander Milliquen there and George Milliquen in Busse in Mortoune parish, and enacted themselves, under a penalty of 500 merks each, to attend the whole diets before the commissioners of Justiciary at Dumfries while the court sits, to answer for anything that may be alleged against them. This day, Sir George McKenzie of Rosehagh, knight, his Majesties Advocate, raised a complaint before William, Marquis of Queensberry, Lord High Treasurer for the kingdom of Scotland, and James, Lord Drumlanrig and Colonel John Graham of Cleverhouse, Lords Commissioners of his Majesties Privy Council and Justiciary sitting in solemn court at Dumfries. The said Lords declared the names of the following persons summoned to appear before them and answer the complaint raised against them, namely, the charge of harbouring, resetting of and conversing with known rebels, included:

The following person compeared and enacted themselves in the court books of Council and Justiciary to appear before the Commissioners of Justiciary at Dumfries within the tolbooth thereof, during the whole diets, under a penalty of 500 merks each, to answer anything of which they may be accused: William Hair in Mortounmaines, John Dalyell of Blairfoot, Janet Gilbsone, spouse to John Haistie in Mortounmaines, Thomas Glencors in Maynes of Mortoun and the same day, John Douglass, servitor to John Milligane, weaver in Laskairne did the same.

At Dumfries (Saturday), the diet being called before the Lord Commissioners, compeared Master Robert Colt, advocate, his Majesties Solicitor, who declared that he restricted the pains of death and forfeiter to an arbitrary punishment such as the said Lords should think fit to conform to his Majesty gracious letters of 1674 and 1683. The Lords having considered the depositions of the after name persons finds them only guilty of forced and accidental converse and ignorant of the law declaring such rebels and fugitives as are mentioned in the libels and of the hazard of not revealing them, in respect whereof and that they confessed their fault and was grieved for the same and entreated the benefit of the Test, the said Lords allowed them to take same in presence of Master James Alexander, sheriff deputy of Dumfries, whom they appointed for that effect accordingly the said persons solemnly upon their knees with uplifted hands and by repeating each word did take, swear and subscribe.

The said day compeared Margaret Milligan, spouse to William Milligan, fugitive, and being solemnly sworn and interrogated conform to the libel and adhered to her former deposition taken by way of precognition by order of the said Lords as the same extant process. The Lords having considered the precognition suspend sentencing until the 24th October and in the meantime she is to be secured in close prison.

The whilk day �Isobell Hunter in Penpunt, Margaret Lorimer there, Janet Milligan in Glengar�, and �Janet Milligan, servitrix to Airkland� and othes, having compeared before the Lords of his Majesties Privy Council and Justiciary to underly the law for the crimes contained in ditta, the said Lords ordained them to come to the clerks chamber this afternoon and there to enact themselves conform to their oath already given before the said Lords�that they nor nane of them in any tyme coming shall harbour, resett, converse with or doe favors unto any declared rebells or fugitives, neither yet counseill any of them, but when they shall see them or any of them shall delate the same and raise hew and cry conform to the proclamation of Tellellan, and that under pain of perjury and banishment with sunder law or doom in caice of failyee in the premises or any parte therof, conform quherunto the saids hail firnamed persons compeered in the clerks chamber and enacted us and every ane of us in the adjournall books of the saids Lords of Justiciary in maner and to the effect forsaid in every point. 3. Compeared �Georg Milligane in Bush, suorn, confesses the crime conteaned in the ditta and is willing to take the Test. Signed Geo. Miligane.�
4. Compeared �John Miligane in Burne, suorne, confesses and is willing to take the Test, and cannot write.
