Notes for JAMES KIRBY:

Humphry Kerby deed for 260 Acres , 15 March 1768 in the district of Chenawen, (district misspelled ) the north side of Lynches Creek on Bay Branch bounded south side George Brown's Land , all other sides is vacant lands.

With this there is a possibaly that Humphry Kerby is the father of James Kerby and George Brown is the Father of Margaret Brown.

some of this land was bought years latter by Frederick Ham. see page 50 in Ham book by Tania Ham.

13 Sep 1847 Frederick Ham purchased land from William J. Kaylor for $425 - 176 acres on both sides of Bay Branch being a part of a tract of land originally granted to Humphrey Kerby, 17 July 1768.

In the name of God Amen I George Kerby Snr being weak of Body but of sound mind thanks be to God for the blefsing calling to mind the uncertainty of this mortal life and the certainty of death I have thought best to make this my last will and Testament in manner and form as follows.

That is to say first of all I desire my body to be Buried in a christian like manner and will my soul to God that gave it I naext desire all my just debts to be paid and next I will and bequeath to my Beloved wife Mahala Kerby all my Lands except a piese of parcel Bounded by the Road Lake and Sparrow Swamp and Jefse Langston Land which I desire to be sold to pay my debts and for support of my said Beloved wife & her children I also Give to my said wife all my Horses cattle Hogs Sheep and potary together with all my Household and Kitchen Furniture plantation tools and I also will to each of my children as follows George John Benjamin Lavunsa Ester Ann Nancy Caroline Tenn dollars a piece to be raised out of my Estate - and I hereby revoke and anul all former wills by me made and declared this to be my last will and Testament and I do hereby in there presents constitute and appoint my said Loving wife Exectrix and Benj Lawrence Executor to this my last will and Testament. The declaration of Benjamin Kirby Sen, a resident of the town of Timmonsville, in the county of Darlington, in the Stat of South Carolina setting forth: I am married; my wife's name was Debora Pilkington, to whom I was married at in Marion County on the 22 day of February 1816.

I am the identical Benjamin Kerby Sen, who under the name served in the military service of the United States as a private in Captain W R Davis's company of the, thinks, (1st) regiment of South Carolina militia volunteers in the war of 1812. That I was drafted in the said service at Darlinton Ch, in the Stat of South Carolina on or about the 10th day of September, A.D. 1814, for the period of six months, and was honorably discharged at Haddvills Point, in the State of South Carolina on or about the 25th day of November, A.D1814 having continued in said service for more than sixty days. I further declare that I am not in receipt of a pension, nor have I made application for a pension, except that I draw land warrant on or about the years 1851 or 1852

On this 20"day of April 1887" Personally appeared before me Jon. W. Hutson Trial Justice in and for the said state and county, Mrs Debora Kerby age Eight one years and resident of Darlington county and stat of South Carolina who being sworn according to law, declares that she is the widow of Benjaman Kerby who served tho full period of one hundred and twenty days in the war of 1812 in the military service of the United States and who was the identical Benjaman Kirby who was drafted in captain W.R.Davids company and was honerably discharged at John's Island.

That her said husband was a pensioner at the time of his death under certificate 16.805 for which service a land warrant had been issued No. unknown that she was married under the name of Debora Pilkinton to the said Benjaman Kirby on th 23" day of February A.D. 1818" by James Myers a methodist minester at Willow Creek there being no legal barrier to such marriage that her said husband died at his home in Darlington County on the 24' day of May 1880 and that she has not married since his death, that at no time during the late rebellion against the authority of the United Stated did she or her said husband abuse to the cause of the services of the Govnment giving them did not comfort or exercised the function of any office whatever under any authority or for forted did anthing in hostilety to the United States that she will support the constitution of the United States, That she is not in reeipet of a pension under any previvious act. that she makes this declaration for the purpose of being placed on the pension rools of the United States that her Post Office is at Scrantmo County of Williamsberg and Stat of South Carolina .

Persenally appeared before me Daniel W. Ham wo upon oath says I am a carpenter in Wheelminght. that I live in Darlington Count a few miles from the Williamsbrg line. that in or about the 20" of May 1880 one Evauder Kirby came to my shop and told me he wanted me to make a coffin for his father - which after some inquing I procieded to do - after finishing the work. I (?) and assisted in putting Mr Evander Kirby's father (who was Benjamian Kerby) in the coffin and that myself and my brother went to the burying - I knew Benjamian Kirby since I can remember and still know his widow Debora Kirby who sometimes now, spends months in (?) neighborhod in visting her son.

Mr. and Mrs. William M. Kerby who were married 50 years Christmas Day, their children gave a tea in their honor, and over 200 friends and relatives called during the afternoo.

Mr. Kirby the son of the late John P. and Martha Allen Kirby, was born June 22, 1874, in Darlington County, and Mrs Kirby, the daughter of the late Simeon and Lanore Wilson Fields, was born August 27, 1875 also in Darlington County.

Soon after their marriage, the moved to Columbia and Mr. Kirby went into the grocery bursiness and at the present time he is owner and manager of Kirby's Food Store at 1516 Taylor Street.

Mr. and Mrs Kirby have 3 daughters, Mrs. Earl C. Smith, Miss Edna Kirby, and Miss Ruth Kirby; 4 sons, Charles, Watus, Clarence and William; 8 grandchildren and 1 great granddaughter. two sons Clarence and William, and two grandsons Earl Smith, Jr. and Weston Smith, are now serving in the Armed Forces overseas.

The Kirby family was very wealthy.  Benjamin Kirby, the father of Benjamin Kirby the father of Lucinda,
married  Deborah  Pinkington.  Her parents were wealthy  and appear to have owned Pinkington Glass Company,   it is still in business today.  Today the glass they make  for airplanes and buildings.  A  sugar bowl that belonged to Lucinda was made by Pinkington Glass Company.  

Unlike the Kirby family, the Scott family is not well documented.   In 1900  the L. V. Scotts were not in Florence, SC . They  were in  Columbia, SC . However, in 1920  they were in Florence, SC  in the 1920   living next door to Evert Scott.
He died before she did.  In the  1920 census they are both 70 years old. Lucinda was almost 100 when she died.
