I Henry Swiggett of Caroline County and State of Maryland, being weak in body but of a sound disposing mind memory and understanding and being desirous to settle my wordly affairs and thereby be better prepared to leave this world when it may please God to call me home, do therefore make and publish this my last will and testament in manner and from following, that is to say;

First I give and bequeath unto my wife Sarah Swiggett the use of my dwelling plantation whereon I now live with liberty of firewood and timber to repair said farm or buildings, during her natural life, with liberty also to sow one bushel of flax seed every year during her widowhood on any of (ye?) lands I hold, as and for her full dower in all my lands and premises. And also give and bequeath unto my wife of my personal estate, her lawfull dower and one mare called Blaze and one best featherbed and furniture and bedstead and two iron pots as and for her full dower in my personal estate.

Item, I give devise and bequeath unto my two sons William Swigett and Johnson Swigett all the lands that I hold that lies on the east side of the road that leads through the forrest, from the road leading from Marshahope Bridge to Potter's Landing, and through Levin Smith's plantation & that lyes contigious to and joining to said forrest road, and to be divided between them equally and the line that Joseph Foster (ran) for a division to remain for a division so far as it divides the said lands, and that part of the resurvey not divided by the said line to be equally divided between them, William's part to be laid off next (to) the forrest road afsd, to them the said William Swigett and Johnson Swigett theirs heirs and assigns forever.

Item, I give devise and bequeath unto my son Harmon Swigett all the lands I have called Chances Venture and Chances Lott and all the vacancy added unto said lands, except any part of said lands should lie over the afsd forrest road next to William Swigett's land, and if so then my will is that William Swigett shall have so much out of the vacancy added unto Harmon's lands as there may be of Harmon's on the east side said road and the rest of the said lands lying on the west side of said road to Harmon Swigett afsd, his heirs and assigns forever, which is all I intend for him of my real and personal estate and (en?) bar against all accounts he may render against my estate.

Item, I give devise and bequeath unto my two sons Henry Swigett and Levin Swigett part of a tract of land called Danby containing about two hundred and sixty acres of land, to be divided between them and the division to begin at the east line of said tract and to run a course agreeable unto and with two stakes I (struck) for to direct the division, and also the course of Levin's fence from the afsd east line across unto the branch, and the east end of said land unto my son Henry Swigett and the west end unto my son Levin Swigett, to them theirs heirs and assigns forever.

Item, I give devise and bequeath unto my son Daniel Swigett part of tract of land called Adams Rest, also a tract of land called Hollises Hunting Fields and all the lands that I hold or have any right unto that lies to the westward of the road that leads from the three bridges of Watses Creek down to Collines Crossroads, to him the said Daniel Swigett his heirs and assigns forever.

Item, I give devise and bequeath unto my son James Swigett my dwelling plantation whereon I now live after his mothers decease, with all the lands I have any right to lying between the afsd road leading down from the three bridges to Collinses Crossroads, and the lands formerly Jonathan Wilson's to him the said James Swigett his heirs and assigns forever.

Item, I give devise and bequeath unto my daughter Sarah Coldscott one half of the lands I purchased of Stephen Elston lying in Kent County State of Dilleware and the other half unto Ralph Collscott during his natural life and then to his son Eli, except the land called The New Warrented Land, I give and devise twenty acres thereof unto the afsd Sarah Collscott and Eli Collscott, son of Ralph afsd, and each of them to have that part they now live on, to them the said Sarah Collscott and Eli Collscott to them their heirs and assigns forever.

Item, I give devise and bequeath unto my son William Swigett the remainder of The New Warrented Land to him the said William Swigett his heirs and assigns forever.

Item, I give and bequeath all the residue of my estate after all my debts are paid and funeral expences satisfied and other expences relative to the execution of this my last will and testament to be equally divided between my four sons and my grand daughter Rhoda Swigett (daughter of Rhoda) that is; Henry Swigett, James Swigett, Daniel Swigett, Levin Swigett and Rhoda Swigett afsd, their heirs and assigns, and I do further direct that if need be that any part of the legacie left my grand daughter may be applied for raising and educating her during her minority.

I do hereby order and direct that no account be made of the provisions that is laid in for the familys use, and I do hereby order and direct that no administration be on my estate but do appoint James Anderson, Willis Charles, Edward Barton and Peter Harriss, or any two of them to settle and divide my estate, and determine and settle any dispute or controversy that may happen to rise, concerning any matter or thing in or relative to this my last will and testament, and whatsoever they shall determine and direct shall be binding and conclusive on all and every person or persons claiming any part of my estate by virture of this my last will and testament.

And Lastly I do hereby constitute and appoint my son Henry Swigett to be sole executrix (sic) of this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this twentythird day of the Ninth month Anno Dommini one thousand seven hundred and ninety eight.
