The State of Ohio, Muskingum County for Court of Common Pleas, November Term 1850 to wit November 15th, 1850
 

On motion to the Court by (Searle?  &  Levy?) Esquires, attorneys and a upon producing an authenticated copy of the last will and testament of Michael Kline, deceased, duly executed and performed according to the laws of the state of Indiana, and recorded in the county of Carroll in that state, and duly authenticated by the Clerk of the Probate Court of said county of Carroll; and appearing that, said, Will relates to real estate situate in the county of Muskingum: It is thereupon ordered by the Court that said last will and testament with the  probate and authentication be admitted to record in this court according to the statute in such case made and provided.
 

 Which said copy of said Will  reads in  the words and figures following


COPY OF WILL

In the name of God Amen.  I,  Michael Kline of the town of Delphi, County of Carroll, and State of Indiana being of sound mind and memory, but advanced in years, do make and declare this to be my last will and testament, as follows viz.
 

It is my Will. And I hereby order on death that my funeral expenses, and all my just debts be first paid.  It is my will that my beloved wife, Catherine, inherit all my estate real, personal and mixed, for and during her natural life, or so long as she shall remain my widow.  To sell or otherwise dispose of the same, as she may think best,  the paying at my demise, or as soon thereafter, as it conveniently can be done.  Out of my estate, to my beloved sons Jacob, John, Leonard, Michael, George and Daniel, or their heirs and to my beloved daughter Barbara intermarried to Jacob Shick, Eve intermarried to William Frash, Catherine intermarried to Jacob Sniff, or the heirs such sum as will make them all equal with the one against who shall stand the greatest charge in my books at my demise.  Beginning with the one against whom shall stand the most charge. And so on until they are all paid equal.  It is my will and I do hereby ordain, constitute and appoint my beloved wife Catherine to be my executor of this my last will and testament.
 

 In testimony whereof I have hereunto set my hand and seal this third day of March A. D. one thousand eight hundred and forty.

Personally appeared before me James Stewart, Clerk of the Probate Court of Carroll County.   William Dunkle and A. E. Tweed who being duly sworn solemnly swears that they saw Michael Kline sign, seal, publish and declare the above writing as his last will and testament.  That they believe he was at the time of its execution of sound mind and memory and that they signed their names thereto and witness in the person of said testament and at his request sworn to and subscribed to before me this the 14th day of June 1841.
