Surname is also known as BREWTON in some records. I only know of one child born to James, that of our direct ancestor Ruth BRUTON born about 1810, who married William TAYLOR.

There was a BRUTON family that originated from Kingswood near Wotton-under-Edge in Gloucestershire that were wool weavers. As James' grandchildren were born in the Gloucestershire area there is possibly a connection to this family.

Regarding the supposed Knighthood held by James BRUTON, there is no mention of any BRUTON's having held a Knighthood in Burke's Peerage.

He died on 24 Mar 1830 in Windsor NSW Australia. He was buried 3 in 1830 in St. Matthew's Church of England, Windsor NSW. He married Jane FLOYD on 13 Aug 1788 in St Dunstans Church, Stepney, England. William was born at Beenham in Berkshire England, late in 1767 and had a twin brother, who did not survive. William was a Brewers Servant in London. He was arrested and indicted as William IZZY for stealing a wooden cask and 36 gallons of yeast and sentenced to 7 years transportation to NSW. William, his wife Jane and their daughter Louisa sailed on the ship 'Royal Admiral' and arrived in Sydney Cove on Sunday 7th Oct 1792. The Convict Indent for the 'Royal Admiral' describes William as a man of above average height, with black hair. He was sent to Parramatta Town and would have most likely been put to work with other convicts, clearing the country and cultivating the land. No records remain of who William EZZY was assigned to during this period and likewise no records remain of when he received his pardon.

William was granted 130 acres of land at Clarendon on 11 August 1804 by Governor King, the greater part of which became the original portion of the Richmond RAAF Base in NSW. He applied himself to his farming with evident success, for it was no time at all before he and Jane were entirely off Government Stores and were supplying themselves and their growing family with their daily food requirement and for the next six years the family settled down to farming and raising their children.

By 1810 William had entered into partnership with John BOULTON, also a former convict, and were in cultivation of acres of Wheat, Barley and Corn. Jane EZZY had also formed partnership agreements with John BOULTON in her own right and it was partly the demand to 'trade in her own right' that developed into a well documented explosive situation that finally split William and Jane apart, with Jane having left her husband William by 1816. Jane EZZY died in Sydney in 1821 and William married Jane MILLS, his assigned convict housekeeper since 1823, on 18 May 1829 with the Consent of the Governor, as Jane MILLS never received a full Pardon during her lifetime. There were no children born to his second marriage.

In March 1811 William received a Licence to sell beer in Sydney and from July to December 1815 a battled raged between William and John BOULTON over the ownership of Boulton & Ezzy's Farm at the Hawkesbury. As well as farming crops William raised horses. His great-great-grand daughter Queenie TAYLOR was shown a book in which it was written "William EZZY supplied the horsed for the crossing of the Blue Mountains". Blaxland, Lawson & Wentworth crossed the mountains in 1813 starting out from the Penrith area and went up over the mountains from Emu Plains, so it would appear there would have been no reason for them to obtain horses from Windsor. However, there were of course several crossings of The Blue Mountains. One group, led by Archibald BELL set out from Richmond on 6 Oct 1823 along with the Assistant Surveyor, Robert HODDLE, accompanied by three men and two natives, following a route Archibald BELL had mapped out the previous September and two unsuccessful shorter journeys in the previous weeks of the same year. On any one of these journeys they could have used horses purchased in the Windsor area. I have been unable to locate the title of the book or confirm this information. However, Archibal Bell, acted as his son John Ezzey's Supervisor, whom he spoke of as a "very worthy character", so we know that there is a documented connection between these two gentleman.

1828 Census shows "EZZEY, William, 66, Free by servitude, Royal Admiral 1791, 7 years, Farmer, Cornwallis, 26 acres, 21 cleared, 16 cultivated, 1 horse, 4 catle".

He is buried in St.Matthew's Church of England, Windsor, but does not have a headstone and the location of the grave is unknown.

William and Jane had eight children :
i. James William EZZY, christened James William HESEY on 18 Jul 1790 in St.Saviour, Southwark, London, d. before 1 Nov 1817. He is believed to have left the colony and died young.

ROBERT TIRESMAN and WILLIAM IZZY were indicted for stealing, on the 2nd of November last, a wooden cask, value 5 s. and 36 gallons of yeast, value 16 s. the property of Felix Calvert, Robert Ladbroke, William Whitmore, Robert Calvert, and Charles Calvert: And THOMAS WATMORE was indicted for feloniously receiving the same, knowing it to be stolen.

RICHARD DIGGINS sworn.
I am a watchman of the ward of Aldgate; I have seen the prisoner Watmore once, and the other two a great many times; I was directed to watch the two first prisoners; about the beginning of November I saw them come through Aldgate High-street into Whitechapel, that is the road from Tooley-street to Petticoat-lane; they had a sledge with no wheels, and a barrel, and a tub like a half barrel; I spoke to John Jameson; I did not go to Watmore's house; I went where they went to on the return along Fenchurch-street, Fish-street, over London-bridge, to Tooley-street, about half after four, when they returned, the place looked then like a brewhouse; I have since found it was a storehouse belonging to Messrs. Calvert and Co.; I observed they took a sledge and a barrel, nothing else; I observed a difference in the sound, that there was something in the barrels as they came towards Petticoat-lane, and empty when they returned; I took the prisoners the 19th of November, about four in the morning; the two first prisoners were coming again along with the sledge, and a barrel and tub upon it, as usual; I jumped across, and stopped the horse; Tiresman asked me what right I had to stop it; I told him I understood it was spirits or gin; he said, no, nothing but yeast from Mr. Calvert's; I said it was my duty to stop him; if he would go to the watch-house, we had officers that were looking after smugglers; he said, we will go back, and leave the sledge here; I said no, and they went with the sledge to the watch-house; they walked in; they saw no officers; I told them they would be there presently; with that, Tiresman says, we may as well shoot this barrel down here, and go for another turn, and by that time your officers will be come; I went and fetched the beadle, and the prisoner Tiresman showed us a key of a storehouse, marked Rupert-street, Whitechapel; we told him he had better tell where he brought it from; he said, from Mr. Calvert's; the prisoners were secured; in the barrel there was yeast, and nothing in the tub, that I look upon to be a receiver; I did not go to Watmore after the 19th.

JOHN JAMESON sworn.
I am a watchman in Aldgate High-street; I remember, the beginning of November, seeing the two first prisoners with a sledge; they went into Boar's-head court, Petticoat-lane; they came out about a quarter of an hour; I did not like to go into the court, it is a very bad place; Mr. Watmore lives in the court, but I do not know the house, or the number; they came back again with an empty cask, because it rumbled and tumbled on the sledge, and before it was solid and steady.

THOMAS PINNER sworn.
I am the constable of the night; I was in bed; I took the charge; they had a cask of yeast, containing 36 gallons, which they said they brought from Calvert's.

WILLIAM BOX sworn.
I am a constable; I went to a house in Petticoat-lane, where Flood lives, in Boar's-head yard, the 19th of November; Flood works for Watmore; I saw Watmore and Flood at Mr. Flood's, putting a cask down a cellar; I took no notice; I went and fetched Mr. Read, and we went back and found the same cask in the cellar; nothing else was in the cellar but the cask.

