Jacob Milligan of Meikle Dempsterton
(Died 15th April, 1846)


REGISTRATION At Dumfries the fifteenth day of October Eighteen hundred and fifty six years. In the presence of Mark Napier Esquire, Advocate, Commissary of the Commissariot of Dumfries, Compeared William Brown, writer in Dumfries who gave in the Inventory, Oath and Settlement, desiring that the same might be recorded in the Commissary Court Book of the Commissariot which desire the said Commissary found reasonable and ordained the same to be done according whereby the tenor follows:

INVENTORY Of the Personal Estate of Jacob Milligan of Meikle Dempsterton in the parish of Dunscore and County of Dumfries who died there upon the fifteenth day of April Eighteen hundred and forty six, as made and given up by Mrs. Jean Johnstone or Milligan his widow, now spouse of James Henry residing in Greenock, as his sole executor nominated by Settlement executed by the deceased on the thirtieth day of June Eighteen hundred and forty five.

1st Cash in the House belonging to the deceased at the time of his death � �12.
2nd Amount in British Linen Company Bank at Dumfries per deposit receipt in name of deceased dated 28th January 1846 (�31) and Bank interest thereon to 15th April 1846 @ 3% (3s 11d), total sum of money .� �31. 3s 11d.
3rd Amount of Stock, household furniture and effects belonging to the deceased per valuation of James Blackstock, farmer, in Laggan and Alexander Stobo farmer in Two Merkland, valuation appointed by the Commissary of Dumfries �. �43 3s 11d.
Amount of the decease�s Estate in Scotland � �158 13s 11d.

OATH At Greenock the eighth day of October Eighteen hundred and fifty six years in the presence of Andrew Stewart, Esquire, one of his Majesties Justices of the Peace for the County of Renfrew, Commissioner appointed by the Commissary Deputy of the Commissariot of Dumfries, compeared Mrs. Jean Johnstone or Milligan, widow of Jacob Milligan late of Meikle Dempsterton in the parish of Dunscore and County of Dumfries, now spouse of James Henry residing in Greenock, who being solemnly sworn and examined depones that said deceased Jacob Milligan died at Meikle Dempsterton aforesaid, testate, upon the fifteenth day of April Eighteen hundred and forty six and that the deponent the said Jean Johnstone or Milligan otherwise Henry has entered upon the possession and management of the deceased�s personal estate and effects, as sole executor nominated and appointed by him per Settlement bearing the date thirteenth day of June Eighteen hundred and forty five, which is signed by the deponent and the said Commissioner as relative hereto. That the deponent knows of no Settlement or other writing left by the deceased relating to the disposal of his personal estate and effect, or any part thereof, other than that now exhibited. That the foregoing inventory which is also signed by the deponent and the said Commissioner as relative hereto is a full and complete inventory of the deceased�s personal estate and effects wherever situated and belonging or due beneficially to him at the time of his death so far as the same has come to knowledge of the deponent. And that the value of the said estate situated in Scotland is of the value of One Hundred pounds and under the value of One Hundred pounds Stirling. All which is truly as the deponent shall answer to God, (signed) Jane Johnstone, Andrew Stewart J. P.

SETTLEMENT I Jacob Milligan of Meikle Dempsterton considering that I have at this time executed a Disposition and Settlement of my heritable property in the parish of Dunscore and that it is now my wish to settle my affairs in regard to my succession to my moveable means and estate so as to prevent all disputes thereanent after my death. I do therefore hereby nominate, constitute and appoint Mrs. Jean Johnstone or Milligan my wife to be my sole executor and universal legatory bearing and bequeath to her the whole goods, gear, debts, sums of money, household furniture and other moveables whatsoever that may pertain or be resting to me at the time of decease with the whole instructions thereof and all that has followed or may be competent to follow thereon. But always with and under burden of my just and lawful debts, sick bed and funeral charges and legacies hereafter appointed to be paid to my nephews and nieces excepting the son and daughter of my late brother Robert Milligan after mentioned. With full power the said Mrs. Jean Johnstone or Milligan to intromit with the whole of my foresaid moveable estate, to give up an inventory thereof, to confirm the same and generally everything in the premises to do competent to an executor. And I ordain my said executor to pay and deliver each of my nephews and nieces though not herein named the children of my brothers and sisters by full and half blood a legacy of two pound Stirling to be paid at the first term of Whitsunday and Martinmas that shall happen one full year after my death with the exception of William Milligan and Lucy Milligan his sister both in Dumfries my nephew and niece for whom I have made a separate provision in my disposition and settlement aforesaid. And I consent to the Registration hereof in the Books of the Council and Session or other competent therein to remain for preservation and to that effect constitute.

In witness therefore these present to writing George Thomson Macminn clerk to Alexander Young writer in Dumfries are subscribed by me at Dumfries the thirtieth day of June Eighteen hundred and forty five years before these witnesses the said Alexander Young and George Thomson Macminn and signed Jacob Milligan, Alexander Young witness and George Thomson Macminn witness.
