This Indenture Made this Seventh day of September
In the Year of our Lord Christ One Thousand Seven Hundred and Thirty Eight
Between Edmund Franklin of Amelia County of the one Part and William
Clement Senior of the County Aforesd. of The other part Witneseth
that The Said Edmund Franklin for the Valluable Consideration of
five pounds Currant money of Virginia to him in Hand paid before the Ensealing
and Delivery of these presents Thee Receipt Whereof I Do Hereby Acknowledge
My Self to be fully Satisfied Contained and paid and by these presents
Have Given Granted Bargind Sold alienated Enffeoffed and Confirmed And
by these Presents Do fully Clearly and Absolutely Give grant Bargin Sell
Alienate Enffefeofe and Confirm unto the Said William
Clement his Heirs Executors Administrators or Assigns for Ever one
Certain Tract of percell of Land Containing fifty acres be the Same more
of Less according to the Bounds thereof it being part of a patent of a
greater Quantaty bearing Date Scituate Liing and being in Amelia County
and bounded as followeth To Wit Begining at a Spanish
Oak on Appomatox River thence Down the Said River to the Licking Gully
Branch Corner Beach thence up the Said Branch by a Line of Markt Trees
to Red Oak Corner thence Down the place Begun at To Have And to Hold the
above granted premises With all and Singular its Rights Members Jurisdictions
and Appurtenances together With all Houses Edifies Buildings Gradens or
Chards Lands Meadows Feedings pastures Woods and under Woods Water ways
profits and Commodities Whatsoever thereupon or thereunto belonging or
in any Wise Appurtaining unto the Said William
Clement His Heirs and Assigns for Ever and the Edmund Franklin Do
for Himself His Heirs and Assigns Covenant Grant and agree to and with
the Said William Clement His
Heirs and Assigns in Manner and form following Viz. That he the Said William
Clement His Heirs and Assigns May and Shall from time to time and
at all Times for Ever Hereafter Peacebly and Quietly Have Hold use Occupy
possess and Enjoy the above granted premises and every part and parcil
with Every of there Rights Members Jurisdicitions and Appurtenances and
Have receive and take the uses profits and Comodities to His or there
proper uses and behoofs for Ever without aney Lawfull Suit Trouble Denial
Eviction or Disturuance of Him the Said Edmund Franklin or his Heirs Executors
Administrators or any other person or persons Whatsoever by from or under
him them or aney of them or by His their or aney of their Means Acts privity
or procurement and the Said Edmund Franklin Do for him Self His Heirs
and Assigns further promess Grant and agree to and whith the Said William
Clement His Heirs and Assigns to Warrant and Defend the above granted
premises With Their and Every of Their Rights members Jurisdiction and
Appurtenances unto the Said William
Clement His Heirs and Assigns for Ever to be free and clear and freely
and clearly Acquited and Exonarated and Discharged of and from all manner
of former and other gifts Grants Bargains Sails Seals Thirds Dowries and
all other Incumbrances Whatsoever and Lastly The Said Edmund Franklin
Doth further Covenant promess and agree to And with the said William
Clement His Heirs and assigns to make Do perform And Accomplish or
cause to be made Done perform'd And Accomplished All and every other act
and acts thing and Things Device and Devises Whatsoever in the Law for
the Strenghting and Confirming the premises be it by Deed or Deeds or
by any other way or means which Shall by the Said William
Clement His Heirs and Assigns or by his of their Council Lerned in
the Law Be Reasonably Advised Devised or Required In Witness Whereof I
