Last will and testament of Trustam Hinshaw and Martha Hinshaw

We Trustam Hinshaw and Martha Hinshaw of the County of Randolph and State of North Carolina being of sound mind and memory but considering the uncertainty of out earthly existance do make and declare this our last will and testament in manner and form following that is to say

First that our executor herein after named shall provide for our bodies a decent burial suitable to the wishes of our relations and friends and pay all funeral expences together with our just debts to whomsoever owing out of the moneys that first come into his hands, do a part and parcel of our estate.

Item Second we will and bequeathe to our son Nathan T. Hinshaw the land we now live on supposed to contain two hundred and thirty acres together with all our stock farming tools and every other species of property that we [-unclear-] except our house hold property and kitchen furniture on condition that the said Nathan [-unclear-] with us and provide a comfortable living for and take care of us in our helpless condition during our natural life.
Item third we will and bequeath to our son Nathan T. and our daughter Martha J. Hinshaw all our house hold and kitchen furniture to be equally divided between them on condition that they can not agree on a division of the property to be divided by three disinterested free holders.

Item fourth we will to our son John one dollar in cash to be paid by our executor
Item fifth we will to our daughter Mahala Laughlin one dollar in cash to be paid by our Executor
Item Sixth we will to our son Thomas one dollar to be paid by our executor
Item Seventh we will and bequeathe to our son Isaac N. Hinshaw one dollar in cash
Item Eighth we will and bequeathe to our son Stephen Hinshaw one dollar to be paid by my executor
Item Ninth we will and bequeath to our daughter Lydia Milikan one dollar to be paid by our executor
Item tenth we will and bequeath to the heirs of our Daughter Rebecca one dollar
Item Eleventh we will and bequeath to our son Jesse one dollar to be paid by our executor
Item twelth we will and bequeathe to our Daughter Hannah Lewis one dollar to be paid by our executor
And lastly we do hereby constitute and appoint our son Isaac N. Hinshaw our lawful executor to all intents and purposes to execute this our last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by [-unclear-] herebefore made.

In witness whereof we the said Tristum Hinshaw and Martha Hinshaw do hereunto set our hand and seal this 23 day of May 1868.