JAMES READ sworn.
I am storehouse-clerk to Messrs. Calvert and Co. the prisoner Tiresman and Izzy's business was to carry yeast; the value of a cask of yeast is 16 s.; they had no business to carry it to Rupert-street, but to Thames-street; seven in the morning is time enough; they certainly had no orders to carry any on the 7th or 8th, or on the 19th; I went to Flood's house, and saw a cask in the cellar; it is the property of Messrs. Calvert and Co.; we sell none of that kind; one and has Felix Calvert and Co.; the value of it is 5 s.

Jane was one of the first "free" woman settlers who arrived in the colony. She came to Australia with her husband William, a convict and their daughter Louisa on the ship 'Royal Admiral' and arrived in Sydney Cove on Sunday 7th Oct 1792. She received a grant of land from Governor John Hunter and was the first woman to be granted land in the Hawkesbury, or Mulgrave Place as it was known, being 30 acres at Cornwallis Flats behind St. Matthew's Church of England Church and known as Ezzys Farm on 1 May 1797. Only 25 other women had previously received a free grant of land in the Colony. Jane, now a 'lady farmer' was most likely assigned her husband William as a 'Farm Labourer'.

William, Jane and their two young sons moved from Parramatta to the Hawkesbury and settled in a part of Windsor, that is today known as Cornwallis Flats and is part of the Hawkesbury Flood Plain.

In the 1814 Muster (and Mutch Index at the time of her death) it states "lives intermittently with John BOULTON, Publican". However their associations are believed to have been purely a business one, as they were legal business partners and for a good deal of the time Jane lived in Sydney prior to the 1814 Muster. In 1812 Jane and John BOULTON formed the partnership of 'Boulton & Co.' and purchased a property in both their names at No.49 George Street, Sydney and on 16th May they placed an advertisement in the Sydney Gazette, advertising their new venture - "opened for accomodation and have a few Hogsheads of excellent Wine for Sale. And for the Accomodation of Settlers will receive approved Colonial Currency or Pigs in Payments". Several years later the property was advertised for sale and described as "being on the corner of the spaceous avenue leading into Hyde Park" which would have been on the extremities of the town and what is currently the Markets Area of the city. In 1813 Jane purchased John BOULTON's half-share of 49 George Street for the sum of 10 pounds.
However. in about 1814 Jane sold 49 George St., back to John BOULTON, now a Sydney Publican of the "Swan and Two Necks" in Cambridge Street The Rocks, where it is believed Jane now resided. John BOULTON sold 49 George Street on 25 Feb 1815 for the sum of 200 pounds.

Jane had left her husband William by 1816 and obtained a Publican's Licence in Sydney Town firstly in 1819 and then in 1821. All records indicate that John BOULTON, who was in Parramatta Gaol from late 1816 until 1817, left the Colony in 1819 as advertised and that Jane was conducting an Inn in her own right. Jane is believed to have spent the last few years of her life, living in The Rocks area of Sydney. By the time of her death she owned two houses, which she left to her to youngest daughters. It is possible that the business she conducted, "The Swan and Two Necks" in Cambridge Street is one of the two houses situated at numbers 8 and 9 Cambridge Street Sydney, that are know to have been in the possession of Jane's two youngest daughters, Elizabeth and Sophia after her death, and it is believed Jane left these to her two youngest daughters.

Jane's original land grant of 30 acres in Mulgrave Place was never sold or sub-divided during her lifetime and it would seem she took the ownership of this most valuable possession with her to the grave. However, no member of her family inheritied, or benefited from it, in any way after her death either, as coninciding with the time of her death, the quit rent was not paid, so the Crown repossessed the grant, with the Deeds not reissued to a new owner for almost 100 years.

Father: Caesar FLOYD & Mother: Isabella (Izabell) MACKENZIE b.1730-1740 in Staffordshire or Hampshire, England. If indeed this proves to be correct and Jane was baptised on 12 JAN 1770 in Saint Luke, Chelsea, London, then it would appear Jane may have been a twin. However, my cousin Grace advised "if the statements made on her daughter Lucy's Death Certificate are correct, then it is possible that Jane was Irish, as her maiden name is supposed to have been FLOID.

Henry was the son of Henry and Elizabeth LAMB (nee LINSLEY). He was a Private in the NSW Corps and arrived in Sydney in 1791 on the ship 'Albermarle'. He enlisted on 29 June 1789 in England and was discharged on 24 April 1803 in Sydney. Henry was assigned a Convict housekeeper Elizabeth CHAMBERS whom he later married when she became free. He was an Overseer to Rev. Robert Cartwright, who performed his marriage ceremony to Elizabeth Chambers.

Henry was granted 25 acres of land at Windsor which were lost in floods. He was later granted 70 acres at Portland Head (North Sackville) but was burnt out by aborigines. Then he received a grant of land at Richmond Hill which he later sold to his son-in-law John EZZEY. He became a Constable and managed the Aboriginal Settlement at Rooty Hill. Later he became a Gardener to Gregory Blaxland (the Explorer) at 'Newington' near Parramatta. Henry died at Richmond Hill in 1839.

He obtained a grant of 80 acres at Kurrajong Brush in 1810 from Governor Macquarie and was one of the settlers who signed the address to Governor Macquarie in December 1810 (see Colonial Secretary's Index).

Henry was given another grant on the North Shore (opposite the present day Royal North Shore Hospital), but he did not take up this grant, possibly due to the fact that he was moved to Windsor at about the same time.

Constables were the parish policeman and were appointed by the vestry. The appointment being confirmed by the Justices and they supervised the 'Watch & Ward', maintained the local prison and the stocks, removef interant strangers, apprenticed pauper children and were included in the training of the local miltia and had many other duties. Any parishioner might be nominated to act as a Constable. It was not a popular job and the parishioner chosen often opted to pay someone else to act in his place.

Many researchers have recorded Elizabeth as being born in Hoborn, London in 1762 or 1763. However the Society of Australian Genealogists states Elizabeth was 23 years of age at the time of her trial on 26 Oct 1791. Therefore, she would have supposedly been born in 1768? However, her age at time of death is 78 years (therefore born about 1760).

Elizabeth was sentenced to 7 years transportation for stealing property belonging to her employer & pawning it, then possibly setting fire to the premises. She arrived in Sydney on ship 'Kitty' in Sydney on 18 Novemember 1792 which departed Portsmouth, Ham, England on 6 April 1792. See Convict Indents - AO Fiche 614, p.76.

"Convicts to NSW 1788-1812" Cd-Rom Published by Society of Australian Genealogists states that Elizabeth was 23 years of age at the time of her trial. It also states "Delivery of the Kings Gaol of Newgate" Reference 4/4002 pp 1-22.

ELIZABETH CHAMBERS was indicted for stealing, on the 22d of October, one woollen cloth coat, value 40 s. one Marseilles waistcoat, value 3 s. one cotton ditto, value 3 s. one pair of velveret breeches, value 3 s. one pair of sattinet ditto, value 10 s. a muslin handkerchief, value 1 s. two pair of hose, value 18 d. the property of William Kinslen; and one pair of cotton stockings, value 2 s. the property of Robert Howden.

WILLIAM KINSLEN sworn.
My house is in Aldersgate-street, opposite Little Britain; I came home about nine last Saturday evening; I found my two pair of stairs front room on fire. The prisoner was my servant; I suspected her of stealing several things. I had her taken up as soon as I had put the fire out. She was going to bed; I found in one of her shoes fourteen duplicates; her bed-room is one pair of stairs above the room that was on fire. I found many of my things upon examining at the pawnbroker's.

