19 July 1728. Robert Lee of Whitechapel, Middlesex, aged 17, bound to John Ball to serve 7 years in Pennsylvania or New York.

(2) in February, 1738 “Robert Lee, labourer,” was accused in the Shrewsbury court of stealing one and a half bushels of wheat.

The court record, on February 10, 1737/8 states that Robert Lee "did acknowledge himself indebted unto our said Soverign

Lord the King in the Sum of Ten pounds Lawful money of the Province above said to be levyed on his goods and chattels, Lands,

and Tenements to the Use of our Said Lord the King his heirs and Successors."

(3) Bill of sale and personal property inventory. Items sold for 5 pounds to try and pay fine in source (1) above. Collection 10,

(4) Robert apparently did not own any land and the forced sale of his moveable estate only brought in half the fine.

He was therefore sentenced to 13 lashes on April 26, 1738 and was committed until his fine was paid.

(5) Baptism of son Giles Lee 22 May 1738 Christ Church in Shrewsbury, Monmouth Co., New Jersey.

(6) Baptism of daughter Elizabeth Lee at Christ Church 08 June 1741.

His parents were listed as Robert and Rachel Lee, and the church record says they lived in Shrewsbury.

(2) 1779 "Ratable's List" (a taxpayer record) ("Genealogical Magazine of New Jersey", Vol. 46, 1971, p. 91) owning 75 acres, 1 horse, and 3 cows in Roxbury Township, Morris Co., New Jersey.

(5) Minutes Of The Council Of Safety Of The State Of New Jersey (Volume I) - Page 104. July 24, 1777 - "Giles Lee 1st Lieut in a Compy of Militia, belonging to the Co of Morris, voluntarily appeared & took & subscribed the Oaths of Abjuration & Allegiance as by Law appointed." Thus Giles gave up his British citizenship and swore allegiance to the Colony of New Jersey. The oath-taking was in the presence of Governor William Livingston and five members of the Safety Board. The event took place in Haddonfield, Camden County, NJ at the Indian King Tavern where the fugitive legislature met and created the state of New Jersey in 1777.

Sources in Wilkes Co., Georgia:

(1) In 1785 Tax List, Giles (as Jiles) was taxed for 400 acres in Capt. Elsberry's District. The land was of third quality meaning

the land featured pines rather than hardwood. In the 1786 Tax List, he appears along with a Robert Lee who owns no land.

This usually implied a son had turned 21 during the ensuing year. If so, Robert was born ca. 1765. Giles appears in the 1787

Tax List, but not Robert. In 1790 Giles owned 200 acres in the same district. A John Lee, who owned no land of his own, lived

with him, indicating this son was born 1767 to 1769.

(2) 1789 Wilkes Co., 200 acres headlight , on Broad River (Vol. Q, p. 165). Giles lived on the south branch of the Broad River.

This land would lie in westernmost Oglethorpe county when that county was formed from Wilkes in December of 1793.

(3) 1791, 1792, and 1793 Tax Lists (200 acres).

(4) 1792 - Headright grant for 200 acres on the Broad River (Wilkes County Deed Book WWW, pp. 268 and 269)

(5) In February 1794, an estate sale was held for the possessions of Robert Pogue, a farmer who lived next to Giles. The record

shows Giles, James, Robert, and George Glazener attended the sale.

(6) In June of 1794 Giles and his wife Ann sold their 200 acres to John Griffith for the goodly sum of 500 pounds (Oglethorpe

County Deed Book A, p. 270). Griffith had been one of the early settlers along the South Fork of the Broad, and by 1794 he

owned the land on all sides of Giles’ farm. So the purchase connected his pieces and gave him more frontage on the river.

Griffith’s land also adjoined James’ and George Glazener’s, confirming that they had indeed lived close to Giles.

Sources in Russell Co., Virginia:

(1) In August 1795, Giles bought 50 acres in the Glade Hollow area (Russell County Deed Book 2, p. 25).

(2) Giles Lee bought 94 acres from William Fugate and his wife Jane, of Lee Co., VA, on 25 July 1797. This land was in Moccasin

Valley on Moll's Creek. and was granted a license to keep an “ordinary” (a tavern) in his home for one year (Russell County

Virginia Law Order Book 2, p. 382).

(3) Deed Book 2, page 436, 26 September 1797, Giles Lee sells to William Sergeant 50 acres in Glade Hollow, being land

patented to Cornelius Roberts in 1787.

(4) Deed Book 2, page 537, Russell Co., VA, Giles Lee and his wife Rachael on 28 August 1798, sell to Colbet Fugate, 50 acres

being part of the above tract bought of William Fugate.

(5) Deed Book 2, page 245, Russell Co., VA, 28 May 1809 Giles Lee and Sarah, sell to Colbert Fugate, another 15 acres part of

the William Fugate tract.

(6) Deed Book 5, page 43, Russell Co., VA, 5 April 1814, Giles Lee sells to Colbert Fugate, 29 acres being the remaining part of

the 94 acres of William Fugate tract.

(7) In June 1796, Giles was brought to the Russell County Court of Quarterly Sessions for selling spirituous liquors (Russell

County Virginia Law Order Book 2, p. 364).

(8) In 1803, Giles Lee and his wife, Sarah were dismissed from the Stoney Creek Baptist Church (Fort Blackmore). 

In 1798, he had wife "Rachael". In 1803 and 1809, he has wife "Sarah", which means Rachael died sometime between 1798

and 1809.

