(Day) Hale, born July 07, 1730 in St. Pauls Parish, Baltimore Co.,MD; died
1785 in Washington Co., TN-Watauga. She
was the daughter of 2. Nicholas Hale III and 3. (Ruth) ? Ann Long. She married (1) Thomas Day. He died Bef. 1753. She married (2) Matthew(II) Talbot June 1753 in Bedford
Co., Va.. He was born November 27, 1729
in Prince George Co.,VA-Bristol Parish, and died October 12, 1812 in Morgan
Co., GA. He was the son of Matthew(I)
Talbot and Mary Williston.
Notes for Mary (Day) Hale:
She was the widow of Thomas
Day and the daughter of Nicholas Hale.
Some records show her mother as Ann Long. Her father had been associated with Matthew(I) in business in Maryland
and both families migrated to Virginia, probably at the same time.
Margaret Kittrell claims
she was born in 1733. Virgil Talbot
claims she was born in 1730.
Notes for Matthew(II)
Talbot:
He was a hunter, trapper,
merchant, stockman, Indian fighter and patriot. In 1777/78, he left Virginia
and settled first in the valley of the Watauga River in what is now eastern
Tennessee. He was engaged in the cattle
business and operated a mill. He had
significant land holdings in the area including the land upon which Fort
Watauga was built. He ground corn for
the settlers to use when they marched over the mountians where they defeated
the British in the famous Battle of Kings Mountain. Matthew(II) served in the comissary during the Revolutionary War
and his four older sons also served. Edmund
and Clayton were too young to fight.
His wife, Mary Hale Day, died in
1785 and shortly afterward, he moved to Wilkes Co., Ga. where his younger
brother, John, was living. Hale,
Thomas, and Mary appear not to have accompanied him but Matthew (III), William,
Edmund, and Clayton did. Later he moved
to Morgan Co, Ga where he died in 1812.
Although scant, evidence exists to show that he was remarried.
Matthew and his wife were
active in the Anglican church but he joined the Baptist church, probably while
in Tennessee, and became a preacher. He
was one of the first Baptist ministers to preach in the Watauga area of present
day East Tennessee and he was the first pastor of the Sinking Creek Baptist
Church there. He continued to preach
the remained of his life. Many of his
descendants followed in his footsteps as ministers of the gospel.

Notes for Nicholas Hale
III:
Nicholas Hale3 emigrated
from Baltimore County to Augusta County, Virginia as early as 1748. In 1749 he was a Justice of Lunenberg
County, and when Halifax County was formed from Lunenberg in 1752 he was a Justice
of that county. They lived in the far
western part of the county which later became Franklin and Bedford Counties.
Talbot family legends hold
that Matthew (I) Talbot and Nicholas Hale, III were business partners in
Maryland before the two families moved to Virginia.
Hale's Old Mill Creek which
empties into the Staunton River, and Hale's Ford both take their names from
this branch of the Hale family. They
owned much land on both sides of the Staunton River which now forms the border
between Bedford and Franklin Counties.

