St Stephen In Brannel, Cornwall Wills


WILLIAM RICHARDS - 1843


This is the last Will and Testament of me William Richards of the parish of St Stephens in Branwell in the County of Cornwall Yeoman. I will and direct that all my just debts Testamentary and funeral charges be fully paid and satisfied as hereinafter named.

I give devise and bequeath unto and to my dear Wife Elizabeth RICHARDS and her assigns during her natural life an annuity or yearly rent charge of Eighteen pounds to be payable quarterly with a portionable part thereof up to the day of her death the first payment thereof to be made at the end of three calendar months from my death. And I charge the payment thereof on my Freehold in Polgooth and also on the residue of my estate and effects. Also I give unto my said Wife such part of my household furniture as she shall select to the value of Five pounds and I direct that the bequest to my said Wife shall be held by her during such time only as she shall remain my Widow.

I give devise and bequeath unto and to and to the use of my Sons Joseph Pearce Richards, Samuel Richards, John Richards and James Birch Richards their heirs and assigns forever. All that Freehold Messuage and Tenement called James�s Tenement situate at or near Polgooth in the parish of St Ewe in the said County in equal shares and proportions as Tenants in Common and not as joint Tenants and to the child and children of such of them as may be dead leaving issue such issue taking a parents share in equal shares and proportions as aforesaid. And I direct that in case of any or either of my said Sons shall be desirous of disposing of his Interest therein he or they shall give the option to his brothers of buying the same at such price as two indifferent persons or their umpire shall name one to be chosen by each party. All the residue and remainder of my Estate and effects Goods and chattels whatsoever and wheresoever I give devise and bequeath the same unto and among my said Sons Joseph, Samuel, John and James Birch and my Daughters Eliza, Susan and Caroline and the children of each of them as may be dead leaving lawful issue such Issue taking a parents share in the following proportions namely. Two shares of which to be taken by each of my said Sons and one only of such shares to be taken by each of my Daughters his or her executors administrators and assigns as Tenants in Common. And I direct that in case any or either of my said Sons or Daughters shall be desirous of disposing of his or her interest in such residue he she or they shall give the option to his or her brothers and sisters of buying the same such piece as two indifferent persons or their umpire shall name one to be chosen by each party. And I direct that it shall be lawful for the majority of my children to whom my Freehold is hereby given and the majority of my children to whom the residue of my effects are hereby given to sell and dispose of the same at Michaelmas one thousand eight hundred and forty four and not before subject to the payment of the said Annuity and to all my just Debts.

And I direct that in case my Sister in-law Mary Pinch shall not have sufficient effects to maintain her that all my children shall out of the property hereby given to them naturally contribute towards her maintenance during her life. And I nominate and appoint my said son Joseph Pearce Richards Executor of this my Will hereby revoking all former or other Wills by me at any time heretofore made do declare this to be my last Will and Testament.

In Witness whereof I have hereunto set my hand and seal the twenty sixth day of June in the year of our Lord one thousand eight hundred and forty three.

Signed sealed published and declared by the said Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses

Proved in common form the 31st day of October 1843 before Charles Grylls Clerk A B Surrogate And Admion of all and singular the Goods of the said deceased and any way concerning the said Will and Granted to Joseph Pearce RICHARDS Son of the said deceased and sole Executor named in the Will. Being first sworne etc.

This will was transcribed by Jessie Evans. She notes that William died aged 64 and is buried in St Dennis. The burial record states he was of St Stephens.
