I, F. M. McCoy, do hereby make application to the Commissioner of Pensions for a pension to be granted me under the Act passed by the thirty-first Legislature of the State of Texas and approved March 26, A.D. 1909, on the following grounds:
I enlisted and served in the military service of the Confederate States during the war between the States of the United States, and that I did not desert the Confederate service, but during said was I was loyal and true to my duty, and never at any time voluntarily abandoned my post of duty in the said service; that I honorably discharged or surrendered (handwritten) "I was in active service at the close of the war and the command disbanded".
that I have been a bona fide citizen of the State since prior to January 1, A.D. 1880, and have been continuously since a citizen of the State of Texas. I do further state that I do not hold any national, State, city, or county office which pays me in salary or fees one hundred and fifty dollars per annum, nor have I any income from any other employment or other source whatever which amounts to one hundred and fifty dollars per annum, nor do I receive from any source whatever money or other means of support amounting to the value of one hundred and fifty dollars per annum, nor do I own in any right, nor does any one hold in trust for my benefit or use, nor does my wife own, nor does any one hold in trust for my wife, estate or property, either real, personal or mixed, either in fee or for life, of the assessed value of over one thousand dollars; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and that I am not an inmate of the Confederate Home, and I do further state that the answers given to the following questions are true:

McCoy a resident & credible citizen of Denton County and who is an applicant for a Confederate Pension and who being duly sworn disposes and says: That he does not know of any soldier who served with him in the Confederate army who is now living-that he has made diligent efforts to find any of his company or comrades. That in the year 1900 he served the affidavits of 3 soldiers with whom he served and that these men are now dead & that in his service during the war his company was detailed as scouts and guides and at times as escorts and on detail with infantry commanders. That at the close of the war the command was with Gibsons company and Thomas Legion N.C. Volunteers. That this command disbanded in Georgia that is ---- the infantry which was behind the cavalry and I do not know what the infantry did at that time

The name F. M. McCoy has not been found on the rolls, on file in this office, of Thomas�s North Carolina Legion, Confederate States Army. No record has been found of the capture, or parole of a man of this name as a member of said organization, nor any record found of a Captain Gibson in that legion.

John L. McCoy being first duly sworn disposes as follows:
Marion McCoy who is my brother and myself were borned and reared in Campbell County, East Tennessee and were living there at the beginning of the Civil War and in the year 1862 I enlisted in the Confederate service, in Gibson�s Co., and our first second and third lieutenants were Nicholas Patterson and Ramsey Patterson, being brothers, Willie Bruce, respectively and upon the same day along with me, was sworn into service one Marion McCoy, my brother, to whom I have just referred above, of Campbell County, Tennessee, and we were then attached to the 5th Tenn. Reg., same being known as McKenzies Reg. from which we drew rations and clothes, but a considerable portion of our time was taken up in independent work, piloting different commands, coming and going who were not acquainted in that section and we having been born and reared in that section we were well acquainted with the country and this work continued 1863 when Burnside captured the country, but the Confederate soldiers fell back in the direction of Chattanooga, Tenn., when both bridges at Loudon and Charleston, Tenn., were burned. Next we entered the Chickamauga Battle which lasted for eight days, thence we were ordered back to Knoxville, Tenn., to route Burnside, being met at Charleston, Tenn., by the enemy we fought a continuous battle, forcing the Federals back across the Tennessee River at Loudon, thence we were ordered to Gotten Port where we crossed the River and fought the Yankees both from behind and in front, on to McMinnville, Tennessee and thence were ordered to Murfreesboro, Tenn., being unable to enter we went in by way of Shelbyville, Tennessee and it was at Duck River that all of our Reg., the 5th Tenn., were killed and captured save 175 and it was on the next day, Aug. 6th 1865 we were attached to the 8th Tenn., Geo Dibrell's Reg., when our company was given the letter "M" of which all, in Tenn., are more or less familiar and who were in the service at that time and under said company we served until a short time before the close of the War when we went into the service or served under Thos� Legion until we were paroled.
It was at this Duck River Battle that our brother George was killed and my wife�s father Capt. Gibson, also lost his life. This means that I went into the Civil War with Marion McCoy, at the times and places stated above as well as with five other brothers, two of whom Geo and Andy were killed during the war. Brother Marion�s services were that of a gallant soldier and a faithful fighter to the end. It was in the Duck River fight that our old Captain Gibson was killed and our first Lieut. Nicholas Patterson was promoted to the rank of Capt. I wish to say further that Marion McCoy never deserted at any time and stood as close and firm in fighting contact with the en-emies as any warrior ever did and I know of my own knowledge that he was duly paroled and was present and paroled myself at the same time, at Franklin, Macon County, North Carolina, April 1865
The forgoing statements are made with reference to Marion McCoy and made without fear or favor but that justice may be done. This the 12th day of April 1912.

On this 16th day of September 1913 personally appeared before me, a notary Public in and for the afore said county and state duly authorized to administer oaths, James Gibson aged 81 years a resident of Bryant�s Store in the County of Knox and State of Ky and whose Post Office address is Bryant�s Store, Ky a person well known to me and entitled to credit and who being by me duly sworn declares in relation to afore said case as follows:
Affiant states that he lived in Tennessee (Scott Co) until the breaking out of the civil war and that he was well acquainted with Francis Marion McCoy.
Affiant further states that said Francis Marion McCoy enlisted with him in Co M 5th Tenn Cav on Poplar creek near Robbinsville Anderson County Tennessee Confederate Services in 1862.
Affiant states that he served in the confederate cavalry with said claimant until the fall of 1863.