WILLIAM THOMPSON sworn.
I am an apprentice; I know the prisoner; she pledged a pair of breeches with me the 7th of September, a pair of stockings for 9 d. the 20th of September; the breeches are velveteen, the stockings are worsted; a coat for 6 s. 2 d. the 24th of September, and two waistcoats for 6 s.

Prosecutor. I never gave the prisoner leave to pawn any thing for me. (The clothes produced.)

ANN HOWDEN sworn.
I have mended my father's stockings; those stockings are mine. (The prosecutor deposes to the coat.)
I have had the coat twelve months; I am sure it is mine. (Prosecutor deposes to the waistcoat.)

William was 22 years of age and Mary was 26 years of age at the time of their marriage . They had a family of ten children who were all born in Chinnor, Oxfordshire, England and baptised at St. Andrew's Church in Chinnor. However, at least three of their children did not survive infancy, as John died at one year of age in 1804, Ann (1814) and Martha aged 3 months (1822).

One son, also named John migrated to Australia with his brother Edmund, our ancestor, where they both raised families. The only remaining male child, George, stayed in England and in 1881 at the age of 62 years his occupation was a 'Domestic Gardener' and he was residing at 'Farm Fold', Pownall Fee, Cheshire, England with his wife Mary, and their two daughters. Ellen aged 26 and Elizabeth, aged 19, who were both "Cotton Weavers" and were born in Styal, Cheshire.

Their youngest child, Lucy married Francis CHOWN in 1846 at Sydenham, Oxfordshire, England when she was 21 years of age. Lucy gave birth to seven children in Sydenham, Mark (1850), Thomas (1853), Esther Elizabeth (1856), Alice (1858), Mary Ann Lucy (1860), George Francis (1863) and Leah Frances (1864). Lucy's husband Francis CHOWN, and therefore their children, are also direct descendants of our ancestors John and Joan CHOWN (ca.1700) of Aston, Rowant, Oxfordshire.

William's father Richard was born at Blewbury and was "of Blewbury" when he married Mary in 1762, on the Brookes Marriage Index complied many years ago by John Brookes and now part of Berkshire Family History Society Marriage Index. Richard's parents are John WITNEY and Mary HUGGILL of Blewbury. I have no more on these two. There are HUGGILL's in Blewbury but no baptism for a Mary and no indication of John WITNEY. They married at Blewbury on 8 Oct 1727 and had all boys : John, Francis, William, Thomas, (then Richard) and James.

Benjamin RATLEY was a Widower at the time of his marriage to Ann WHITE. It is not known at this stage if he had children to his first marriage. There were three children born to his second marriage with Ann, all daughters, Lydia in 1811, Rachel in 1812 and Elizabeth, our direct ancestor in 1813. Lydia is Elizabeth's only known surviving sibling and she married Joseph MANN in Chinnor, Oxfordshire, England in 1831. Elizabeth's younger sibling Rachel, died at four weeks of age.

80. William ASHER was born about 1790 in possibly Germany or Nottingham England. He married Elizabeth , possibly BAYFIELD. William resided 1 in 1815 in Queen Street, Nottingham England. He resided in 1818 in Newcastle Street, Nottingham, England. He was employed 2 as Hawker in 1815 & 1818.

William and Elizabeth were known to have had two sons. Both were christened in St. Marys, Nottingham, England :
George Thomas Bayfield ASHER, b. 1815 and Samuel Lyon ASHER b. 1818, our direct ancestor who married Ann BOWDEN. A Joseph Asher was also baptised at St Mary's Church, Lacemarket Nottingham on 13 November 1820 address given as Newcastle Street and occupation Hawker. Parents Lyon and Elizabeth.

On the 1851 Census Lyon Asher is down as a General Dealer still living on Newcastle Street and 'where born' it says Germany. There was also another family Joseph and Margaret Asher who were about the same age they lived on Clare Street which was the next street to Newcastle Street. Both of these streets are still there in Nottingham but no houses. I They are believed to have been pulled down when the railway was built. 1851 census for Joseph and Margaret Asher 'where born' it looks like Listrok Pakington and he had several people lodging with him from Prussia, Poland. Occupation Hawkers of jewellery.

The name Asher is sometimes not only ASCHER but also ESHER or ESCHER and the Asher's are very closely connected to the Seligman family (or Selligmann). "Lyon" is a town in France, so perhaps something sentimental in the name? As many Jews lived in France, perhaps this family was from around there (then again, Germany is not too far from there).

In Continental Europe this name is known as ASCHER in Wien and Galizien Kroenlande in Austria. However at this stage our ASHER ancestors are believed to have originated from Germany, where the name 'Lyon ASHER' is known as LEONHARDT ESCHERS in Evangelisch, Simmern Kirn, Rheinland, Preussen, LEONHARD ESCHER in Kirchensittenbach, Mittelfranken, Bayern, LEONARDUS ESCHER in Katholisch, Bellingen, Loerrach, Baden and LEONTIUS ESCHGER in Wyhl, Freiburg, Baden.

William, Elizabeth and their family migrated to Australia in 1838 aboard the ship 'Maitland' when he was 42years of age, with his brother Joseph. They departed Gravesend in Kent (near London) England, on 24th June, 1838 arriving in Sydney NSW on 6 Nov 1838 as 'Assisted Immigrants'. In the shipping records William stated he was going to live at Paterson River, which is in the Raymond Terrace area. Tragically his wife Elizabeth died upon arrival in Sydney and their son James shortly thereafter. The remaining family members settled at the Emmigration Barracks in Hunter Street and William found work as a gardener. In the 1841 Census he was in the carrying business and living at Bourke Street Surrey Hills. William applied for land and in due cause was granted a clearing lease. Early in 1842 the family moved to Dora Creek near Lake Macquarie, leasing a property known locally as 'Muddy Creek' near the present railway station at Dora Creek (originally called 'Newport') where William and his sons worked at logging the cedar which they would haul by bullock team to Newcastle for sale until 1847. The Bowden's 'Muddy Creek' lease was owned by a Mr. Holden who took up a position in the Brisbane Water Court House.

William moved his family to Ash Island, probably as tennant farmers of Alexander Walker SCOTT in the Hunter River near Hexham and established a thriving fruit and vegetable trade with the Newcastle markets. When the Hunter River flooded in 1856 William and his youngest son George moved to "Kennington Park" at Raymond Terrace and became vegetable & grain farmers, carting produce to the Newcastle markets (maize, potatoes, melons, pumpkins & lucerne). Even at the age of 60, William was very active and could effectively handle the bullock teams. 'Kennington Park" is north of Hexham, on the Raymond Terrace Road, opposite the 'Courtauld's Factory'.

William and Elizabeth had a family of ten children, James (1817), William (1819) married Caroline MUNN, Rebecca (1821) married Thomas ADAM, Thomas (1824) , Ann (1826) our direct ancestor married Samuel ASHER, Frank (1828) married (1) Alice Maria ROTHWEL then (2) Rebecca OSBORNE , Catherine (1830) married Joseph BILLINGHAM, Mary (1832) married Thomas PRYOR, Joseph (1834) and George (1837) who married Maria FOUNTAIN.

