Last Will and Testament of Maria L. Daniels:

I Maria L. Daniels of the town of Port Washington, in the County of Ozaukee and State of Wisconsin, being of sound mind, memory, and understanding, and being mindful of the uncertainties of human life, do hereby make publish and declare this my last Will and testament in the manner following to wit:

Clause 1st
After the payment of my just debts and my funeral expenses, I give, devise and bequeath to my daughter, Ann Jane Hoyt wife of Antaxerxes Hoyt my large cherry table, my bible, my silver castor, the picture entitled “Shore to Shore”, and any second sized looking glafs.

Clause 2nd
I also give, devise and bequeath to my daughter, Cordelia Hoyt, wife of Thomas M. Hoyt, my bureau, my large looking glafs and my “Signal Corps” picture.

Clause 3rd
I also give, devise and bequeath to my said daughters Cordelia Hoyt and Ann Jane Hoyt my sofa, my ‘what not’ and six sofa bottomed chairs, to be divided so that the sofa and the ‘what not’ shall be taken by one of my said daughters, and the six sofa bottomed chairs shall be taken by the other, as they shall agree. And the residue of my household goods and furniture consisting of books, painting, pictures, clothing, beds and bedding, provisions, chattels and effects other than money or securities for money, which shall, at my decease, be in or about my dwelling house and premises at the said town of Port Washington I give, devise and bequeath to my before mentioned daughters Cordelia Hoyt and Ann Jane Hoyt, to be justly and equally divided between the said Cordelia Hoyt and Ann Jane Hoyt as they shall agree.

Clause 4th
I also give, devise and bequeath all moneys and security for moneys, which shall remain after my decease, and after the payment of my just debts and funeral expenses to my three sons Nahum Daniels, Jasper S. Daniels and Stewart Daniels: each of said sons to received one third part of said moneys and securities for moneys so remaining after my decease, But, in the event of the death of any one of said three sons above named prior to my decease, then and in that case, said moneys and securities for moneys shall be divided, pro rate, between such of my three sons above named as may survive my decease.

Clause 5th
I also give, devise and bequeath jointly to my aforesaid three sons Nahum Daniels, Jasper S. Daniels and Stewart Daniels, and to their heirs and afsignes, the following Real Estate, situated, lying and being in the town of Port Washington, in the County of Ozaukee and State of Wisconsin (should the same remain unsold at the time of my decease) and particularly described as Lot No four (4) in the subdivision of the West half of the South West quarter of Section No twenty eight (28) in township No. Eleven (11) North of Range No. twenty two (22) East together with all the hereditaments and app??tenances thereunto belonging or in ?? thereunto appertaining, each to have and to hold an equal one third interest in said real estate forever. But, in case wither of said three sons above mentioned should die prior to my decease, then said real estate shall go to the surviving sons (of the three named) in equal shares.

Clause 6th
I give devise and bequeath to my before mentioned daughters Cordelia Hoyt and Ann Jane Hoyt all and singular the rest, residue, and remainder, if any, of my personal property of what nature and kind soever; and I hereby revoke all former wills by me made.

I hereby nominate and appoint James W. Vail of the town of Port Washington, in the County of Ozaukee and Sate of Wisconsin, the Executoor of this my last Will and Testament; and empower him the said James W. Vail, to settle, compou??d and compromise and claim or demand which may be against or in favor of my said estate.

In witnefs whereof I have hereunto set my hand and affixed my seal this 28th day of January A.D. 1881.

The above and foregoing instrument, consisting of one sheet of legal cut paper, and four pages of writing was, in the day of the date thereof signed, sealed; published and declared, by the said testatrix, Maria L. Daniels, to be her last Will and Testament in the presence of us who have signed our names at her request as witnefses in her presence and in the presence of each other.
