Thomas Anderson produced in Court the receipt of the sheriff of this
county for the sum of twelve dollars and fifty cents the tax imposed by
law on physicians & surgeons & thereupon on his action, he is hereby
licensed to practice medicine & surgery according to the act of
assembly in that case made and possible.

An indenture from William Morris and Sally B. his wife to John C.
Barnitt was acknowledged by the said William Morris to be his act and
deed and ordered to be recorded.

Pursuant to an act of the General Assembly in that case made & provided
the court proceeded to the appointment of Constables within the said
county & thereupon George Robertson, Hezekiah Smithson, Josias W.
Harrison, Richard Parrish & George A. Shelton were appointed in the 2nd
Battalion of the 42nd Regiment of militia. William Ingram, Allin
Woodson, John Sutherlin, Thomas James & Orlando Smith in the first
Battalion of the said Regiment, Richard G. Keatts, William Myers,
Francis Chumbley & Coleman Glenn in the first battalion of the 101st
Regiment & Pleasant Phears, Samuel A. Moore & Samuel M. Terrell in the
2nd Battalion of the 101st Regiment-Whereupon the said George Robertson
with William Beavers & Nathaniel Wilson his securities-Richard Parish
with Thomas Barnittt & Leroy Shelton his securities-William Ingram with
Thomas Woody & William Stone his securities-Allin Woodson with
Champress Terry & Doctor C. Williams his securities-John Sutherlin Jr.
with Michael Mitchell & Evan Shaw his securities-Orlando Smith with
Jesse Smith & Daniel Motley his securities-Francis Chumbley with
Benjamin Gosney & Michael Mitchell his securities-Coleman Glenn with
Nathan Glenn & Daniel Neal his securities-Samuel A. Moore with William
Tunstall & John Chatton, Jr. his securities-George A. Shelton with
Ellis Wilson, George Adams & James Astin his securities & Thomas James
with Josiah Rice & William Echols his securities-severally outlined
unto & acknowledged their honor in the penalty conditioned as the law
directs in the penalty of five hundred dollars and also took the sworn
oaths prescribed by law-as also the oath to support the Constitution of
the United States.

John Conner who was ordered to be summoned to appear here at this court
to show cause why certain free children of color bound to him by the
overseer of the poor should not be removed from their apprenticeship,
having departed this Commonwealth sinse the said order was made It is
ordered that they be removed from their said apprenticeship and that
the overseer of the poor of this county do bind out Boling Barnitt one
of the said children to Edward Inge and the other to John May according
to law.

Guardian of Fanny Jefferson Sutherlin and James Madison Sutherlin
orphans of James Sutherlin decd be summoned to appear before the next
court to show cause, if any he can, why he should not be removed from
his said guardianship for improper treatment to his said wards.

that special bail was approved in this cause at the last court and a
motion made to set aside the Office Judgement, But instead of making
the .in this cause, there mistake, it was made in a suit of Allin Gray
against Jeremiah Burnitt and Thomas Burnitt-Therefore it is ordered
that the Executive of the Judgement in this cause and the forthcoming
bond taken by virtue thereof be quashed and that the cause be...

John Sutherlin came into court and produced a commission appointing him
Ensign of a company in the forty second regiment Seventh brigade and
first division of the militia and took the several and respective oaths
prescribed by law as also the oath to support the Constitution of the
United States.

John Barnitt who sues for the benefit of John Sutherlin, Jr. against
William Townes
This day came the plaintiffs by his attorney as also the defendant in
his proper person who acknowledges the plaintiffs motion against him to
be just: Therefore it is considered by the court that the plaintiff
recover against the said defendant the sum of fifteen pounds ten
shillings with Interest thereon at six per cent per annum from the
first day of April 1812 until payment of the debt in the declaration
mentioned-together with his costs by him about his suit in this..28th
day of March 1812.

payment of a Debt due to Adam Sutherlin was proved by the oaths of two
witnesses thereunto subscribed to be the act and deed of the said

Robert Dalton & Co assignee of John Anderson, Jr. vs Francis Gallaway -
--Debt
This day came the parties by their attorneys and the defendant's
attorney relinquishing his former plea staiteth he is not further
informed what to say in defense of this cause. Whereby the plaintiffs
action against the said defendant to remain undefended. Therefore it is
considered by the court that the plaintiffs recover against the sd
defendant the sum of 18 pounds the Debt in the declaration
unconditioned together with their costs by them about their suits in
this behalf. ..1st day of Aug 1812 until payment and the costs.

benefits of Robert Colquhoun adm. Of James Colquhoun deced vs Frances
Burnitt Ex. of Thomas Burnitt decd. Frances Burnitt was ordered to pay
42.50 on the 17th day of Dec 1805.