83. Elizabeth GODFREY was born on 9 May 1798 in Rolvenden, Kent, England. She died on 12 Nov 1838 in Spring Cove Quarantine Station, Manly NSW. The cause of death was Scarlet Fever. Elizabeth emigrated on 24 Jun 1838 from Gravesend in Kent (near London). She immigrated 1 on 6 Nov 1838 arriving in Sydney on ship 'Maitland'. [Parents]

Elizabeth immigrated to Australia via the ship 'Maitland' arriving in Sydney 6 Nov 1838. However she did not survive the voyage on the disease ridden ship and died shortly after her arrival at the Quarantine Station in Spring Cove at Manly. Officials at the Quarantine Station are of the opinion that Elizabeth is likely to have been buried in the Quarantine Cemetery. In 1854 the headstones were removed and stored at the Quarantine Station. However a search of the stored headstones in Feb 1987 failed to find one for Elizabeth Bowden.

A descendant wrote, David WEBSTER, a lowlander was born in Dundee. He had a wife Helen TRISTAN and two brothers who were timber merchants in Alloway. David was killed in Dundee. His widow, Helen, afterwards moved to Fifeshire and married Robert Williamson. Ryan DUDLEY, another LINDSAY descendant has established Helen's surname was LINDSAY and not 'TRISTAN'.

IGI Ver.4.02 gives two separate marriage entries for David WEBSTER & Helen LINDSAY, both on 6th Nov 1818. The first is in Newburgh, Fife and the second entry in Abdie, Fife, Scotland. David & Helen's son James WEBSTER was christened 26 Jul 1821 in Coupar Angus, Angus, Scotland. Their first born John was christened in Church of Scotland Parish Church of Newburgh (Fife) and Ann & Agnes were christened in the Church of Scotland Parish Church of Dundee.

The family were recruited by the AA Co and Helen and her second husband Robert Williamson immigrated to Australia. Robert worked in their mines until he died in a fall of coal aged 76.

On 18 Jun 1885 the following notice appeared in Newcastle Morning Herald "The Friends of Mr. James LINDSAY are respectfully invited to attend the Funeral of his deceased sister."

In 2004 a house called the LINDSAY House at Hamilton was open for Heritage week. It has survived from the 1800�s and was a Mine Manager�s house for an A.A. Co. pit at Hamilton and the old maps have it labelled as the LINDSAY House. The City Council have purchased it and are gradually working on its' renovation.

In 1982 a descendant wrote, David WEBSTER, a lowlander was born in Dundee. He had a wife Helen TRISTAN and two brothers who were timber merchants in Alloway. David was killed in Dundee. His widow, Helen, afterwards moved to Fifeshire and married Robert Williamson. Ryan DUDLEY, another LINDSAY descendant has established Helen's surname was LINDSAY and not 'TRISTAN' and that Helen's first husband David WEBSTER was supposedly killed in a timber accident.

IGI Ver.4.02 gives two seperate marriage entries for David WEBSTER & Helen LINDSAY, both on 6th Nov 1818. The first is in Newburgh, Fife and the second entry in in Abdie, Fife, Scotland. Frank and Marion SHARP confirmed the marriage of Donald McIntosh and Ann Collie in 1818 in the Parish of Duthil & Rothiemurchus by sending the original OPR (GROS data 96/B 0002 FR000215) which shows two images - the full page and the crop for Donald and Ann which shows Donald was a "wood manufacturer" and the marriage took place at The Dell in Rothiemurchus, near Coylumbridge. This was part of the Rothiemurchus Estate, run then and now by the chief of the Clan Grant, and focussing heavily on forestry. Great place to be for a wood manufacturer!! The fullpage image gives the bonus marriages and Collies are everywhere. As well as The Dell there were/are The Croft and The Doune (see modern OS Map and an abstract from the 1874 OS map showing the Dell and the nearby sawmill - see the top 2 marriages on the full page, both gents were sawmillers). The Doune was the main residence of the Grant Lairds of Rothiemurchus.

Duthill is north of Aviemore. Cromdale and Inverallan and Advie Parish is the nextdoor Parish to Duthil and Rothiemurchus. Inverness-shire, a highland county of Scotland, bounded N. by Ross and Cromarty, and the Beauly and Moray Firths, N.E. by the shires of Nairn and Elgin, E. by Banff and Aberdeenshires, S.E. by Perthshire, S. by Argyllshire and W. by the Atlantic. It includes the Outer Hebrides south of the northern boundary of Harris, and several of the Inner Hebrides ... and is the largest shire in Scotland.

Duthil and Rothiemurchus The name of a civil parish, from 1870 until 1975 in the county of Inverness. The parish was formed from two separate parishes: Duthill in Morayshire and Rothiemurchus in Inverness-shire. The parish boundary was altered by the Boundary Commissioners in 1891. Rothiemurchus is the name of a civil parish, from 1845 until 1870 in the county of Inverness. In 1870 it combined with the parish of Duthill to form the parish of Duthill and Rothiemurchus, which combined parish was placed in the county of Inverness.

Donald and Ann had four children, two of whom are known to have immigrated to Australia:
i. Janet McINTOSH, b. 24 Nov 1819, Duthill et al Inverness, Scotland.
ii. Donald McINTOSH, b. 1 Feb 1820, Duthill With Rothiemurchus INV Scotland
iii.Ann McINTOSH b. 1 Oct 1821, our direct ancestor married James WEBSTER and they immigrated to Australia.
iv.John Loughlin McINTOSH b. ca 1826 married Ellen ROBERTSON and immigrated to Australia.
John and Ellen lived in Ballarat, Victoria. They had 4 children. The youngest three were born in Ballarat.
- Donald born about 1850, Anne (1855), Helen (1858) and John (1860).

The births of these four children were originally advised to me by a Professional Researcher. However, at this stage I have only been able to confirm the birth and christening of their first child Janet (25 NOV 1819 in Duthil With Rothiemurchus, Inverness, Scotland) & Ann (15 Nov 1821 in Cromdale And Inverallan And Advie, Inverness, Scotland). Our direct ancestor Ann's parentage has been confirmed by her 1855 Death Record in Geelong, Victoria. The IGI does list the entry for Donald Jnr in 1820. However it gives father's name as Robert McIntosh and mother Ann Collie. Therefore I will need to view the film of the original Parish Registers to carry out further investigation on the children born to Donald and Ann.

The Informant on Anne's 2 Jan 1855 Death Certificate is Euphemia McINTOSH, daughter. Both parents stated as deceased. Born Inverness Scotland. Time In Colony - 5 months Victoria. Married in Inverness Scotland at 21 years to Donald McIntosh. Issue: Janet 36, Ann 32, Mary (possibly D? for deceased), Isabella (also possibly D? for deceased and no age given for either), Lochlan 28, Euphemia 26, Elizabeth 22 and Jane 19 (Note no mention of supposed spouse Robert, or son Allan 1831)

IGI Ancestral File Version 4.19 gives name as "Ann COLLY" born about 1797 in Rossamondlea, Strathspay, Scotland

Laurent Lagu advised : Allan Collie 1750-1829 and Anne Stuart 1761-ca1841, both living in Tullochgrue, Rothiemurchus (parish of Duthil and Rothiemurchus, Inverness-shire).They had 10 children, including my ancestor Alexander Collie 1786-1867, and a daughter called Anne Collie born in 1793 in Rothiemurchus.

