The Will of Richard Mountney proved 1880

This is the last Will and Testament of me Richard Mountney, Butcher and
Farmer of Elton in the County of Derby.
In the name of God. Amen.
I direct that all my just debts and funeral and testamentary expenses be
paid and satisfied out of my real and personal property by my Executors
hereinafter named as soon as conveniently may be after my decease.
I give devise and bequeath the rest residues and remainder of my estate and
effects whatsoever and wheresoever both real and personal whether in
possession reversion remainder or expectancy unto my dear wife Esther
Mountney, now residing with me at Elton in Derbyshire
during the term of her
natural life absolutely, and from and after her decease I give devise and
bequeath the same and every part thereof unto and among and to be equally
divided between all and every my children both Sons and Daughters, who shall
be living at the time of the decease of my said wife and the issue of such
of them as shall be dead, such issue nevertheless taking only the share
which their deceased parent would have been entitled to in the event of such
parent surviving my aforesaid wife viz.
To my Son John Dale Mountney to have one equal part or share thereof for his
own use and benefit absolutely. To my Son Richard Dale Mountney to have one
other equal part or share thereof for his own use and benefit absolutely. To
my Daughter Sarah Walker to have one other equal part or share thereof for
her own use and benefit absolutely. To my Son Large Mountney to have one
other equal part or share thereof for his own use and benefit absolutely. To
my Son William Mountney to have one other equal part or share thereof for
his own use and benefit absolutely. To my Daughter Catherine Mountney to
have one other equal part or share thereof for her own use and benefit
absolutely. To my Daughter Hannah Nuttall to have one other equal part or
share thereof for her own use and benefit absolutely. To my Son George Dale
Mountney
to have one other equal part or share thereof for his own use and
benefit absolutely. To my Daughter Emily Mountney to have the other
remaining equal part or share thereof for her own use and benefit
absolutely.
But should it happen that any of my aforesaid children either Sons or
Daughters should remain single then I direct that one of my cottage houses
in Elton
be left undivided for his or her use so long as he or she remains
single. Then after he or she is married or deceased the aforesaid house
shall be equally divided amongst my surviving children as before directed.
And I nominate constitute and appoint my sons John Dale Mountney and William
Mountney to be the Executors
of this my Will and hereby revoke all former or
other Wills and Testaments by me at any time heretofore made. I declare this
to be my last Will and Testament. In Witness whereof I the said Richard
Mountney
have to this my last Will and Testament, set my hand the twenty
fourth day of January One thousand eight hundred and seventy (1870)

Signed by the said Testator Richard Mountney an acknowledged by him to be
his last Will and Testament in the presence of us present at the same time
and inscribed by us in the presence of the said Testator and of each other.

Codicil. This is a Codicil to my last Will and Testament bearing date the
24th. January 1870, and which I direct to be taken as part thereof.
I give devise and bequeath my dwelling house and Premises situated in the
Main Street Elton
, now occupied by myself and also my household furniture
linen and everything in the said house and premises unto my two daughters
Catherine Mountney and Emily Mountney now residing with me at Elton in the
County of Derby
for their lifetime then at their decease to be equally
divided among my other surviving children or their descendants. As witness
my hand this ninth day of September One thousand eight hundred and seventy
nine (1879)

Proved at derby with a Codicil the 9th day of July 1880 by the Oaths of John
Dale Mountney and William Mountney the Sons the Executors
named in the Will
to whom Administration was granted
The Testator Richard Mountney was late of Elton in the Parish of Youlgreave
in the County of Derby. Butcher and Farmer and died on the 31st. Day of May
1880 at Elton aforesaid