(9) In 1804 Giles asked the county court to be excused from paying his taxes because of age and bodily infirmities (Russell

County Virginia Law Order Book 3, p. 331). He was about 67 then and the release was granted. It suggests Giles and Sarah

were poor.

(10) A Giles Lee bought a 5 acre plot in the Copper Ridge region of Russell County on November 3, 1817 (Russell County

Deed Book 6, p. 33). Ten days later James Lee wrote in his Bible, “Giles Lee departed this life Nov. 13, 1817.”

(4) In September 1795, George and Nellie Glazner sold their 100 acres on Tillet’s Creek in Wilkes Co., Georgia to

Fleming Jordan. (The disposition of their other 175 acres is unknown.)

(5) George Glazener and wife Nellie Lee and their children moved to what became Buncombe County, NC, and Robert Lee

went with them. There they got involved in the “Walton County War” over state boundaries and the validity of various

land deeds.

(1) 1789 Wilkes Co., 200 acres headlight , on Broad River (Vol. Q, p. 166).

(2) James Lee and George Glazener each bought 100 acres, for 30 pounds each, from Thomas Hendron on Tillet's Creek in November, 1790

(Wilkes Co. Deed Book GG, 1790-1793 p. 376 and p. 364). Hendron had acquired the land as a grant in 1784 (Georgia Colonial and Headright

Plat Index, 1735-1866, Book G, p. 184). Tillet's Creek joins the Broad River just south of the property where Giles lived.

(3) 1791 Tax List (300 acres).

(4) 1792 - James was given a headlight grant of 200 acres on the Broad River (Wilkes County Deed Book WWW, pp. 268 and 269.)

(5) 1793 - A titheable, but unlanded, William Lee now lived with James on Tillet’s Creek.

(6) 11 November 1793, James and his wife Sarah sold their 200 acres, now a part of Oglethorpe County, to Samuel Shannon for a mere 25

pounds (Oglethorpe County Deed Book A, p. 215). They presumably still lived on Tillet’s Creek.

(7) In November, 1795, William and Mary Lee sold what had originally been James’ 100 acres on Tillet’s Creek to Alexander Elliott

(Oglethorpe County Deed Book C, p. 64). We do not know when William and Mary Lee obtained title to these 100 acres. Perhaps brother James gave

William the property without going through the legal process.

(5) James bought 160 acres on Sinking Creek.

(3) In 1791, 1792, and 1793, Robert lived with Giles on his 200 acres.

(5) 1795 / 1799 Robert moved with George Glazener's family to what became Buncombe County, NC.

(6) 1800 census Buncombe Co., NC. 08 Jan 1800 Robert signed "Walton War" petition.

(7) Robert, with George Glazener, got involved in the “Walton County War” over state boundaries and the validity of various land deeds.

He, along with one of George and Nellie’s sons, was indicted in May 1805 for being present during a fatal December 1804 assault.

He appears to have avoided prosecution by fleeing the area.

(8) Robert was living in Tennessee in 1810 where son Daniel was born. They apparently settled in Lincoln Co., Tennessee close to the

Alabama border, and may have eventually moved into northern Alabama. Then they made a clan move to Madison Co., Arkansas about 1830.

(9) Lucy in 1860 census Madison Co., AR, age 86, born SC.

(10) Goodspeed's history says daughter Ellender was born in Virginia and "accompanied her parents to Alabama when a child, where she was reared

and married". This would place Robert Lee in Alabama somewhere in the years between 1809 and 1822. According to the 1800

Buncombe Co. census they had 3 children under 10, so Robert was probably married about 1796.

(11) In 1814, a Robert Lee enrolled with a Militia unit in Huntsville, Madison Co., Miss. Terr. (now Alabama) for a month

and nine days of service to protect the area against Creek Indian attacks. This may or may not be our Robert.

(Russell County Personal Property Tax List, Upper District, 1795; also Deed Book 2, p. 56).

(2) June 1796 John bought 87 acres on Clinch River near Leatherwood Branch.

(3) John and Polly sold their land in Glade Hollow in August, 1797 (Russell County Deed Book 2, p. 313). By 1799 John had decided to

throw in his lot with his in-laws, and took his family to Kentucky as part of a VanHook clan move.

NOTE: William's descendants match 45 of 46 DNA Y-chromosome markers of James and John Lee above. 98% match

implies a common ancestor in about 6 generations which turned out as predicted.

(1) 1793 Tax List Wilkes Co., GA. William was evidently landless and living next to James on this tax list.

(2) 1794 Tax List Wilkes Co., GA living between James Lee and George Glazener.

(3) 1795 William and Mary Lee sell 100 acres of land, now in Oglethorpe Co., previously purchased by James Lee in Wilkes Co., GA.

William would have been about 23 in 1795, and his wife Mary probably was somewhere between 18 and 22.

(4) Some time before 1800, William and brother Robert follow the Glazener's to Buncombe Co., NC. Father Giles and brothers James

and John had previously moved to Russell Co., VA.

(5) William and Robert Lee were both indicted by North Carolina officials for participating in "riots" in December 1804 during the

"Walton County War", Both evidently fled the region to avoid prosecution. Went to Tennessee and evidently settled close to the Alabama

border. We know this because Robert had a son Daniel born in Tennessee in 1810 and William's son Joshua substituted for him in Lincoln Co.

in 1813 joining the 1st Reg't West Tennessee Militia.