Anne Collie born 29th May 1793 daughter of Allan Collie and Anne Stewart his spouse, in Kinrara na coille. Macintosh Donald , Wood Manufacturer, was married to Ann Collie at the Dell (Rothiemurchus) 10th dec 1818. Janet Macintosh daughter to Donald Macintosh and Anne Collie was born on 24th Nov 1819 , Kinnapoul (Rothiemurchus). There is an Allan Macintosh b.1831 in Coylumbridge near Rothiemurchus, son of Anne Collie, but the father is Robert Macintosh so I don't know if this is the same family.

The Informant on Anne's 2 Jan 1855 Death Certificate is Euphemia McINTOSH, daughter. Both parents stated as deceased. Born Inverness Scotland. Time In Colony - 5 months Victoria. Married in Inverness Scotland at 21 years to Donald McIntosh. Issue: Janet 36, Ann 32, Mary (possibly D? for deceased), Isabella (also possibly D? for deceased and no age given for either), Lochlan 28, Euphemia 26, Elizabeth 22 and Jane 19 .

It is possible that Ann may have had another son named John Carr who born about 1816 in Duthil Scotland. He is listed on his death certificate as Illegitimate. His mother is listed as Ann Collie and his father "Reputed" John Carr. John died in 1895 at Coylum Bridge Invernesshire. John was a Gamekeeper by profession .

I have a rather tentative finding for John and Sarah in the 1861 census.
5 Grantham Street St Martins Lincoln John Hewitt aged 70 retired Bootmaker (b Market Rasen) and his wife Sophia Hewitt aged 58 (b Coningsby). They had a son John Henry Hewitt aged 15. The Leroys I'm looking for were apparently Hugenots. They married into my family somewhere along the line. As my family were solid Lincolnshire I am lookinging for Lincolnshire Leroys. There are tons of Leroys up in Durham but very few in Lincolnshire.

Miles Jarvis on June 29, 2000 was trying to find to find out information about relatives/parents of William Hewitt who died in 1846 aged 92 in Lincolnshire (DoB 1754). He married Elizabeth (Brooks?) and had a number of children including John Henry Hewitt who was a bootmaker in Lincoln - bapt. 12.1.1789 and retired in 1851. He believes he married and he was also trying to find out information about a Captain Thomas Hewitt who served with the 10th (North Lincolnshire) regiment. He joined in 1777 and resigned his commission in 1785.

I am researching the convict JOHN HEWITT born April 1797 in Boston Lincolnshire. He was convicted of stealing wheat and sentenced to 7 years arriving on the ship "John" on the 8 June 1832. He was married to a HANNAH RAMSEY at the time of
his conviction. Two years later in 1834 his wife was tried and convicted of shop lifting and also transported to Australia with 5
of her 9 children. John Hewitt died 2 August 1834 at Windsor and it is not known if he ever saw his wife and children before his death. Following her husband's death in 1834 Hannah married another convict JOHN THOMPSON in 1835, then in June 1839
married JOHN BACON. In September 1854 she again married this time a WILLIAM BROWN.

92. George SMITH was born 1 in 1777 in Birmingham, Warwickshire, England. He died 2 on 10 Dec 1826 in Windsor, NSW Australia. He was buried in St. Matthew's, Windsor NSW. He married 3 Elizabeth ROBINSON on 19 Oct 1813 in St. Matthew's, Windsor NSW. George departed England on 28 Jan 1806, arriving in the colony on the 12 Jul 1806 as a Convict on the ship "Fortune". He was later employed as a Victualler.

George was a Bookeeper in Birmingham, Warwickshire, England. He was 5' & 8" tall with a fair complexion, light brown hair and hazel eyes (AO NSW COD 18 page 376 no 3/1290). On 10 Aug 1805 at Warwick Assizes England, George was sentenced to seven years transportation and he left England on on 28 January 1806 aboard the ship "Fortune" arriving in Australia on 12 July 1806. Although a convict, he was a clerk to the Bench Of Magistrates in Windsor at the time of his marriage by special licence at the Hawkesbury Chapel. He was a resident of the Windsor district since 1808 until his death and on Colonial Secretary's Papers dated 10 Sep 1818 was on list of person to receive grants of land in 1818. His sentence expired on 10 Aug 1812 and his Certificate of Emancipation was dated 3 Jan 1814.

George and Elizabeth had seven children: Mary Ann (1815) married James CUNNINGHAM, Eliza (1816) died 12 Mar 1819, Henry Alexander (1818) our direct ancestor married Sarah MURRAY, Harriett (1820) married Thomas SARJEANT, Maria (1822) married her brother-in-law James CUNNINGHAM after the death of her sister Mary Ann, Eliza (1824) married George SMITH-HALL, George Edward (1826) d. 18 Feb 1827.

In the Sydney Gazette on Saturday 16 Dec 1826, his Death Notice stated :
"At his residence, George St. Windsor on Sunday morning last, at 7 o'clock, Mr. George SMITH, age 48 years, after a short illness which he bore with truly Christian fortitude & resignation, leaving a widow & 6 young children to deplore the loss of an affectionate husband, a tender parent & much regretted by a numerous circle of friends".

At the time of his death his occupation was described as a "Victualler", this being a person who supplies food and stores.

93. Elizabeth ROBINSON was born 1 on 10 May 1795 in Sydney Cove, Sydney NSW Australia. She was christened on 6 Jul 1806 in St.Phillips's, Sydney NSW Australia. She died 2 on 12 May 1859 in Windsor, NSW Australia. She was buried in May 1859 in St. Matthew's, Windsor NSW. Elizabeth was employed as Innkeeper in Windsor NSW. [Parents]

Elizabeth was the daughter of two convict parents, Edward ROBINSON who arrived as a convict on the ship "Admiral Barrington" on 16 Oct 1791 and Mary HARRISON who was transported from England on 16 Feb 1791, aboard the "Mary Ann" and arrived in Sydney on 9 Jul 1791.

The eldest of seven children, she was born when her mother was about 21 years of age and had six siblings, Harriet (1797-1877), Ann (1798-1848), Mary (1800-1867), Maria (1803-1868), Robert (1804) and Edward William Alexander (1805-1874).

Her father, Edward was a habitual thief in 1789 before his transportation, but he became a Landholder and was known in the Hawkesbury Settlement as a successful farmer. Edward was also an Innkeeper, like Elizabeth. On 18 October 1809 one of Edward's grants of 80 acres at Upper Nelson was also in the name of Elizabeth ROBINSON. She was only 13 or 14 years of age at the time.

Elizabeth, who was illiterate, married George SMITH, a Convict, when she was eighteen years old. Witnesses to their marriage were Paul BUSHELL and her sister Ann ROBINSON, who also signed with 'x' her mark and Joseph HARPUR. Elizabeth had seven children to her first marriage with George. After he passed away at 49 years of age on 10 Dec 1826 Elizabeth was a Widow and remained unmarried for nearly ten years.

Elizabeth had one son to her second husband John Woodness SMITH the day before her 41st birthday: John Thomas SMITH born 9 May 1836. She married John Woodness SMITH on 16 May 1837 in St. Matthew's at Windsor. John was also a convict, who had been born in London in 1797. He was transported to Australia on 18 May 1821, aboard the ship "Speke".

Elizabeth became a Widow once more when her second husband, John died on the 31 May 1843.

Her son John Thomas SMITH married Blanche Selina DUNSTON in St. John's, Wilberforce NSW on
16 Sep 1868 and they had five children, Ernest D (1869), John Dunstan (1871), Elizabeth Mary (1873),
Hilda Woodness (1878) and Mildred (1885).