The Will of Nicholas Hale,
II
In the name of God Amen. I Nicholas Haile of Baltimore County in
the Province of Maryland being weake of body but of perfect mind and memory
thanks be given to God for the same hoping sure trusting him to remission of my sins through his son Jesus Christ
and knowing the uncertainty of this mortal life have ordained and do ordain
this to be my last Will and Testament & I do hereby utterly Disallow and
make invalid all other former wills by me made but do fully confirm this my
last Will and Testament. I also will that my well beloved Wife Francis Haile to
be my whole and Sole Executor of this my last Will and I do trust to her for a
decent Burial. I also will that all funeral charges and just debts to be
honestly and legally paid and discharged.
Item: I will unto my eldest
son Nicholas Haile have that tract of and called Hailes Fellowship whereon he
now liveth to him & his heirs of his body lawfully begotten forever; the
said land to be divided right across the middle. I will that my son, George Haile, shall have the upper and portion
next to George Hitchcock's to him and his Heirs of his body lawfully begotten
forever but and if my two sons Nicholas Haile and George leave no lawful heirs
them his or their part or parts of Land to the next of kin and so constitute as
aforesaid forever.
Item: I will to my well
beloved Wife Frances Haile my now Dwelling plantation called part of Merryman's
Lott and my new plantation called Hailes Addition to her and for her without
Molestation During her natural life and after Disease to my son Neale Haile and
my daughter Mary Haile .
Item: to my Son Neale Haile
my now dwelling Plantation which is called part of Merrymans Lott to him and
his heirs for ever also I will that my son Neale Haile to have part of that
tract of Land called Hailes Addition adjoining to my new dwelling Plantation
and to begin at a great standing stone by the great Run of this tract and to
run with a strraight line to a bounded black oake being on the land called
Hailes Addition to my son Neale Haile and his heirs lawfully begotten by him,
but and if he dies without heirs fully begotten then all his land to the next
of kin.
Item: I also will that my
eldest daughter Mary Haile shall have all the remainder part of that tract of
land called Hailes Addition to her and her heirs of her body lawfully begotten
then that land to the next of kin.
Item: I will unto my two
daughters Hannah Haile and Ann Haile my tract of land called Mount Pleasant
containing one hundred and fifty acres to be equally divided between them and
for them and their heirs lawfully begotten for ever. Hannah to have her first
choice but and if they, one or both die without issue lawfully begotten then to
the next of kin as above said.
Item: I give to my two
Daughters Millisant Haile and my Daughter Sabbiner Haile one hundred acres of
Land lying on Stonyruning called Hailes Folley to be equally divided between
them Millisant to have her first choice to them and their heirs lawfully
begotten for ever but and if they die without issue lawfully begotten then to
the next of kin and each of them one heifer apiece besides their equal share in
the moveable Estate.
Item: I also will that my
three old Negroes be to my wife to maintain her herself and my son Neale Haile so
long as long as she liveth but and if any negro Woman bring children then the
first child to my youngest Daughter Ann Haile & the next to the next
youngest and so on till every one of my children has one negro child if so be
that my Negro woman or women should bring so many but and if my wife should die
then the three old Negroes to my son Neale Haile but and if he should die
without heirs to the next of kin.
Item: I will that my son
George Haile have the mare colt that is now with and came of my mare called
Dainty(Daisy) and the next colt that either of my mares bring to my Daughter
Millisant and the next to my Daughter Sabbriner and the next to my Daughter Ann
and the next to my son Neale Haile also all the rest of personal Estate to be
equally divided amongst all my children.
In Testamony hereunto I
have fixed my hand and Seal this Twenty seventh Day of February one Thousand
seven Hundred and Twenty nine. Sealed published and Declared by the said
Nicholas Haile to be his last Will and Testament in the Presence of us

Marryman Johannah Merryman & Francis Hinckley the subscribing witnesses to

saw the Testator Nicholas Haile Sign Seale and heard him publish and declare
the within to be his last Will and Testament & that at the Time of his so
doing he was to the best of their knowledge of sound and disposing mind and
that they subscribed the said Will in the presence of the said Testator sworn
to before Tha Sharedine D. for Balt Co.

Notes for Nicholas Hale I:
Our first American Hale ancestor was Nicholas Hale who was
in Virginia by 1645. He lived first in
Elizabeth City County, Virginia, and by 1648 owned a plantation in York County,
Virginia. In 1651 when Lancaster County
was formed; he began acquiring land there.
He was living in York County until at least 1654.

Nicholas Hale filed patents
on two tracts in Lancaster County, one in 1657, 360 acres on the Corotoman
River and one in 1666, 234 acres also on the Corotoman.
In 1758, Nicholas Hale was
among those assessed 50 pounds of tobacco for their share of the minister's
compensation. "Court at James City
order to pay David Linsey 50 pounds tobacco. . . in satisfaction for his
ministry among them . . . Nich Hales.
Court 27 May 1758."
On two occasions he was
issued certificates for the transportation of people into Virginia. These certificates could be exchanged for
land - 50 acres for each person. In
1662 he received a certificate for 5 persons, including himself. In 1666 he
received another one for the transportation of 7 persons. The transportation could be for people
entering Virginia for the
first time or for those
returning from a trip abroad.

The 1662 certificate may
have been for a business trip to England as he seems to have had some contact with
merchants there, and on at least one occasion was authorized to act in their
behalf.

There were only three
children of Nicholas and Mary, as daughter Mary was to receive 1/3 of the 2/3
children's part of her father's estate and 1/3 of the estate of her
mother. When a man died without a will,
1/3 of his estate was reserved to the widow for her lifetime with the other 2/3
being divided evenly among the children.
At the death of the mother, her estate would have been divided evenly
among all the children.
