The first Castle of Tolly had, it is said, the
inscription "Sir Alexander Barclay of Tolly, fundator, decessit, AD 1136.
The Barclays of Bourtie were the Barclays of Tolly. King Robert gave charter
upon Towie to Alexander Barclay of Kerco. Kerco or Kercow is so like the
spelling of Cracow, which might have been made at that time in Scotland, as
to tempt inference that Alexander Barclay was an early example of what was
common from Aberdeenshire in later times.

Notes for PATRICK DE BERKELEY:
Sir Patrick Berkeley, Knight, Thane of Balhelvie, Co. Aberdeen, who was
Great Chamberlain of Scotland between 1280 and 1288. He signed the Ragman Roll
in 1296, and was afterward said to have been a friend of Sir William Wallace.
Sir Patrick was father of two sons, who were styled "Hug (Hugo) et Walter
de Berkeleya Fratres."

Notes for WALTER DE BERKELEY:
Sir Walter de Berkeley, Knight, Baron of Towie Aberdeen was the first of
the family and a burgess of Perth. After accompanying his elder brother on the
Welsh Mission, he was taken prisoner at the battle of Dunbar, 27th April 1296,
and was one of the Scottish Knights imprisoned in Berkhamstead Castle,
Bedfordshire, on 31st May, following. On 1st August 1322, he received a Crown
Charter of the lands and barony of Towie, in which he is styled "of Kerko"
from an estate owned by the Berkeleys in the Carse of Gowrie, Perthshire. In
1322, Sir Walter also received a Crown Charter of the lands of Kainzie, in the
Thaneage of Ballhelvie. The Baron was Sheriff of Aberdeen in 1323.

Notes for PATRICK13 DE BERCLAY:
In 1421 was a "bruch" (suretie) with two other Barclays, for
Alexander Berkeley of Mathers. This seems to have been for proof of the kinship
of the Scottish Barclays to Macduff. It is quite possible that Mathers had taken
part in some fued, for, by the "Law of the Clan Macduff," those who
could claim kindred with Macduff, Earl of Fife, within the ninth degree (canon
Law), were immuned for homicide if they could reach Macduff's Cross, which stood
on the march between Fife and Strathearn, near Newburgh, and pay a fine of nine
kye (cows) and a colpindash (a young cow), when they were then absolved from any
slaughter which they might have committed.

Sir Patrick Barclay,
Knight, Baron of Towie, succeeded his father, and is described as "Chief of
(the) Barclays in Scotland" in a curious note by and unknown hand � some of
which rhymes � on the outside of the Royal MS. of Andrew Wyntoun's
Chronicle of Scotland, now in the British Museum, which latter was
transcribed, as it states, for George Barclay of Achrody, brother-german to
Sir Patrick, abovementioned. The date of this copy is said by experts to be
between 1460-70. It alludes to the marriage of the "hous" of Towie to "ane
dochter of Gartly," and turning to the arms then borne by Sir Patrick, it
goes on to explain that he carried a third "cors" in honour of his
allegiance with the heiress of Gartlie, i.e. "twa corsis" in chief, and one
in base. The end of the note id unfortunately obliterated, or still more
valuable information concerning these points might have been obtained.
The Baron married
Catherine Barclay of Gartlie. The has issue two sons: 1. John Barclay, who
succeeded to Towie 2. William Barclay, who inherited Gartlie, as already
described under that family.

Notes for HUGO DE BERKELEY:
Sir Hugh de Berkeley, Knight, Thane of Balhelvie, succeeded his father and
received a Crown charter of those lands from King Robert Bruce (1306-29) in
which he was designated "of Fintriegask." Together with his younger
brother WALTER, he was sent by the Comyns to form a treaty with the Welsh.
Whether these were the Welsh of Strathclyde, or the Tribesmen of Wales, is not
very clear. According to an inquisition held at Berkeley, co. Gloucester, 27th
April 1296, he was an adherent of John Balioli, and was in receipt of two merks
paid yearly by contract from the manor of Cam, Gloucestershire. Cam, in the
district of Dursley, was granted to Robert de Berkeley of Berkeley Castle- of
the Fitzhardinge family- for the support of his first spouse, Juliana, niece of
the Earl of Pembroke. This Robert died without issue in 1219, having married,
secondly, Lucie (surname unknown), who survived him, and was afterwards wife of
Hugh de Gurney, whose family in later years intermarried with the Barclays of
Urie. The manor of Dursley at that time belonged to the heirs-male of the
original Norman family of de Berkeley. By Eleva, his spouse, Sir Hugh does not
appear to have left any male issue.