94. Robert MURRAY was born about 1790 in possibly England or NSW Australia. He died on 30 Jan 1822 when he drowned in Sydney, NSW Australia. He married 1 Rebecca WATSON on 26 Apr 1811 in St. Phillips, Sydney, NSW, Australia. Robert possibly immigrated 2 on 4 Apr 1807 as a Seaman on the ship 'Brothers'. He was employed as Port Jackson Harbour Pilot. He was employed 3 as a 'Master Mariner/Habour Pilot' at time of his marriage on 26 Apr 1811.

I have not established whether Robert was born in England or Australia, though he must have had some knowledge of the sea, as he was a Port Jackson Harbour Pilot. This is probably how he met his wife to be, Rebecca WATSON, as her father, Robert WATSON, was also a Harbour Pilot.

Robert died tragically in the company of two other men on a small boat returning from a local wharf which left the King's Wharf for South Head, the place of their residences. The Captain of the "Midas" who was sailing past the trio witnessed that two of the three were very drunk and they never reached their destination. No bodies were found. The next day two oars were picked up on the beach, as well as part of the boat, and later, one or two hats were found floating. The incident was reported in the Sydney Gazette dated 1st February 1822 and included in part the following transcription :

"and Mr Murray, who for many years bore, in the colonial merchant service, and also under the Government a character irreproachable for assiduity and integrity, leaves a widow (a young woman of the Colony) far advanced in pregnancy, to lament his premature end. We are unwilling for the sake of those relatives that are now disconsolate, to mention anything that would have tendency to give additional pangs to the wounded mind; but, we should fail in the performance of public duty, were we not to say, that such repentedly woeful example loudly enjoin a sufficient of reflection to induce persons to abstain from those vices, that are at once so pernicious and so awfully destructive in their consequences."

It appears that their bodies were never found, as there is no trace of any Burial Records for any of the three that drowned that evening.

Robert and Rebecca possibly had two children:
i. Robert MURRAY, b. ca 1820, possibly Sydney, NSW. His details are unknown, though there is reference to him and his mother on 8 Sep 1821 in relation to his father being the Port Jackson Harbour Pilot. At this stage it is believed that Robert Jnr was the son of Robert and his first partner Mary GOUGH and this child was raised by his second wife Rebecca.
ii Sarah MURRAY baptised 14 Mar 1822, our direct ancestor married Henry Alexander SMITH.

We know very little of Robert Murray, at the time of his marriage to Rebecca WATSON it states he is a Master Mariner.
In the Historical Records of Australia, a Robert Murray Captain of "Eliza" is mentioned.

95. Rebecca WATSON was born about 1792, possibly on Norfolk Island, Australia. She died 1 on 28 Sep 1826 in George Street, Sydney, NSW Australia. The cause of her death was suffocation by excessive drinking. She was buried 2 on 29 Sep 1826 in Parish of St.James, County of Cumberland. Rebecca was possibly born in Dec 1792 on Norfolk Island, the daughter of Sarah DORSET. Rebecca would undoubtedly have been raised in the shanty towns of The Rocks, as her father Robert was a Signal Man from 1791 to 1811 and in 1800 he was in charge of battery on the east point of the Cove (Dawes Point?). A few months after her marriage on 17 Aug 1811 her father Robert was appointed Boatswain of the Dock Yard at Sydney and Harbour Master of Port Jackson. It was not until five years after her marriage that he is mentioned on the list of persons to receive grants of land at North Harbour (16 Jan 1816) and two years later on 28 Nov 1818 was appointed Superintendent and Keeper of Light at Macquarie Tower.

The Mitchell Library Manuscripts Card Index for Rebecca DORSET states she was born on Norfolk Island on 23 Dec 1792 and departed Norfolk on 22 Mar 1794. Source : Norfolk Island Victuallers Book. p.77b (Ref A1958).

On 26 Oct 1821 Rebecca and her brother John made the following Petition to the Colonial Secretary for land entitlement at Watsons Bay :
To His Excellency Lachlan Macquarie Esq etc.

The humble petition of John Watson and Rebecca Murray most respectfully showeth :
That your Excellency's humble petitioners are the only children now living of Robert Watson, deceased, late pilot and harbour master of Port Jackson. That about 17 years ago his Excellency, the late Governorn King, bestowed your humble petitioners' late father an allotment of land at South Head for the purpose of building a house thereon which has been done many years since, and your Excellency was pleased some time ago to promise your humble petitioner's father a grant of the said land. Your humble petitioners are therefore emboldened to solicit your Excellency for a grant of the same and humbly trust your Excellency to extend that promise to your humble petitioners and consider them worthy of that indulgence, and your humble petitioners will as in duty bound ever pray.

The Surveyor General of Lands is authorised and directed to mark out and locate for John Watson and Rebecca Murray, the petitioners, the allotment of grand occupied and built upon by their later father, providing it does not exceed fifty acres and does not interfere with the any Crown purposes.

When Rebecca's husband Robert died in 1822 she was pregnant with their daughter Sarah, who was born six weeks later. At the time of her death she was living at Mr. Redman's residence in George Street. The Coroner's Jury gave a verdict of "suffocation by excessive drinking". Ironically, the Inquest was held in the local tavern, the afternoon after the discovery of her body. There are two transcriptions from the local papers describing her death (Sydney Gazette 30/9/1826 and Australian 30/9/1826).

SYDNEY GAZETTE: SATURDAY 30 SEPTEMBER 1826
"Thursday last, a Coroner's Inquest was held in George Street on the body of Mrs Murray, widow of a person of that name formerly of Sydney, who was found dead the same morning. It appeared that the deceased was addicted to drinking and had gone to bed the previous night in a violent state of intoxication and Jury accordingly returned a Verdict - Died of suffocation by excessive drinking."

THE AUSTRALIAN: SATURDAY 30 SEPTEMBER 1826
"A Coroners Inquest was held on Thursday morning last, at the Sign of the Union public house in George Street, before G.M. Slade, Esq. Coroner, on the body of Rebecca Murray. From the evidence adduced before the inquest, it appeared that the deceased was the surviving widow of Mr.Murray, the late pilot master of this Port, who may it be recollected by some was accidentally drowned between two and three years ago. The body of this poor unfortunate woman in this instance, was found in her apartment a lifeless corpse in the course of Wednesday and from the concurrent circumstances was supposed to have come by her death from suffocation, whilst in a state of extreme inebriety. Prior to the death of her husband she was said to be a woman of temperate habits but after his melancholy loss had given herself up to the habits of drinking. The Jury found a verdict that the deceased came by her death from suffocation in liquor."

Ashdown is very much a Sussex and Kent name and there were many ASHDOWN's in that area. I was advised that in the early 1800's that most people tended to stay around the same small area, so the earlier Ashdown's possibly remained in the North Aylesford and Malling registration districts.

Due to their marriage being in Frindsbury John was originally thought to be the son of John and Sarah ASHDOWN who had four children John (1804) and an older brother Isaac (1802) baptised in Frindsbury Kent, and two sisters, Sarah born and baptised in 1806 at Wilmington Kent and Sophia baptised nine years latter in 1815 at Crayford Kent.

However thanks to Rob GIBSON who is researching daughter Frances (1832) on behalf of his friends Ann & Pete APPS, I learnt in the 1861 Census John ASHDOWN was from Otford, Kent, England. Otford is a village not far from Sevenoaks.

