JAMES COURTNEY

Greene County TN
September the 16 day of 1833. In the name of god amen. I James Courtney of the County of Greene and state of Tennessee being weak in body but sound in mind and memory at this time but knowing that it is once appointed for all men to die do make constitute and ordain this my last will and testament in manner and for following (vizz). I recommend my soul to God who gave it to me and my body to be buried in a decent and christian manner. As to my worldly goods which it has pleased God to bestow on me I give and bequeath in form and manner following. Item 1st - my will is that all myjust debts be paid. Item 2 - I give and bequeath to my beloved wife Sarah all my real and personal property during her lifetime or widowhood except Item 3 - I give and bequeath to my beloved grandaughter Sarah P Mangram one feather bedsted and furniture that she now claims and also a cow that we call spike horn and also a flax wheel. Item 4 - my will is that my beloved grandson Jeremiah Mangram be paid twenty dollars in cash. Both my grandchildren here mentioned received their above described legacy at my death. Item 5 - My will is that each of my lawful children (viz) George COURTNEY, James COURTNEY, Lucinda MARSHALL, Marshall COURTNEY, Elizabeth HOLDAWAY, Agga HURLEY, Sarah HURLEY, Polly HURLEY and Jane PETTIT receives one dollar at my death. Item 6 my will is that my beloved wife Sarah keep the balance of my property both the real and personal in her own hands during her natural life time or widowhood and at her death or marriage Item 7 my will is that my beloved son Fielding COURTNEY shall have all my real and personal as his legacy to me. Item 8 my will is and I do hereby appoint my beloved sons Marshall COURTNEY and Fielding COURTNEY to be my executors of thismy lat will and testament relaying on them that they will execute it faithfully avowing to my above stated desire. Item 9 I hereby revoke and declare all other wills by me made heretofore null and void. I also publish pronounce and declare this my last will and testament in the presence of attest. An there upon Fielding Courtney one of the Executors namedin said will entered into bond in the sum of five hundred dollars with Vincent JACKSON and Hugh MALONEY. Securities qualified according to law.
The executor of the last will and testament of James COURTNEY decd was duly proven by theoath of George MURPHY, Thomas STROUD and Jacob HAUN subscribing witnesses:
James Courtney was the husband of Sarah Kesterson , daughter of William and Ann Kesterson of Greene Co TN.
