Will of John Dillahunty
John Dillahunty decd. Will...Recorded May the 15th

In the name of God Amen I John Dillahunty of the State of
Tennessee & County of Davidson being rather in a low State of
health but of sound mind and memory And as it is appointed unto all
men once to die do Constitute and make this my last will and
Testament leaving all my property that it hath pleased God to give
me on Earth as follows declaring this my last will & disclaiming
all other wills by me made in witing or otherwise ~~Item
I give my Soul to God in Jesus Christ who gave it me & my body
to be buried as my executors hereaffter mentioned Shall think proper
And my properrty I give as follows Item Whereas I have given to
three of my Sons (Viz.) John Dillahunty Samuel & Daniel Dillahunty
lands in North Carolina with other property which said property I confirm
to them & their heirs as their full share of all my estate forever.
Item Whereas I have given to my son Thomas Dillahunty two hun
dred and Sixty acres of land in North Carolina and have also given
him a duplicate for two hundred and twenty eight acres which
I obtained from the office in Nashville & assigned to him which proper
ty I confirm to him & his heirs forever. ~~My will further is that
the crop remaining of every kind after my death & the death of my
beloved wife Hannah Dillahunty should she out live me go to
my Son Thomas Except so much thereof as will pay my lawfull
Debts which I wish him to See to & Settle off which together with
that xxxx property I confirm to him & and his heirs forever as his full
Share of all my estate~~~ Item I give to John B. Dillahunty Son of
Thomas Dillahunty a negro boy named Stephen but if John B. Dilla
hunty should die without issue my will is that said boy fall back
into the estate of Thomas Dillahunty. Which Boy I confirm to
him and his heirs forever~~~ Item whereas I intended giving
my son William Dillahunty two negroe boys & he is now dead
one of the boys being dead also My will is~~~ Item I give &
bequeath unto John Dillahunty Son of William Dillahunty one
negro boy named York to him & his heirs forever~~~ My will is
that after Sally Dillahunty the mother of John Dillahunty or
his guardian shall receive said boy that they shall hire him
out until John Dillahunty comes of age and the money arising
from his hire Shall be eaqually divided between his two brothers
Isaac and William Dillahunty which I confirm to them and
their heirs forever as their full share of all my estate~~~
Item Whereas I have given to my daughter Rachel and to her hus [sic]
husband Joseph Johnson Sundry property heretofore I do now bequeath
to her and him one negroe woman named Venice and her increase
that she may have after the date of this will I also give to my son
in Law Joseph Johnston my Sorrel horse which property I confirm
him forever as their full share of all my estate~~~~
Item Whereas I have a negroe woman named Dinder who
from her good conduct in my family I wish to Set free from
Slavery at the death of her Mistress and I wish her to live
with my daughter Rachael & son in law Joseph Johnston
and work to them for her maintainance while she lives~~~
Item I give and bequeath to my daughter Mary ann West
one negro child named anny which I confirm to her

and her heirs as their full hare of all my esatate~ Item whereas
I have given to my daughter Ann Colvett Sundry property in
North Carolina and she being now dead I give to her heirs one
dollar as their full share of all my estate~~ Item I give un?
to my grandson John Quilling one horse if their should be
one more beside the one before named to him his heirs &C
Item my Will is to lend to my beloved wife hannah Dillahun
ty During her natural life all my property named in
this will Together with every article & property not herein
named which may remain after my debts are paid~
Item My will is that at my death and the death of my beloved
wife that all my property and article of every kind not herein
named and disposed of go to my daughter hannah Twilling
which I confirm to her and her heirs as her full share
of all my estate my will is that my executors take care of
said property until her or her agent receives it & that they
take care of all the property herein named untill the several
legatees or their agents gets it... Item And lastly I do appoint
my son Thomas Dillahunty George West & James Whitset
my whole and Sole Executors to this my last will &
testament~ In Testimony whereof I have hereunto set
my hand and Seal this thirty first day of may in the
year of our lord one thousand eight hundred and ten

State of Tennessee Davidson County Court april Sessions 181?
The last Will and Testament of John Dillahunty decd. being
exhibited in Court for probate and the Suscribing wit
ness's not being present said will was admitted to be proven
by James Whitsett & Jenny Whitsett in whose hands it had
been deposited by the testator from the execution thereof for
safe keeping and thereupon the said James Whitsett and
Jenny Whitsett being duly sworn say that they saw the
said John Dillahunty sign the same and that they verily
believe he was in his right mind at the time he executed
said last will and testament Whereupon Thomas Dillahun
ty George West & James Whisett the executors named in said
will came into Court and gave bond of three thousand
dollars with Thomas Hickman Thomas McCrory and
Charles Hays [Hayo?] Securities for the faithfull discharge
of the trusts reposed in them and quallified according to
law ordered that they have letters Testamentary
granted them whereupon said and will and probate
is ordered to be recorded at length