John ASHDOWN was a baker residing in Malling, Kent during the years 1822 to 1827 when their first four children were born : Harriet (1 Apr 1822), John (17 Aug 1823), William (26 Jan 1826) and Henry (25 Sep 1872) our direct ancestor who married Mary Ann LAWS.

The family does not appear in the Frindsbury Parish Registers after Henry's Birth in 1827. However it is likely there were eight more children born to John and Harriet at Wrotham Parish, Kent (which is only 10km from Frindsbury). Jane Elizabeth (1829), Frances (1832), Thomas (1836), Mary (1838), George (1840), James (1842), Edward (1845) and Daniel (1845).

However Edward is christened on 3 Sep 1845, before Daniel's (11 Sep 1845), so it is quite possible there were two couples in the parish with the same names. I am as yet to hire the 1851 Census records for these parishes, which should indicate if the father of these children was a "Baker". However, we know John & Harriet were definitely the parents of the four children christened in Malling and also Frances (1832), Thomas (1836) and Edward (1845) christened in Wrotham.

The cause of John ASHDOWN's Death of Climacteric (climacterick) Decay is "Pertaining to a critical period in human life.
The period (in males and females) when fertility and libido are in decline." The witness at the death of John ASHDOWN on
22 Sep 1863 was M.A. MILLER. The only MILLER residing in Wrotham in the 1871 Census was Mary A Miller born 1801in Newhaven, Sussex, England as Head of household in Wrotham Kent . Mary A Miller Age in 1871: 70 ; Estimated birth year: 1801 resided in St. Mary's Lane, Wrotham with no other family members and was born in Newhaven, Sussex, England. Of interest her neighbours (possibly residing with her?) at the time of the 1871 Census were Elisa SEAL Widow aged 73, Elisabeth ASHDOWN Widow aged 78 born Sussex Wadhurst, Elisabeth SMITH, Widow aged 76 born Wrotham, Kent and all are stated as Head of Household and all with Occupation of 'Almswoman' at:

About two miles south from Shoreham and three north from Seven Oaks; s the village of Otford, presenting the wide spread ruins of a castle, once the proud residence of the celebrated Thomas á Becket. Ightham five miles SE from Seven Oaks, Two miles from Ightham is the village of Wrotham, in an extensive parish; principally situated on the side of a hill, on the road to Maidstone, from which it is distant eleven miles. It was formerly a market town and appears to have had some importance attached to it, as from it the hundred in which it is situated is named.

The other John (Deaths Dec 1871 Ashdown John 71 Malling 2a 280) looks as if he was a Bricklayer from Rochester on the 1861 census so he could have moved the few miles south to the Malling area by the time of his death.

At least three of John and Harriet's children moved to London, including possibly their brother Henry, our direct ancestor, before his immigration to Australia. John Jnr (also a Baker, Unmarried aged 39 years) and his sister Mary (also Unmarried aged 23 years) were living at 44 King Street, Deptford, Greenwich in the 1861 Census. This has probably solved the mystery as to why their sister Frances married Charles Kirk in London and how in fact they met in the first place. Frances obviously went with her brother and sister and stayed there with their brother George moving to London too. George was an umarried Clerk Admirally Post Office Director, aged 20 years, residing at 4 St James Gardens, Marylebone, Kentish Town, Pancras in the 1861 Census. Frances KIRK was employed in Post Office Duties at Wrotham, Kent in 1881 Census.

There was a marriage for a George Ashdown to Mary Ann Collins on 25 Dec 1876 in Frindsbury (possibly the abovementioned son George born in 1840?).

I am researching the Ashdowns of Wrotham,Kent for a descendant of Frances Ashdown born 1832 in Wrotham.I have identified her as being the daughter of a John and Harriet Ashdown.
On the IGI there are twenty children born to more than one John and Harriet,but from the known age of my Frances the one quoted there as christened April 29 1832 is the correct one.From the 1861 census John(72)was born in Otford,Kent and his wife Harriet(62)was born in Birling,Kent.It looks as if these were the two who married in the Frindsbury area in 1821.John was a Baker by trade as were at least two of his sons. Your list of children then looks correct, but should include an Edward(1845) as he is still with his parents in 1861. Interestingly there is a daughter Harriet (1822) born in West Malling, also Thomas (1836) born Wrotham at home too. This then points to the fact that all the children on that IGI list born in West Malling and Wrotham are all children of that one John and Harriet.(12 in all). Henry (christened Oct 27 1827) ...IGI list, is a brother of the above children too.

Barrow Green, 1575, 1587, Boroe Green 1594, Burrough Green, 1697, Burrow Green, 1713. The exact source of the name is unknown. The original parish of Wrotham was divided into six boroughs, Town, Stansted, Nepicar, Winfield, Roughwaye and Hale. It is thought that Borough Green was the site for games and sports for the area, not a village green, but a "Borough Green". Another theory is that it was Barrow Green, of which there is some evidence. A further theory is that it was Boroe Green from the Anglo Saxon for a place of refuge
In 1841 the census returns show 70 houses with 186 males and 174 females. The Basted Paper Mills were insolvent at the time so only 3 paper makers were listed. There were 41 agricultural labourers, 4 carpenters, 2 shoemakers, 2 smiths, 2 wheelwrights, 2 lawyers, 1 school mistress (private), 2 dressmakers, 1 publican (Black Horse), 1 beer retailer (Fox and Hounds), 1 tailor, and 1 baker. Butchers, doctors and dentists would probably have been in Wrotham Town. Henry Ashdown had the forge in Station Road. He sang in Platt Church Choir. Rob Gibson advised in Feb 2005 re 1861 Census the word "Ufford" it should read "Otford" and does on the original census document. Otford is a village not far from Sevenoaks and ties in nicely with the family being in the Wrotham and West Malling areas. Birling is also a small village only about 2-3 miles from Wrotham, where Harriet was born.

The family does not appear in the Frindsbury Parish Registers after Henry's Birth in 1827. However there were eight more children born to John & Harriet at Wrotham Parish, Kent (10km from Frindsbury) as the LDS site gives the following ;
1829 Jane Elizabeth, 1832 Frances, 1836 Thomas, 1838 Mary, 1840 George, 1842 James and 1845 Daniel.

Harriet died in 1873 at the age of 71 years. Cause of death being Chronic Hepatitis & Anasarca. Anasarca Generalised, massive, intractable oedema. This will probably result from heart or renal failure. Oedema is an excess of fluid within a tissue. It can occur in any site, tissue or organ. There are several "sub-types" of oedema .
(1) Dependant oedema, where the oedema collects in lowest part because of gravity This is usually the lower leg but in someone who is bedfast it could be over the lower back or the lungs. In severe cases the oedema can be generalised - Anasarca may be due to heart failure, kidney failure, severe anaemia conditions where there are low levels of protein in the blood such as malnutrition and liver disease.
(2) Pitting oedema. This is likely to be dependant oedema and means that the fluid can be pressed out of the skin that overlies the oedematous area and leave an indentation
(3) Pulmonary oedema. This is fluid within the airspaces of the lung and results in breathlessness and a cough producing watery, frothy and occasionally blood tinged sputum.
The usual cause is heart failure, when the breathlessness and cough tend to be worse when the victim lies flat i.e. at night
May also result from inhalation of gasses, fumes, poisons etc
(4) Lymphoedema. This is usually seen in a single limb or sometimes the head and neck. It results from an obstruction to lymph drainage. The underlying cause is usually primary cancer or the spread of a cancer (including blood cancers like leukaemia, lymphoma and myeloma) or infection

The witness at her death is Elisabeth BRATTAN, present at death of Wrotham, who signed with her 'x' mark (which possibly may have been her daughter Jane Elizabeth, however age in 1881 Census appears five years older if related to 1881 UK.

