Probate Records of Hinmon Wharton, Sr., of Sussex County, Delaware


In the Name of God Amen, I Hinmon Whorton Sen'r of Sussex County on Delaware being in Health and of Sound mind and Memory, but Calling to mind the Mortality of my Body, Knowing that it is appointed for all men Once to dye, I therefore do make and ordain this my Last will and Testament in manner and words following~

Imp's~ my will and Desire is that my wife Mary Whorton have the use of one third part of all my Estate Royal and Personal Dureing of her Natural Life and at her Death her thirds of the moveable Estate to be Equally divided amongst all my Children, to beholden by them and their heirs & assigns for Ever.

Item~ I give and bequeath unto my Son David Whorton all my Lands in Ceeder Neeck, and the Land and plantation whereon he Now Liveth, to beholden by him, his heirs and assigns for Ever.

Item~ I give and Bequeath unto my son Watson Whorton the Land and Plantation whereon he now Liveth, together withh all my Right of Land in Mudy Neeck, to him, his heirs and Assigns for Ever.

Item~ my Will and Desire is that my Daughter Mary Barker have the use of twenty five pounds current money Dureing her Natural Life and at her death to be Divided amongst her Children, to them, their heirs and assigns for Ever.

Item~ I give and Bequeath unto my Daughter Elizabeth Smith, Cathrine Evans and Rhoda Aydelott the sum of Twenty five pounds current money, to them, their heirs and Assigns for Ever.

Item~ my Will and Desire is that all the Remainder and Residue of my Estate be Equally Devided amongst my Children hereafter Named, after the following manner (Viz) my Daughter Mary Barker's part a Dividend, to be beholden by her Dureing her Natural Life  and at her Death to be Divided amongst her Children, to them their heirs and assigns for Ever, and my Son David Whorton, Hinmon Whorton, Watson Whorton, Elizabeth Smith, Cathrine Evans and Rhoda Aydelott's part or Dividend to be beholden by them, their heirs and assigns for Ever.

I do Nominate and appoint my Son David Whorton, Hinmon Whorton, Watson Whorton, Elizabeth Smith, Cathrine Evans and Rhoda Aydelott my Whole and Sole Executors of this my Last Will and Testament, and I do Revoak and Disannull all former Will or Wills heretofore by me made and I do Acknowledge This to be my Last Will and Testament as Witness my Hand and Seal this the Nineteenth day of December Seventeen Hundred and Seventy five 1775.

Memorandum, the fourth day of May 1778 John Evans and Elizabeth Tunnell two of the witnesses to the within will subscribing, Appeared before me Phillips Kollock Register Appointed for the probate of wills & granting Letters of Administration for the County of Sussex on Delaware...

The Inventory of Hinmon Wharton's estate is badly mutilated, portions of the two page document are missing along the center of both pages. The following is some interesting information gleaned from it.
