LAST WILL AND TESTAMENT OF GABRIEL FURMAN
In the name of God Amen I Gabriel Furman of Newtown in Queens County
on Long Island in the province of New York yeoman being far advanced in
Age and sick and weak in Body, but thanks be to God of sound mind and
memory and of perfect Understanding do therefore make this my last Will
and Testament in manner and form following and principal and first of all
I give and bequeath my precious and immortal Soul unto God who gave it my
Body I recommend to the Earth to be decently Interred at the discretion of
my Executors herein after named, and as such worldly Estate wherewith God
has blessed me in this Life I give will devise bequeath dispose thereof as
followeth Item I will and order that in the first place all my just Debts
(if any I shall owe) together with my funeral Expenses shall be duly paid
by my Executors out of my personal Estate Item I give and bequeath unto my
son Gabriel Furman all my wearing apparel as also the sum of ten Pounds
New York, money over and above what I have heretofore given given unto him
out of my Estate, Item I give and bequeath unto my Cousin Mary Thompson
whom I have brought up from a Child the sum of Ten pounds Item I will and
order that Abigail my dearly beloved Wife Shall have a good and sufficient
maintenance out of my Estate supplied unto her by my Executors and of the
same and I also give unto her full and free Liberty to continue in my now
dwelling house during her natural Life but if she shall chuse to remove
from the same and live with any of her children then on her quitting the
same I do hereby authorize and fully impower my Executors to sell and
dispose of my whole Estate real and personal at Publick Vendue or
otherwise as they shall think best for the Advantage of my Estate and of
the moneys arising thereby I give devise and dispose of as followeth, my
wife always first to be provided for and supported as aforesaid) to wit,
that the same shall be equally divided amongst my Children hereafter
named, to wit, William, John, Abigail the wife of Ezekial Furman, Samuel,
Howard, Margret the wife of Benjamin North, Nathan, Joseph, Benjamin and
Mary Furman Single woman only with this that my said Son Nathan shall have
fifty Pounds less than either of the rest out of the said Division by
reason that I have hertofore given unto him the Sum of fifty Pounds more
than the rest of my sons and daughters last above mentioned Item whereas I
have two out Lots of Land in the Township of New Town aforesaid lying
separate from my Homestead Lands The one called the Neck Lot and the other
the old Lot I do hereby Authorise and impower my Said Executors to sell
and convey the said two Lots of Land at any time after my Decease when
Ever they shall see cause, and the moneys arising thereby to divide and
distribute amongst my Ten last mentioned Children abovesaid in such
Proportion as aforesaid Item my Will is that my said Wife over and above
what I have herein before given or bequeathed unto her shall have the
Liberty of Keeping six of my best Cowes on my homested Lands while she
shall continue in my now dwelling House as aftersaid and to take and
receive the benefits and profits of the said Cows to her own use and I do
hereby enjorn my said Executors to Provide fother for the said Cows in the
Winter Season during the Term aforesaid out of my Estate and Lastly I do
hereby nominate and appoint my two Sons William Furman and John Furman
both above mentioned Exectuors of this my last Will and Testament
declaring and allowing this and no other by me heretofore made to be and
contain any last Will and Testament. In Testimony whereof I have hereunto
set my hand and seal the Day and year hereafter mentioned to wit the
twenty first day of September in the year of our Lord Christ on thousand
seven hundred and Sixty two The mark of Gabriel X Furman (Ss) Signed
Sealed published and declared by the said Gabriel Furman the Testator as
and for his last Will and Testament the word me in the 9th Line on the
other side being first interlined and the words (Benjamin North) on the
same side in the 28th Line being first Erazed) in the presence of us who
have hereunto subscribed our Names as Witnesses thereto in the Presence of
the said Testator and in the Presence of Each other William Welling,
Richard Morrell, Benj a Hinchman, I the herein and above named Gabriel
Furman do this fifteenth day of September in the year of our Lord
seventeen hundred and sixty eight make a possible this my Codicil to my
above and here in before unto last Will and Testament in manner following
(to wit) Thereas Since the making my last Will and Testament my Daughter
Abigail the late Wife of Ezekiel Furman therein named is deceased so that
he Legacy or Legacies in and by my said last Will and Testament aforesaid
given unto her is become lapsed wherefore I do hereby declare that my will
is that her Children (to wit) Gabriel – Nathan and Josiahs shall have all
and whatsoever I therein gain or bequeathed unto my said Daughter Abigail
their mother equally to be divided amongst them to be paid to them as they
respectively arrive to lawful Age or marry and it is my Will that my
Executors shall [quit ?] and keep the same out at Intenst in the mean Time
and pay the same in manner and form as aforesaid But my will is that in
case any or either of them shall happen to Dye before the said Legacies
shall become due as aforesaid that then the Survivors or Survivor of them
shall have the whole and of it So happen that they all dye before their
Legacies shall become due then my Will is that the said Legacie or
Legacies so in and by my said last Will and Testament given unto my said
Daughter Abigail as is therein mentioned Shall return unto my Estate and
be divided amongst all my Children in my said Will named in proportion to
what I have therein given unto them respectively and lastly it is my
desire that this present Codicil be made part of my last Will and
Testament & all intents and purposes. On Witness whereof & the
said Gabriel Furman hair hereunto set my hand and Seal this day and year
aforesaid The mark Gabriel X Furman &s Signed sealed made and
published in the presence of us who have hereunto Subscribed our Names as
Witnesses thereto William Welling, Luke Ramson, Queens County s. s. Be it
Remembered that on the twenty third day of January one thousand seven
hundred and sixty sixty nine personally came and appeared before me Henry
Dawson Surrogate of the said County William Welling of said County yeoman
and being duly Sworn on his Oath declared that he did see Gabriel Furman
sign and seal the within written Instruments purporting to be the Will and
Codicil of the said Gabriel Furman of the Will bearing date the Twenty
first day of September one thousand seven hundred and sixty two And the
Codicil bearing date the fifteenth day of September one thousand seven
hundred and sixty Eight And heard him publish and declare the same as and
for his last Will and Testament that at the time thereof he the said
Gabriel Furman was of sound disposing mind and memory to the best of the
Knowledge and Belief of him the Deponent, And that his Name subscribed to
the said Will and Codicil is of his own proper hand writing which the
subscribed as a Witness to the said Will and Codicil in the Testators
presence And that he the Deponent saw Richard Morrell and Benjamin
Hinchman the other Witnesses to the said Will, and Luke Ramson the other
Witness to the above Codicil subscribe their Names as Witnesses thereto in
the Testators presence. Henry Dawson Surrogate Sir Henry Moore Baronet
Captain General and Governor in Chief in and over the Province of New York
and the Territories depending thereon in America Chancillor and Vice
Admiral of the same. To all to whom these Presents shall come or may
concern Greeting. Know ye, that at Queens County on the twenty third day
of January last before Henry Dawson Esquire thereunto delegated and
appointed, the last Will and Testament of Gabriel Furman deceased (a copy
whereof is her unto annexed was proved and is now approved and allowed of
by me the said Deceased having whilst he lived and at the Time of his
death Goods Chattels and Credits within this Province, by means whereof
the proving and registering The said Will and the granting Administration
of all and singular the said Goods Chattels and Credits and also the
auditing allowing and final discharging the accounts thereof doth belong
unto one; And that Administration of all and singular the Goods Chattels
and Credits of the same Deceased and any way concerning his Will, is
granted unto William Furman and John Furman the executors in the said Will
named being first duly sworn will and faithfully to Administer the same
and to make and Exhibit a true and perfect Inventory of all and singular
the said Goods Chattels and Credits, and also to render a just and true
Account thereof when there unto required; On Testimony whereof I have
caused the Prerogative Seal of thee Province of New York to be hereunto
Affixed at the City of New York, this fourth day of March one thousand