The parentage of our ancestor William LAWS is still unproven at this stage. However, William LAWS christened on 11 Jan 1801 in Folkestone, Kent, England to William and Judith LAWS, is believed at this stage to be that of our ancestor. If the abovementioned birth proves to be correct, then he had the following nine siblings : Elizabeth (1802), James (1804), Elizabeth (1805), Alice (1806), Harriet (1808), Elizabeth (1809), Richard (1811), Eliza (1814) and Susan (1817) all christened in Folkestone, Kent, though not all survived infancy.

Our ancestor William LAWS is stated as from the Parish of Bermondsey, Surrey (which is near London) at the time of his marriage to Mary Ann HIGHT. However, he is possibly the William christened on 11 Jan 1801 in Folkestone, Kent, England to William and Judith LAWS. The marriage entry may include the word 'of Lympne', which is an adjoining Parish of Folkestone.

William and Mary Ann had three children, who were all baptised in Northfleet, Kent, England : Sarah (1818 ), William (1820) who immigrated to Australia and married Honor ANDERSON and had seven children in Sydney, Mary Ann (1826) our direct ancestor who also immigrated to Australia and married Henry ASHDOWN.

There is a William LAWS listed in the 1828-1834 Pigots Directory, which gives William Laws of 'Leather Bottle" Inn/Tavern. This may have been our William LAWS. However, I won't know if it relates to our ancestor. There is no Listing in Pigots in1840 for Gravesend http://freepages.genealogy.rootsweb.com/%7Eshebra/new_page_4.htm

Mary Ann was the daughter of John and Sarah HIGHT (nee MINTER) and the eldest of five children. She had four siblings, Sarah Minter HIGHT (1803), John (1805), John (1807) and Richard (1809).

Their first child, a daughter Sarah, who would have been named after Mary Ann's mother was christened at the Parish Church of England in Northfleet Kent on 8 Nov 1818. Two months later she married William on 20 Jan 1819 in her home town of Folkestone, Kent. Their son William was christened the following year, followed by Mary Ann's in 1826, both in the Parish Church of England in Northfleet, so it would appear the couple resided in Northfleet.

Duration - Indefinite. He was buried 3 on 8 Nov 1899 in Church of England Cemetery, Rookwood. He married 4, 5 Ann FINNIGAN on 21 Nov 1836 in St. James Church of England, Sydney NSW Australia. Thomas possibly immigrated in 1829 as a convict on the ship "Mellish". He was employed as Tailor. He joined religion 6 Church of England. [Parents]

It has not yet been confirmed that Thomas was the Thomas SADLER transported to Australia as a convict on the ship "Mellish" which arrived in 1829 who was granted a Certificate of Freedom on 12 Jan 1833. Certificate of Freedom Number 33/0017. State Records of NSW Ref. 4/4314. Film No.990. This convict has been recorded as having "flat feet".

There was also a Thomas SADLER, convict aged 34 (born ca.1799) who arrived on the ship "Lotus" in Tasmania in 1833. Refer 'Index to More Tasmanian Convicts, Papers re Convict Ships 1814-1845) published by FHC Resources Group Kiama NSW". Year 1833. Frame 0234. Reel P3-7. Roll CY 1242.

When Ann and Thomas married on 21 Nov 1836 Ann signed "x" with her mark and her surname is recorded as FINICAN.
The ceremony was performed by Robt. Cartwright, Chaplain in the presence of John and Ann ROBBINS of Kent Street., Sydney.

On 1st Jul 1851 Thomas SADLER, widower marries Mona DORY, widow in the same church as first marriage to Ann. Witnesses to the marriage are James JONES & Agnes JONES of Pitt Street and Thomas signs with this mark "x".
However this could be another Thomas SADLER as there were several in the early colony. Ours may indeed be the one
that died at age 44 in 1846 (reference : V1846848 115/1846 SADLER THOMAS AGE 44). However the occupation for
the one that dies on 7 Nov 1899, does correspond with our ancestor being a Tailor and is also of the correct age. The
informant was the Chief Superintendant of Rookwood Asylum who stated Thomas had been in NSW for 73 years (ca 1826).

When Thomas & Ann's son, our ancestor Thomas marries Agnes McCREA on 15 October 1860 witnesses to the marriage are Marcus S LOGAN & Thomas SADLER (possibly the father of the groom?). Thomas SADLER who was one of the witnesses also signed with his "x" mark.

There are no births recorded in Victoria remotely similar to Thomas SADLER for that time - records only go to 1920 for births.

293. THOMAS SADLER was indicted for stealing, on the 2d of January, 7lbs. of mutton, value 3s. 6d., the goods of Edward Mitchell.

MARY MITCHELL. I am the wife of Edward Mitchell, a butcher, who lives in St. John-square. Clerkenwell. About a quarter past six o'clock on the evening of the 2d of January, a lady said some meat was stolen - I ran as far as St. John-street, and saw the prisoner with two other boys - I caught bold of him, and a gentleman assisted me- the meat fell from him - I had seen it safe about three minutes before it was missed - he must have crept under the stall board.

Prisoner. Two young chaps said they would give me a penny to carry that meat for them as far as Smithfield - I took it, and the woman came and began to beat me.

BENJAMIN PHILLIPS. I am an officer, and took the prisoner.

GUILTY. Aged 14.

Thomas Sadler was possibly one of the migrants from Tasmania, who were brought to Victoria by the Geelong,Portland Bay (& Port Fairy) Emigration Society.They arrived between 1845 and 1846 per the vessel's David, Scotia, Julia, Platina, and Shamrock. The migrants in 1845 and 1846 were brought over to Victoria by the Geelong and Portland Bay Immigration Society (including Port Fairy). The society was formed by the likes of squatters and merchants along the southern seaboard and into the hinterlands of the ports of Portland Bay, Port Fairy, and Geelong.

In 1846 a Thomas Sadler was listed to be brought to Port Phillip aboard the vessels charted by the Geelong and Portland Bay Immigration Society (including Port Fairy) although possibly listed he may not have embarked? Yet, this entry gives further connection to the possibility of his wife Ann, being the Ann Finnigan born in Port Fairy.

Ann possibly may have been born in Victoria? An Annie Irene FINNIGAN was born in 1818 at Port Fairy, father Jno (John), mother Doris RUSSELL. Possible surname variants include FINIGAN, FINNEGAN, FINEGAN, FINNAGIN, FINGHAN and FINGHIN, FINNCANE, FINUCANE.

When Ann and Thomas married on 21 Nov 1836 Ann signed "x" with her mark and her surname is recorded as FINICAN.
The ceremony was performed by Robt. Cartwright, Caplain in the presence of John and Ann ROBBINS of Kent Street, Sydney.

If she did infact outlive her husband Thomas, the the only suitable death entry is in 1881 (Reference :1720/1881 SADLER ANN JAMES UNKNOWN SYDNEY). However this is not for the correct person - having arrived in the Colony ca.1858.

William had ten children by his second wife Jessie YARD whom he married when he was 39 years of age:
