Notice of Probate of Will: In the Superior Court of the State of California in and for the County of San Joaquin. In the Matter of the Estate of John F. Miller, Deceased. Notice is hereby given that Tuesday the 22nd day of April, A.D. 1952, at 10:00 o'clock A.M. of said day, and the Court Room of said Court, in Department 4 thereof, at the County Courthouse in the City of Stockton, County of San Joaquin, having been appointed and are hereby appointed by the Clerk of said Court as the time and place for proving the last will and testament of said John F. Miller, Deceased and for hearing the applications of Esther Schnell for the issuance to her of Letters Testamentary thereon when and where any person interested may appear and contest the same. Witness my hand and the seal of said Court this 4th day of April, 1952.

Notice of Hearing in the matter of Estate of  Anna Miller, deceased. Notice is hereby given that Mary Miller of the above-entitled estate, has filed herein a petition for probate of wiill and for letters of administration with the will annexed, reference to which is hereby made for further partlculars, and that the time and place of hearing the same has been set for Wednesday, July 13, 1960, at 10:00 a.m. in the courtroom Department No. 2 of said court at the County Courthouse of said county, in the City of Stockton, California.

In the name of God Amen. I James Miller of the County of Muhlenberg and State of Kentucky, being weak in Body and being also in my perfect mind and memory. But calling to mind the mortality of my body, and knowing and believing that it is appointed for all mankind once to die I have thought proper while in my proper mind to make this my last Will and Testament.

In the first place I will my Soul to God who gave it.

Secondly. My will is for my Sister Mary Anne Hodgens to have all that is due by Anuity(?) and Otherwise in Ireland.

Thirdly, I give and bequeath to Angeline E. Poag and her bodily Heirs, my House and Lot in the Town of South Carrolton Muhlenberg County, Kentucky. It being the same myself and John R. Jones purchased from Jno. McGhee. Also I will to the said Angeline E. Poag and her bodily Heirs a certain Lot adjoining the Lot purchased from McGhee. Which Lot is deeded to Me by John Fentress. And furthermore I will to the said Angeline E. Poag a Check which I am now expecting from Ireland every mail. And in case it Should not arrive before my decease I desire that it be handed to Mrs. Angeline E. Poag to do as she may think proper.

And fourthly I will that my Executors hereinafter mentioned pay to my friend John Bruce Fifty dollars.

Fifthly. Whereas I ordered a Cooking Stove to be purchased for the use of the House I purchased from McGhee, it is my will that Angeline E. Poag have it for the use of herself and bodily heirs. And I also will my Horse Prince to A. E. Poag and her bodily heirs.

Sixthly. I will to Joseph Poag, son of James W. Poag my Watch.

Seventhly. I will my Trunk to Mary E. Johnson.

Eighthly. I will to my friend John E. Reno my Bible in Two Volumes in token of my high Regard for him.

And lastly I will to Angeline E. Poag and her bodily Heirs any Money an property of mine that may be left after my just debts and funeral expenses are paid.

And in conclusion I do hereby Constitute and appoint my friend John E. Reno my Executor of this my Last Will and Testament, hereby revoking all other Wills by me made heretofore. In Witness whereof I have hereunto Set my hand and affixed my Seal this 24th day of June 1837.

The foregoing Last Will and Testament of James Miller deceased was exhibited in to Court and proved to be the Act and deed of the Said James Miller by the Oaths of *. S. Campbell and John Kittinger, the subscribing Witnesses thereto and thereupon ordered to be Recorded. In testimony that the same has been truly Recorded I have hereunto Set my hand.

Resident of Prince Georges County, Maryland
Admitted for probate January 17, 1826

In the name of God amen, I, Jacob Miller of Prince Georges County and State of Maryland indisposed in body, but of a sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last Will and Testament in manner and form following , that is to say, First and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executrix herein after named and after my just debts and funeral charges paid then I devise and bequeath as follows.

Item: My will and desire is that my beloved wife, Sarah Miller should have and hold all my Real and Personal  Estate consisting of two Lots of ground laying in the County of Washington, District of Collumbia that is to say one House and Lot in Georgetown upon High Street, District of Collumbia allso one unimproved Lot in the City of Washington, District of Collumbia, being on Seventh and D Street, Together with all my Personal Estate that is to say Negro Dick, Negro Mary, Negro Siller,
Negro Bill, Negro Mimi, Negro Gin, Negro Peter, and Negro John who has yet fore years to serve . Together with all my stock consisting of Horses Cattle Sheep and Hoges and Mules,  this with all my Household furniture including Kitchen and Plantation utensils and that my wife Sarah Miller shall be in full possession of all my Real and Personal Estate as aforesaid during her natural widdowhood and if she is not satisfied with my Will my desire is that she take the one third of my total real and personal as the law directs.  I leave it to her choice and after my wife, Sarah Miller makes up her minds to eighther hold all my Estate real and personal during her natural life or widdowhood or take one third part which I leave to her choice, then my will is that what shall be remaining both of real and personal including all notes and open accounts belonging to my Estate shall be equally divided amongst my several children both Real and Personal consisting of two lots aforesaid and negros there names afore written Together with all my Household and Kitchen furniture and my plantation utensils and notes and open accounts to me be equally divided between all my children share and share alike that is to say John Miller, my son, Catherine Hoover, wife of David Hoover, Sarah Pumfrey , wife of Levi Pumfrey, Jacob B. Miller, my son, Mary Miller, my daughter, Addam Miller, my son, Elizabeth Miller, Leonora Miller and Margaret Ann Miller, my daughters to be equally divided share and share alike my will and desire is that if each or eighther of my children whose names are above written die without lawfull heir then there part of my Estate both real and personal shall be equally divided between the surviving ones to them their Heirs and Assigns forever.  And Finally I do hereby constitute and appoint my dear Wife, Sarah Miller to be my administrix jointly with my son John Miller to be the administrators of this my last Will and Testament revoking and annuling all former Wills by me heretofore made ratifying and confirming this and none other to be my last Will and Testament.  In testimony whereof I have herein to set my hand and affixed my seal the twenty-sixth day of July in the year of our Lord One thousand eight hundred and twenty-four.
