George W. Farris Last will and Testament

 December the 20th AD 1864  

I, George W. Farris of the county of Macoupin State of Illinois, do hereby make and declare this my last will and testament in manner and form following to wit.  

First                 It is my will that all my just debts be fully paid.

Second             After the payment of my just debts I give and bequeath unto my wife, Nancy, all the land now owned by me, during her natural life.  And it is my will after her death that the land be sold, and the money or proceeds thereof be equally divided among my heirs.  And it is my will that all the personal property be sold except one two horse wagon and two horses.  And it is my will, that the money that this property brings be loaned and the interest     is to be subject to the    My wife during her life, and at her death it is my will that the money be    And equally divided among my heirs.  And it is my will that my daughters Sarah Jane and Lucinda have one hundred and fifty dollars each of the money owing to me as soon as it can be collected.  And it is my will that my wife full possession of all the household furniture and other articles of personal property not here in enumerated or otherwise disposed of in this will during her natural life, after having disposed of a sufficient amount to defray and discharged expresses and debts aforesaid.  And that as her death all the property aforesaid her bequeathed or so much thereof as may remain unexpended.  It is my will that it shall be equally divided among my heirs.  

And it is my will that James S. Farris and Robert Sawyer be the executors of this my last will and testament revoking  and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament.

In witness where of I the said George W. Farris have here unto set my hand and seal this the twentieth day of

Personally appeared in open court John Walker and Dempsey Sawyer subscribing witness to the foregoing instrument of         To be the last will and testament of George W. Farris late of Macoupin Co. deceased who being duly sworn according to law, do depose and say.  Each for   that the foregoing is the last will and testament of the same George W. Farris.    This they subscribe their names thereto as the attesting witness as the     the said testator, and in his presence.  And in the presence of each other     and there subscribed his name thereto in their presence and declared this his last will and testament and the said testor at the time of       Same as aforesaid was of was of full age of sound mind and memory and under      Subscribed and sworn to in open court this 11th day of February AD 1865.

Farris deceased who being sworn in due form of law    And say that the said written instrument is the last will and testament of the said George W. Farris deceased.  And also come into court John L. Walker and Dempsey Sawyer attesting witnesses to the said last will and testament who having been sworn in due form of law.     And say that the said instrument is the last will and testament of the said George W. Farris deceased that they subscribed their names thereto as the attesting witnesses at the request of the said testator and in his presence and in the presence of each other.  That he and    Subscribed his name thereto this    And declared the same to be his last will and testament and that the said testator at the time of executing the same as    Was of full age of sound mind and memory and under no constraint.

Ordered by the court that the said will be taken for   and that the clerk record the will and probate.

Came into court James S. Farris and Robert Sawyer executors of the last will and testament of Geo W. Farris deceased for an adjustment of claims against the estate of the said deceased and made proof that notice has been given as required by law when W. W. Mitchell presented a claim against the estate of the said deceased amounting to the sum of forty dollars which was proven and allowed.

Wm V. Farris presented a claim again the estate of the said deceased amounting to the sum of ninety six dollars which was proven and allowed.

Gilbert Sexton presented a claim against the estate of the said deceased amounting to the sum of six dollars which was proven and allowed.

John M Davis presented a claim against the estate of the said deceased amounting to the sum of twenty five dollars which was proven and allowed.

John Schultz presented a claim against the estate of the said deceased amounting to the sum of thirteen dollars and fifty eight cents which was proven and allowed.

Henry Caldwell presented a claim against the estate of the said deceased amounting to the sum of five dollars and seventy cents which was proven and allowed.

Sawn Walker presented a claim against the estate of the said deceased amounting to the sum of two dollars and fifty cents which was proven and allowed.

Robert Sawyer presented a claim against the estate of the said deceased amounting to the sum of twenty five dollars which was proven and allowed.

James S. Farris presented a claim against the estate of the said deceased amounting to the sum of eighty seven dollars which was proven and allowed.

Citation

James Ferris and Robert Sawyer executors of the estate of George W Farris dec

And now on this day comes Thomas Whittington the petitioner by his attorney Robert B Shirley ad also comes James Farris one of said defendants and the said defendant Robert Sawyer having been served with process more than ten days before the first day of the present term of this court, and being three times solemnly called came not but herein made default.  It is therefore ordered that the default of said defendant Robert Sawyer be entered.

And the said James Ferris and Robert Sawyer executors as aforesaid and having failed to file a new bona herein as heretofore ordered by the court    Is ordered that the letters testamentary heretofore issued to them as executors of the estate of George W Farris be and the same are hereby revoked.   Ordered that citation be dismissed at costs of defendants and execution issue therefore.

Ordered that court adjourn to tomorrow morning at 9 O’clock

To the Honorable Thaddeus S Soomie (?) Judge of said County sitting for Probate business

Your Petitioners William Farris and Nancy Williams widow of George W. Farris all residents of said county and state would respectfully represent and show unto your Honor that on or about the ____ day of ____ 1865 George W Farris departed this life in this county leaving a widow Nancy Farris and leaving also the following named children and heirs to wit Lucinda Jane Farris and Sara Jane Farris and William Farris, James S Farris and the said George W Farris also left a last will and testament and therein appointing James S Farris and Robert Farris Sawyer executors of said will and in said will he the said deceased among other things provided first for the payment of all his just debts.  Second he did there in give all his land owned at the time of his death to his said wife during her natural life and that all his personal property be sold except one two horse wagon and two horses and that the money which the property might bring by the sale thereof he loaned and the interest thereon  was to be subject to the will of his said wife during her life and at her death that the money be collected and equally divided among his heirs, and that his wife have full possession of all the household furniture and other articles of personal property not in said will enumerated or otherwise disposed of in the will during her natural life after having disposed of a sufficient amount to pay and discharge the expenses and debts of the estate and that at the death of his wife all the property aforesaid to his said wife bequeathed or so much thereof as might remain unexpended should be equally divided among his heirs and for certainly refereed to his heirs, said will is hereby made part of this petition.

Your petitioners further represent unto your honor that the said James S Farris and Robert Sawyer did on or about the eleventh day of February 1865 as executors of said last will enter into the usual executions bond with security and entered upon their duties as executors as aforesaid and have made two reports of their actings and doings which said reports are not just on time and neither of them set out or show the real amount of monies collected by them nor the time nor real amounts which they have received or should have received in due course of administration, and said reports or either of them show the amount which has been paid the said widow nor do they show that they have paid her anything your petitioners further state, that ample time has been allowed for said executors to make final settlement of said estate but so it is said estate has not been finally settled but is becoming more and more unsettled; for your petitioner states that none of the interest of the money collected by said executors belonging to said estate has not been paid to said widow nor has it been accounted for by said executors - and large sums of money over which they are chargeable or have received have not been accounted for - and many of the sale notes and monies ? received from the sale have never been accounted for since the filing of the sale bill.  In consideration of the promise and of the statute in such cases make and provided your petitioners property that summons may issue against said executors to show cause & end your petitioners pray for such relief s the case above stated and the condition of said estate may require and they will ever pay.

Estate of Leasel Grant admin qualified

 County of Probate Special Term December 13th A.D. 1841 George W. Farris appeared in ? Court and suggested the death of lease Grant late of said County deceased Ordered that proof of the same be now made    The said G W Farris     as that Leased grant died on or about the 12th day of December A. D. 1841.  Having at    and interlace to the best of his knowledge and belief.  Ordered that said affidavit be placed on file in this office thereupon the said George W. Farris presented the renunciation of Mrs. Grand widow of the said leased grant deceased which was ordered to be placed on file in this office.

Thereupon the said George W. Farris requested that letters of administration be granted on to him on the estate of the said deceased, ordered that proof of value of the personal estate of the said decs be now taken thereupon the said George W. Farris made oath that same does not exceed the ? Of three hundred forty dollars to the best of his knowledge and belief ordered what said affidavit he placed on file in this office.  It is now therefore ordered that letters of administration issue to the said G. W. Farris as aforesaid upon his entering into bond with security in the ? sum of ? $680.  Bond offered in forgoing sum of $600. With Thomas Grant security approved and ordered to be filed.  Ordered that letters now issue as aforesaid.  Ordered that warrant of appraisement to the said George W Farris which is according done.

Know all men by these presents that we George W. Farris & Thomas Grant of the County of Macoupin and State of Illinois are held and firmly bound unto the people of the State of Illinois in the final sum of six hundred and eighty dollars current money of the United States which payment will and ? be made and proposed we and each of us bind ourselves our heirs executors - administrators and    jointly    & firmly by these presents -     our hands and seals this 15 day of December A. D. 1860 -

The condition of the above obligation is such that if the said George W. Farris who has this day been appointed administrator of all    and    The goods and chattels rights & credits of Leasel Grant deceased do make or cause to be made a true and    - inventory of all and    The goods and chattels of rights and credits of the said deceased which shall come to the hands ? Or knowledge of them the said George W. Farris as such administrator or to the hands of any person or persons for him and the same so made do    Or cause to be exhibited in the court of Probate for the said County of Macoupin agreeable to law and such goods and chattels rights and credits do well and truly administer according to law.  And all the rest of said goods and chattels rights and credits which shall be formed remaining upon the account of the said administrator the same being first     And    By the court of Probate shall deliver and pay unto which person or persons respectively as may be legal        and further do make a Trust and trust account of all his actings and doings therein when        by the said court and if it shall hereafter    That any last will and testament was made by the deceased    The same be proven in court and letters  -      thereupon and the said George W. Farris do in each case             of on being         sender and deliver ? The letters of administration granted to him as aforesaid and shall in general do        all others acts which may at any time be    Of    By law then his obligation to be void otherwise to remain in full force and    -

 The people of the State of Illinois to all to whom these presents shall come greeting. Know ye that whereas Leasel Grant of the County of Macoupin and State of Illinois died intestate as it is said on or about the 12th day of December A. D. 1840 having at the time of his decease personal property in this state which may be last destroyed or diminished in value if     Cane be not take of the same.  The end therefore that said property and debts may be collected and    For those who shall appear to have a legal right or interest    We do   Affavit George W. Farris of the County of Macoupin and State of Illinois administrator of all and singular the goods and chattels rights and credits which were of the said Leasel Grant at the time of his decease with full    And authority to        collect the said property and debts where? The same my be found in this State and in general to do and    All others acts which now are or        may be required of him by law.
