The State of Alabama }
Elmore County        }  Probate Court of said County To The Hon Wm E. Dennis 
Judge of said Court, your Petitioner, Robt J. Pool, Administrator of the
Estate of William Curlee Deceased, respectfully represent that
about ten months hace elapsed since he was appointed by this
Court to said Administration, and that from the and character
of the claims already presented to him, and from his intimate
knowledge of the indebtedness of the Estate he is satisfied that said
Estate is entirely solvent. Your Petitioner further represents
that the heirs of said decedent are as follows to wit;
Catherine Pool, now the wife of your Petitioner, Jackson Curlee,
Pinkney Curlee, William T. Curlee - all of whom are of full age
and all living in Elmore County, Alabama, A Catharine Cardin,
wife of William Cardin, and Sicily Howard, both of full age, and
also Mary Jane Rast, also of full age; the three last named persons
being daughters of Floyd Curlee, who was the son and lawful heir
of decedent, all the aforesaid named persons being residents of the aforesaid
State and County, except Mary Jane Rast, who resides in Falls County
Texas, and her husband is Marcus Rast, residing at same place,
and also Franklin Curlee, a resident of the County of Coosa, and
state aforesaid, and of full age, and Randolph Curlee, of full age
and living in Jackson Parish in the State of Louisiana, also
William James Curlee, Julia Curlee, and Washington Curlee
all of full age, children of Washington Curlee who was the son
and lawful heir of the deceased, and all residents of Coosa
County, Alabama. Your Petitioner further states that the lands
of said Estate consists as follows; SE 1/4 of Sec 12, T20. R18, South 1/2 of
SE 1/4 of Sec 1, T20, R18, SW 1/4 of Sec 6, T20 R19 except 40 acres across the
East end - NW 1/4 of SE 1/4 of Sec 18, T20 R19, NE 1/2 of NW 1/4 of Sec 14, T20 R19,
N 1/2 of Sec 7, T20 R19 - all lying in Elmore County, Alabama, which
parcels of lands are of unequal values and are so situated, and are
of such dimensions, respectively that they cannot be equitably
divided among said heirs aforesaid; your Petitioner there=
fore states that he believes that the interests of all persons
concerned in said lands, will be best promoted by a sale
thereof, and a distribution of the proceeds among said
heirs, according to their several rights; Wherefore your
Petitioner prays your Honor, to authorize him to sell said lands for
Cash, for the purpose of making a division of said Estate among said
heirs aforesaid, according to the statute in such cases made, and that
such proceeding, orders and decrees may be had and made in
the premises, as may be sufficient to effect such sale, for said
purpose according to law. And as in duty found &

to wit; Mrs Curlee relict and surviving widow of William Curlee, late 
of said County deceased, begs leave respectfully to set forth and show to 
your Honor, that on the 24th day of November AD 1869 the said William Cur 
lee departed this life at his residence in said county and that he was 
lawfully seized, possessed in fee of certain Real Estate, consisting in 
part of certain lands, and at the time of his death, known and distinq 
uished by the Numbers, and futher that said William Curlee died intes- 
tate, and that the applicant to wit; Amy Curlee widow as above, has not 
signed away nor relinquished any legal right of dower interest in said land, 
And now, that justice may be done to all the heirs at law to said Estate, I pray
your Honor to proceed as the law directs to cause Eighty (80) acres of my dow- 
er interest set off to me by meets and bounds & according to law, I hereby re- 
linquish my claim to all the balance of said land.

of Twelve and Five oclock in the afternoon in pursuance of 
law in such cases made, and in strict compliance with all 
the terms, conditions and requirements of the former order 
and decree of this Court, which was the decree of sale
granted and entered in the premises on the 20th day of 
November 1869, be proceeded and sold at public out cry on 
the premises of said William Curlee deceased; the land set 
forth and particularly described in said former order and

of said lands; Further that the said Calvin Humphries Wm P. 
Curlee, Mrs Amy Curlee, and Robt Pool have complied with the 
terms of said Sale and purchase, by the payment of cash in 
full for all their proportional parts: In consideration of the 
above stated, and which the undersigned is ready to prove at such 
time, and in such form, and manner as may be required by your