John Barnitt vs Alin Gray
On motion of the defendant by his attorney It is ordered that the
judgement and writ of Enquiry awarded against the plaintiff in this
cause for want of appearance be set aside and the sd defendant have
liberty to plead and thereupon he by his attorney pleaded not guilty,
to which plea the plaintiff by his attorney replyed generally Whereupon
came a Jury to wit: Alexander Murray, Pleasant Waller, Green Adams,
John Smothers, Lewis Rose, Burgis Riddle, Adams Sutherlin, Charles
Carter, George Briscoe, Philip Harper, Laban Grisham, & Francis Clark
who being elected tried & sworn the truth to speak upon issue joined
upon their oath do say the defendant is guilty in manner & form as the
plaintiff against him hath complained and they do assess the plaintiff
damage by occasion thereof four dollars.

James Sutherlin vs Thomas Sutherlin & Adam Sutherlin -In Chaucery
By consent It is ordered that this suit be revised against the
defendants in the name of Peyton Lumpkin admn of the plaintiff who hath
departed this life. And there from on motion of the sd Peyton Lumpkin
admin. Aforesaid an Injunction is granted him to stay all further
proceedings at common law on a Judgement obtained by the Executors of
George Sutherlin decd against the Executors of James Sutherlin decd
until the matter in equity arising therein can be heard.

William Richardson vs John Dismark & Achilles Whitlock-upon an
Injunction in Chancery.
The defendants by their counsil moves the court for a dismissal of this
injunction But the court refused to hear the said motion whereupon it
is ordered that the same be certified.

Wm Dodson came into court and produced a commission appointing him
Capt. Of a company in the 42nd Regiment 21st Brigade & 1st Division of the
militia & took the oath prescribed by law & the oath to support the
Constitution of the United States.

Thomas Sutherlin is appointed a Constable in the first Battalion of the
42nd Regiment of militia in the room of John Sutherlin who has been
called into the military service of the United States whereupon the
said Thomas Sutherlin came into court and took the usual oaths
prescribed by law and the oath to support the constitution of the
United States and with Thomas Shelton and Soloman Debow his security
acknowledged their bond in the penalty of $500 conditioned as the law
directs.

relinquished her dower right to land sold to John Mays.

Thomas Sutherlin one of the Constables of this county came into court &
resigned his said office and thereupon George Sutherlin, Jr. is
appointed Constable in his room, who came into court & took the oaths
prescribed by law & the oath to support the Constitution of the United
States and with Thomas Sutherlin and George Sutherlin his securities
entered into and acknowledged their bonds in the security of five
hundred dollars conditioned as the law directs.

decd, Thomas H. Clack, John Waller & E. White and Lydia his wife. By

him.

William Whitlock appeared in court in discharge of a recongizounce
entered into at the information of Susan Shields, who charged the sd
Whitlock with being the father of her bastard children Espa & Sally and
thereafter on hearing the said Susan on oath & the parties by counsel
it is considered by this court that the sd William Whitlock pay
annually to the overseers of the poor of this county the sum of 10 lbs
toward the support of the sd children that is to say 5 lbs for each of
them until they respectively arrive at the age of seven years.

to Samuel Kidds in the room of Clement McDaniel & it is ordered that he
together with his own male labouring by this & those of William Dodson,

Boothe, George Campbell, Samuel McCulley, John Mosely & William Dodson
do for with clear and keep the same in repair according to law.

On the motion of Caleb Dodson & for reasons appearing to this Court It
is ordered that 134 acres of land which the sd Dodson purchased of John
Caldwell be exonerated from all taxes due thereon prior to the 19 day
of June 1811. It appearing from the oath of sd Dodson that he knew
nothing of the sd taxes being in arrears & that he has no part of the
purchase money in his hand.

On the motion of John Lumpkin, Benjamin Ratliff and Joseph Ferguson It
is ordered that 400 acres of land which they purchased of John C.
Russell be exonerated from the taxes due thereon for the years 1802 &
1803 when the same was charged to said Russell and also from the tax
due thereon for the year 1804 when the same was charged to Eleazar
Clay. It appearing to the court that they knew nothing of the said
amount of taxes at the time of this purchase of the said lands and that
they have no part of their purchase money in their hands.
