Archibald Robinson & Others - Petition for Partition of Land

 

To Court - The Petition coming on to be heard - It is ordered by Court that the pray of the Petitioners be granted, and that Batte Irvin, Thomas L. Hutchison, Wm Gribble, Jas A. Todd & Addison Frazier be appointed Commissions to divide & Partiion the lands belonging to the Estate of the late Robert Robinson decd - in the County afore said adjoining the lands of David R. Henderson, Nancy McClure, Jas P. Henderson & Archibald Robinson, between his Heirs at law, the Peitioners aforesaid viz. A[ndrew]. Springs, Gudn. of Joseph Gillespie, Archibald Robinson, C. H. Robison in his own right and guardian of Dorcas E. Alexander, Cynthia Robison, & John Knox & wife, and put them in possession of the same and Report under their hands and seals to next Court -

To the Worshipful Court of Pleas & Quarter Sessions

 

The petitioners A. Springs, Guard. for Joseph Gillespie, Archibald Roberson, C. H. Roberson in his own right & as Guard of Dorcas E. Alexander, Cinttia Roberson, John Knox & his wife hereby slow to your worships that they are teneants in common of a tract of land descended to them from their _______ [?]

Robinson consisting of about two hundred & fifity acres known as the ROBINSON PLACE adjoining the lands of David R. Henderson, Nancy McClure, Jas P. Henderson & Archibald Roberson your Petitioners state that they are the only heirs at law of said Robinson & that the alnd can without detriment be divided among them, to wit one share to A. Springs as Guard for Joseph Gillespie, and to Archibald Roberson in his own right One to C. H. Roberson in his own right & another to said Roberson as guard of Dorcas E. Alexander. One to Cynthia Robinson and one to John Knox & wife in her right. Your petitioners would therefore pray your worships to [?] according to the act of ________ [?] in such case make & provide to lay off & make partitions of said land between paetitioners, as is duly bound your petitioners will ever pray -

Mecklenburg County } We the undersigned Commissioners Viz:

James H. [sic A]. Todd, Wm. Gribble, Addison Frazier, Batte Irwin being appointed by the Court to divide and make partition between and among ARCHIBALD ROBINSON, C[ARNES] H. ROBINSON, CYNTHIA ROBINSON, the HEIRS of ELIZABETH [ROBISON-GILLESPIE] ALEXANDER, decd., and the HEIRS[?*] of MARY KNOX, [all] HEIRS AT LAW of ROBERT ROBINSON, decd, where upon we have made and do the make the following appropriations, viz:

 

[1] The Lot No 1 is assigned to the heirs* of Elizabeth [Robison-Gillespie] Alexander...36 acres..value $250

[2] The Lot No 2 is assigned to C[arnes] H. Robinson...62 acres...value $298

[3] The Lot No 3 is assigned to Archibald Robinson...52 acres...value $258

[4] The Lot No 4 is assigned to Cynthia Robison...71 acres...value $202

[5] The Lot No 5 is assigned to the heirs** of Mary [Robison] Knox....98 acres..(.value not given, but must be $242)

 

The Lot No 2 [Carnes] pays to Lot No 4 [Cynthia] $48, the Lot No 3 [Archibald] pays to Lot No 5 [Mary Knox] $8 which sums make an equitable division all of which is respectfully submited under our hands and seals the 5th December 1844

PRB Notes:

 

1) *Elizabeth's heirs were: Joseph Robison Gillespie, son by Alexander Gillespie; Dorcas Elizabeth Alexander, daughter by Elias Alexander.

 

2) *"heirs of Elizabeth Alexander, decd' is clearly stated. However, Mary wasn't shown as decd, and is clearly alive in subsequent transactions. This appears to be a clerical error that was half corrected. See actual 5 Dec 1844 Land Division in Robert Robison's 1844 Loose Papers ...,decd is marked through in the on the first page of this document, but left on the back page.

 

3) Elizabeth (Robison-Gillespie) was the sister of Archibald Robison, Mary B. (Robison) Knox, Cynthia H. Robison, & Cairns Henderson Robison -- all children of Robert Robison II & Margaret Henderson ]

 

4) Robert Robison 1844 Loose Papers, boundary descriptions added of lots:

 

Lot No 1 is assigned to the heirs of Elizabeth [Robison-Gillespie] Alexander...36 acres...Boundaries include David Henderson's line and corner...

 

Lot No 2 is assigned to C[arnes] H. Robinson...62 acres...Boundaries include Jas. P. Henderson's corner and Jas P. Henderson's line...stake on the GREAT ROAD...with the G. ROAD...side of G. ROAD...

 

Lot No 3 is assigned to Archibald Robinson...52 acres...Boundaries include Henderson's line...with said A. Henderson's own line...Marquis [sic Marcus] Barnett's corner...with said Barnett's line...

 

Lot No 4 is assigned to Cynthia Robison...71 acres...Boundaries include...beginning Archd Robinson's corner...with his line...Marquis Barnett's line...McLures line...take in the G. ROAD, side of G. ROAD...

 

Lot No 5 is assigned to the heirs of Mary [Robison] Knox....98 acres...Boundaries include...beginning at Archibald Robinson's corner...with his line...side of the G. Road...C.