The Petition of R J. Pool respectfully shows unto your Honor, that more 
than Eighteen months have elapsed since he was appointed and 
qualified in this Court as Administrator of the Estate of William 
Curlee Deceased, during all of which time heas diligently, and 
to the best of his abilities administered in and upon the affairs of said 
Estate - Your Petitioner further states that within one month after 
said letters were granted to him, he gave notice of his said appoint- 
ment by publication there of for Six successive weeks in the Ala- 
bama State Journal, a Newspaper published in the City of Mont- 
gomery, Ala (It being the Official paper for Elmore County) and it 
being the paper published nearest to the Court House of this County, 
there being no paper published in this County, a copy of which said 
notice, as published, is herewith Exhibited and filed together with 
the affidavit of the publisher of said paper showing when said 
publication was first made, and the length of time it was contin= 
ued; Your Petitioner further shows unto your Honor, that in his opinion 
Said Estate no longer requires the continuance of an Administra 
tion, wherefore, he now herewith files his accounts for a final Settle- 
ment thereof, Showing all the amounts with which he is firstly charge- 
able, and the payments which he is entitled to have allowed to him 
together with his vouchers, each duly numbered and all other 
written evidences which he has, in support of said account, 
Your Petitioner also, further states that there is nothing left to 
divide between the heirs of said Estate as is Evidenced by his 
former Statement and present accounts presented for such 
final Settlement; Your Petitioner further states, that he has 
not at any time during his said Administration, (Except as 
accounted for at his last annual Settlement made with this 
Court - dates therein stated.) used any of the funds belonging to 
said Estate; Your Petitioner, therefore, prays your Honor that 
a day may be set for making such final Settlement; that 
notice of the same may be given and published as is required 
by law, and that said Schedules and said accounts, vouch= 
ers &c have been duly credited, Examined and Considered. 
Your Honor will be pleased to pass and allow said accounts 
in such form as may then appear just and right.

                The undersigned 
R J Pool your petitioner by appointment 
of this Court administration of said 
estate would respectfully do present 
that there are debts due from said 
estate to the undersigned amounting 
to two hundred & twenty six 94/100 
Dollars, Ninety six 94/100 dollars of 
which was due on the 24 Feby 1871 
as will appear by the Annual 
Settlement made by the undersigned in the Court as Admd. of Said 
estate and the interest thereon 
since that time is Ninety 19/100 dollars 
also the sum of twenty one 85/100 dollars 
due petitioner for Costs paid in 
the Circuit Court with interest thereon 
amounting to Eighty five 25/100 Dollars 
all of said _______ with interest amounting

Petitioner, There is no personal 
property or Money belonging to 
said estate with which to pay 
the said debts due from said 
estate, But there is belongings to

      Arkansas, The three last named 
      being daughters of Floyd Curlee 
      dec'd who was the son of Wm Curlee

6d    Charlie Curlee, Laura Horn wife Elijah 
      Horn, Susan Curlee, Sarah Curlee 
      Vinie Curlee, James Curlee, all 
      reside in Talladega County in this 
      State and was 21 Years old all reside 
      _____ Talladega County, all children 
      of Pickney Curlee dec'd who was a 
      son of dec'd Wm Curlee decd 
7     Franklin Curlee resides in Texas 
      a son of intestate over 21 years old 
8     Randolph Curlee also resides in Texas 
      & a son of intestate over 21 years old 
9     William James Curlee who was a son of 
      Washington Curlee who was a son of 
      intestate of full age resides in this 
      County. 
10    Union Curlee, Wesley Curlee, Cyrus 
      Curlee Calvin Curlee all over 
      21 years of age and are sons 
      of Union Curlee who was a 
      son of the intestate all reside in the 
      state of Texas       Petitioner prays 
      that Citations issue to notify all 
      who are of _____ age & reside ___ another state
      of the above named heirs of the nature 
      of this petition & of the day set for the 
      hearing, and that the now resident 
      heirs who are of full age be notified 
      by publication as the law directs 
      and that such other precedings
