This Indenture made this Ninth day of June one thousand seven hundred
and thirty eight Between Benja.
Clement of Amelia county of the one part and Lewis Thomas of King
William County of the other part Witnesseth that the said Benja.
Clement for the valluable consideration of Ten pounds Current money
of Virginia to him in hand paid before the Ensealling and delivery of
these presents the recept whereof I do freely acknowledg my self to be
fully satisfied Contented and paid by these presents have given Granted
Bargind Sold Alinated Enfeofed and Confirmed and by these presents fully
Clearly and absolutely Give Grant Bargain Sell Alineate Enfeoffee and
Confirm unto the Said Lewis Thomas his Heirs Executors Administrators
or assigns for ever one Certain parcel of Land Containing One hundred
and fifty acres more or less according to bounds of it Being part of a
patent of a greater quantity bearing date Situate lying and being in Amelia
County and bounded as followeth to witt Begining at a Pine and white oak
on James Seay line Thence across the said land by a line of marke trees
to John Hurts line to a pine at the new Road Thence along the Said John
Hurts and James Hurtt line to a Corner white Oak Thence along Abraham
Hurts line to a faced corner Thence to Jacob Seays Corner Thence to the
begining To have and to hold the above granted premises with all and Singular
its rights Members Jurisdictions and appertances to geather with all Houses
Edifies Buildings Gardens Orchards lands and Meadow feedings Pastures
Woods and under Woods Waters Ways profits and Commodities whatsoever thereunto
belonging or in any wise appertaining unto the said Lewis Thomas his Heirs
and assigns for ever and the Said Benja.
Clement doth for him his heirs assigns Covenant Grant and agree to
and with the Said Lewis Thomas his Heirs and assigns in manner and form
following Viz. That he the Said Lewis Thomas his Heirs and assigns may
and shall from time and at all times forever hereafter peacably and quietly
have hold use Occupy posses and Injoy the above granted premises and every
part and partill with every of their rights Members Jurisdictions and
appurtenances and have receive and take the use &es profits and Commodities
to his or their proper uses and behoofs for ever without any Lawfull Suit
Trouble Denial Evictions or Disturbances of him the Said Benja.
Clement or his heirs Executors Administrators or of any other person
or persons whatsoever by from or under him them or any of them or by his
or thier or any of their means act privilly procurements and the said
Benja. Clements do for himself
and assigns further promiss grant and agree to and with the Said Lewis
Thomas his Heirs and assigns to Warrant and Defend the above graned premises
with their and every of their Rights Members Jursiction and appertenance
unto the said Lewis Thomas his Heirs and assigns forever to be free and
clear and freely aquited Exonerated and discharged of and all maner of
Forms and other Gifts Grants Bargins Sails Seals Thirds Dowries and all
other Incumbrances whatsoever and lastly the said Benja.
Clement doth further Covenant promis and agree to and with the said
Lewis Thomas his heirs ans assigns to Make do perform and accomplish or
cause to be made done and perform.d & accomplished all and every other
Act and Acts thing and things Devises and Devises whatsoever in the Law
for the Strengthing and Confirming the primeses be it by Deed or Deeds
or by any other Law or mens which Shall by the Said Lewis Thomas his heirs
or assnigs or by his or their Councill Learned in the Law be reasonable
advised Desired or Required as Witness whereof I have hereunto Set my
hand and Seal the day and Year above writen.

Memorandum
That Quiet and peacable possession wass Granted to the within Mentioned
Land premises to Lewis Thomas by the other covenanter to these presents.
In the presents of us
At a Court held for Amelia County June the 9th 1738 Benja.
Clement Acknowledged this his Deed and livery of Seisen unto Lewis
Thomas which is admitted to Record and Susanna
the Wife of the Said Benjamin
being first privately Examined and Voluntary assenting thereto Relinquished
her Right of Dower in the Land conveyed by the Said deed.
