I, Nathan Potts, of the County of Caldwell in the State of Missouri do make and publish this as my last will and testaments. 1st: I will that my funeral expenses, and expenses of last sickness be paid out of any money that may next come to hand. 2nd: I will that my debts be paid out any money that may next come to hand, and without delay. 3rd: I will that as soon as can be that my guardianship of the minor heirs of John Fryer, deceased, be settled up. Also my curatorship of said heirs be also settled up any money that may be coming to them or any one of them from me as their Curator shall be settled and paid off. And for that purpose I hereby appoint and authorize William H. Kesterson to settle up and have the amount of my description be sold immediately and hereby authorize the same to be sold under the direction and control of the Probate Court of Caldwell County and in the same mode and manner as in cases of Sales by administration so far as applicable. 5th: I will that my Negro slave named "Jule" be and is hereby set free and no longer held in bondage from and after my death - also my Negro slave "Soss" be and is hereby set free and no longer be held in bondage from and after my death and I desire it to be understood and so acted upon that my two slaves named shall have their freedom after my death. 6th: I will that after my liabilities and debts are all settled and paid off, that my children shall each have an equal share of my estate, except for reasons satisfactory to me, I desire and will that the heirs and children of Nancy Davis, my daughter, shall take and have the share that she would as one of my children and heirs have in my property and estate, I therefore and further will I hereby appoint (blank) Executor of this my last will and testament. I hereby revoke and make void all former wills by me heretofore made. In witness whereof I set my hand and seal this the nineteenth day of October in the year of our Lord One Thousand Eight Hundred and Fifty Eight.
