This is the last Will and Testament of me Richard Mountney late of Newton
Grange Farm but now of Clifton near Ashbourne in the County of Derby.
Gentleman
made and published as follows. I hereby revoke all former and
other Wills by me at anytime heretofore made and declare this to be my last
Will. I nominate and appoint my friends Samuel Saint of the Dairy House Farm
Alkrnanton near Brailsford. Edward Saint of Roylston Farmer and my son in
law Frederick Robinson now of the said Newton Grange Farm all in the said
County of Derby
Trustees and Executors of this my Will.
I give and bequeath all and singular my personal estate consisting of live
and dead Farming stock, ready money, money at my bankers, Household goods
and furniture of every description, Bills, Bonds, Notes and all and every
security and securities for money and all and every accumulations of
interest that may henceforth become due and payable under and by virtue of
such securities unto them the said Samuel Saint, Edward Saint and Frederick
Robinson
and the survivors and survivor of them and the executors and
administrators of such survivor (hereinafter called the Trustees or Trustee
of this my Will) upon the following Trusts (That is to say) Upon Trust in
the first place and as soon as conveniently may be after my decease to
utilize (if need be) by the sale and conversion of such part of my said
personal estate ans may not consist of ready money the full sum of Five
hundred pounds and when they shall have so realized or possessed themselves
of such last mentioned sum of money then and immediately thereupon I hereby
direct and empower them my said trustees or trustee for the time being of
this my Will to invest the said sum of Five hundred pounds in their or his
names or name in any of the Parliamentary Stocks or Public Funds of Great
Britain or at interest upon Government or real security in England or Wales
or in or upon the Shares Stocks or Securities of any Company incorporated by
Act of Parliament and paying a Dividend with power for the said trustees or
trustee to vary the said stocks funds shares and securities at their
discretion yet so that during the life of my daughter Mary the Wife of the
said Frederick Robinson
every such sale or variation shall be made with her
consent in writing first had and obtained and not otherwise. And I further
direct and authorize them my said trustees and trustee for the time being of
this my Will to pay the whole of the nett annual income from the investment
of the said sum of Five hundred pounds Trust fund as aforesaid into the only
proper hands of my said Daughter Mary Robinson during her life and whether
she be covert or sole and whose receipt alone notwithstanding her present or
any future correctives I hereby direct shall at all times be a sufficient
discharge to my said trustees or trustee for such last mentioned annual
income. And from and after the decease of my said Daughter Mary Robinson
Then I further direct and empower them my said trustees or trustee for the
time being of this my Will to hold the said trust fund of Five hundred
pounds and all accumulations thence arising in Trust for all the children or
any child of my said daughter Mary Robinson now or hereafter to be born
living at the time of her decease and who may live to attain the age of
twenty one years. If more than one in equal shares and if only one shall
live to attain that age then to such one. But in case there shall be more
that one such child living to attain twenty one years of age Then I direct
that the share and interest of each and every such child and children in the
said principal sum of Five hundred pounds and the accumulations thereof
shall become vested and payable to him, her or them immediately on their
respectively attaining their majority and that such several or respective
and separate payments shall not be deferred until the youngest of such
children attain twenty one. And as to for and concerning the residue of such
my personal estate. I hereby authorise and empower them my said trustees or
trustee for the time being of this my Will to stand possessed thereof in
trust for my said Daughter Mary Robinson for her own sole and separate use
and disposal absolutely subject nevertheless to the payment of all my just
debts funeral and testamentary   expenses and the expenses of proving this
my Will. But freed and discharged from the control and also of from and
against all marital control or the debts liabilities and engagements of her
present or any future Husband with whom she may hereafter intermarry. I give
devise and bequeath the whole of my Real Estate consisting Firstly of
Freehold land with the Public House and outbuildings thereon erected situate
and being in the township of Roston in the said County of Derby and now in
the tenure or occupation of
Thomas Walker and known by the name of "The
Roston Inn" and Secondly of a certain other freehold property consisting of
thirteen acres of land or thereabouts and the Dwelling house thereon erected
situate and being in Swinscoe in the parish of Blore in the County of
Stafford and now in the tenure or occupation of
Isaac Beresford unto my said
daughter Mary Robinson
to hold the same. Unto her my said daughter her heirs
and assigns absolutely subject nevertheless to and chargeable firstly with
the payment of the sum of Fifteen shillings weekly and every week out of the
rents issues and profits arising therefrom to my Daughter Elizabeth, now the
wife of Ralph Adams
for and during the term of her natural life and from and
after the decease then subject to the payment of the like sum of Fifteen
shillings weekly and every week for the benefit maintenance and education of
the child or children of her the said Elizabeth Adams until the youngest of
them if more than one shall attain the age of twenty one years, such weekly
payments to be made by my said trustees or trustee into the proper hands
Only of my said Daughter Elizabeth Adams with power for them to apply the
same monies in such manner as they in their absolute discretion shall deem
most advisable for her exclusive benefit and advantage during her lifetime
and afterwards for her children or child during their minorities or minority
and whose receipt or receipts alone for such weekly payments notwithstanding
her present or any future coverture I hereby direct shall be a good and
sufficient discharge and discharges for the same and that such weekly income
shall not at any time be subject or liable in any manner to sale or mortgage
by her my said daughter by way of anticipation or to the interference
control debts liabilities or engagements of her present or any future
husband. And when and as soon as the youngest of the children or child if
only one of my said Daughter Elizabeth Adams shall have attained the age of
twenty one years There further subject And I hereby charge the whole of my
said real Estate with the payment of the sum of One thousand pounds unto and
amongst the children of my said Daughter Elizabeth Adams who shall live to
attain the age of twenty one years in equal shares and proportions if one or
more than one but if only one then such one. And I hereby declare that all
and every the share and interest of each and every Grand daughter of mine
shall only be paid into the proper hands of such granddaughter or
granddaughters and that her and their receipt and receipts shall alone be a
sufficient discharge or discharges for all monies to which she or they may
respectively become entitled and that the same shall not in any manner
become subject to the control or liable to the debts engagements or
liabilities of any husband or husbands with whom she or they may happen to
marry. And lastly I declare that the powers and provisions for the
appointment and for the indemnity and reimbursement of trustees which are
contained in the statutes passed in the twenty second and twenty third and
the twenty third and twenty fourth years of the reign on her present Majesty
shall be taken and read as part of this my Will in the same manner as if the
same had been fully set out herein
In Witness whereof |I the said Richard Mountney have to this my last Will
and testament contained on this and three preceding sheets of paper set my
hand this fifth day of October One thousand eight hundred and

present at the same time and who in his presence at his request and in the
presence of each other have herewith set and subscribed our names as
witnesses.

Proved at Derby the 22nd day of February 1871 by the oaths of Edward Saint
and Frederick Robinson two of the Executors to whom administration was
granted. Samuel saint the other executor and one of the universal Legatees
in Trust named in the Will having renounced the probate and Execution
thereof.
The Testator Richard Mountney was late of Clifton near Ashbourne in the
County of Derby Gentleman and died on the 4th day of February 1871 at Newton
Grange near Ashbourne aforesaid
