N: 154 } This Indenture made this 2d of January Saml T Stewart & others } one thousand Eight hundred and thirty To} Deed } two between the heirs of Alexandria & Sarah Richd Sammons } Stewart Deceased to wit, Samuel T Stewart William Stewart, James B Stewart and Evan A Hall all of the State of Tennessee Said Samuel T Stewart of the County of Weakley, William Stewart and James B. Stewart of the County of Rutherford, and Evan A Hall of the County of Hickman and State of Kentucky all of the one part and Richard Sammons of the Same State and County of Rutherford of the other part Witnesseth that Said Samuel T Stewart, William Stewart, James B Stewart and Evan A Hall for and in Consideration of the Sum of Two Hundred dollars to said heirs in hand paid by Said Richard Sammons the receipt whereof is hereby acknowledged hath given, granted, bargained Sold and Conveyed and Confirmed unto the Said Richard Sammons and his heirs a Certain tract or parcel of land being in Rutherford County on the head waters of Overalls Creek a branch of Stones river, Beginning on a cedar, running East forty Eight poles to a dogwood and ash stump, thence North fifty two poles to a dogwood stump, thence East forty five poles to a stake, thence north one poles hundred & six poles to a stake, thence West forty five poles to a buckeye & locust, thence North fifty one poles to a cedar and Ironwood, thence West forty eight poles to a post oak, thence South two hundred and nine poles to the Beginning, And by Survey Ninety two and one half Acres be the same more or less, And the said heirs Samuel T Stewart, William Stewart, James B. Stewart and Evan A Hall doth Covenant and agree with the said Richard Sammons and his heirs, the said heirs Samuel T Stewart, William Stewart James B. Stewart and Evan A Hall and their heirs Executors, admin- -istrators and assigns will warrant and forever defend the above mentioned tract or parcel of land with its appurtenances and singular hereditaments to the same belonging or in any wise appurtaining from themselves and heirs and from any other person or persons whatever unto the Said Richard Sammons and his heirs Executors, administrators and assigns forever, In Witness whereof the Said heirs Samuel T Stewart, William Stewart, James B. Stewart and Evan A Hall hath hereunto Set their hands and seals this day and date first written, Signed & acknowledged in presence of, Wayne W Murphey, his Travis Windrow, Samuel X T. Stewart {Seal} mark his Wm X Stewart {Seal} mark his James X B Stewart {Seal} mark his Evan A Hall {Seal} State of Tennessee } Rutherford County } Personally appeared before me John Woods Clerk of the County Court of said County Travis Windrow a subscribing witness to the foregoing deed who being first sworn depose and say that he was acquainted with the above named Samuel T Stewart, W. Stewart, James B Stewart and Evan A Hall the bargainors and they acknowledged the same in his presence to be their act and deed upon the day it bears date, Witness my hand at office this 24th day of July 1854 - John Woods Clk State of Tennessee } Rutherford County } Personally appeared before me John Woods Clerk of the County Court of said County James E Webb & Roger Snell to prove the hand writing of Wayne W Murphey one of the subscribing witnesses to the foregoing annexed deed who being first sworn depose and say that they were well acquainted with the said Wayne W Murphey in his life and with his hand writing and that he is now dead and that they believe the above Signature purporting to be his, be his own proper handwriting and genuine Signature, Witness my hand at office this 11th day of April 1850 - John Woods Clk Registered Octr 18th 1854.
