Lost Penland Cemetery


THE LOST PENLAND CEMETERY

In a series of law suits in Fleming Co., KY between 1851 and 1854, several witnesses named individuals that are buried in the Penland or Hurst Cemetery that is lost to genealogical researchers because one of the defendants allowed hogs to graze in the cemetery thus destroying any genealogical evidence that did exist in that cemetery.
The following is a list of witnesses and an extract of their depositions naming individuals that are buried in that ancient cemetery. Also is a list of other persons that took part, in some way, in the trials.

Robert Davis, Casper H. Severs, Wm. B. Evans and James B. Evans VS. Landon Hurst and James Hanlon (Att. Gen. of KY), 1 Sept. 1851.
Deposition of Robert Davis: States that his wife and child buried there along with several other relatives.
Deposition of William B. Evans: States that his mother and several other relatives buried in the cemetery.
Deposition of James B. Evans: States he is the brother of William B. Evans and has the same relatives buried in the graveyard.
Also named as being buried there, in a general statement at the beginning of the court record, were Alexander Penland, Mary Penland and William Penland.

Deposition of George Penland: States he is the brother of William Penland and is aged fifty-five years next Christmas. He also states the his brother-in-law Doneway's [Isaac] children were the first buried there. His father [Alexander] was buried there thirty-six years ago last February.
Deposition of Reason Plummer: States he is about age fifty-five and Isaac Doneway's child was the first to be buried there. Also, Wm. Penland's father and mother were buried there, as well as William Penland. Mr. Plummer also stated that his father and mother were buried there. His mother was buried there thirty-seven years ago and his father some time after that. He also stated that his brother Samuel was buried there, six or seven years ago. Also named by Mr. Plummer was Henry Severs, his wife, son Peter, and daughters Mahala and Hannah, Mrs. Martha Evans, mother of Wm. Evans, George Plummer, Wm. McGavic and his daughter Jane and at least one hundred persons, if not more.
Deposition of Benjamin Plummer: States these persons buried in the Penland Cemetery: Alex Penland, William Penland on 5 Oct. 1824, the Doneway children, wife of Davis, mother of Wm. and J. B. Evans, father, mother and child of Casper H. Severs and between fifty and a hundred people. Mr. Plummer also believed that the child of Jacob Cooper was buried there as well as ten or fifteen relatives of Hurst, including three wives and one child.
Deposition of Harrison Humphries: States that one of Isaac Dunaway's children was buried there in 1815.
Deposition of George Littleton: States he has a brother-in-law buried there and no other relatives.
Deposition of Zachus Evans: Named no one buried there.
Deposition of R. G. [Robert G.] Lewis: Named no one buried there.
Deposition of Millie Williams [Amelia (Dunaway) Penland Williams]: States her father, Alex Penland, [Actually her father-in-law] buried there. [She was the widow of William Penland].

Penland or Hurst Cemtery

(Penland or Hurst Cemetery)

The following names and dates were copied from stones in the Hurst Graveyard in Fleming County on 17 April 1971. This grave yard is located approximately 12 miles East of Flemingsburg and about 0.5 mi1es South of KY Rt. 32. Some of the older stones were hard to read. There are about a dozen graves marked with field stones bearing no names, dates, or information. Also, there are quite a number of graves with no visible markings.
