                 wedding, in the Brick Store Community, near the Hub, Newton Co. Buried in

                 Salem Cemetery.

                 He was crippled for life by being shot in the head, and the bullet could not be

                 removed. He died when his clothes caught on fire and he burned to death.

James "Charlton" Bates was born in Franklin Co, GA in either 1839, 1842, or 1843, as the records of his birth vary.  The date of 1839 is consistent with the later census records. 

In 1850, he lived with his father in Franklin Co, GA.

From History of Hall Co, Georgia, Volume 1, by James Dorsey, p. 69:

William Bates and Charles Bates were arrested for horse theft in 1858 near Sugar Hill. (as reported in the Southern Watchman, Nov 11 and 18, 1858). Note: it is believed that the “Charles” mentioned above was “Charlton” Bates.

James C. Bates enlisted into I Company, 12th Tennessee Cavalry[9] (USA) in Parksville, TN, on March 10, 1864, at age 22. His military record states that he was a saddler. He was wounded Oct 27, 1864 while skirmishing, when he fell from a horse and landed on a saber, puncturing his lower abdomen. From this wound he suffered his entire life. He was discharged Dec 25, 1864 from Kansas City, MO.  His record states that his occupation before the war was a shoemaker. He was also listed as having blue eyes, dark complexion, light hair, and stood 5'6" tall.

The story goes that James and Charity met when the Federal troops occupied Covington, Georgia and he went back after the war to marry her. It is said that he took a train to Gainesville, then walked from there to Covington, which took 14 days. 

In 1865, he went to live with his father in Hart Co, GA[10]. 

In 1870, he lived with his family in Newton Co. GA, in Brewers Locality:  He was a farmer, with real estate valued at $700, and personal property at $200. 

It must have been around 1871 that James and family went to live in Arkansas for a while.

They left Georgia with little more than their two children and a horse drawn wagon. No one knows exactly how long they were there, but they engaged in farming while out there. When an epidemic of yellow fever swept through the area, killing one of their children, they sold their possessions and started back home. Their funds provided tickets to Georgia for wife and 2 children, but only to the next town for James. When his ticket ran out, he started walking the tracks. After 8 days, the train stopped as it passed James, and they took him aboard anyway.

Two years later, he purchased a covered wagon and he and his family set out again. Funds must have been exhausted by the time they reached Atlanta, for they stopped there, where he obtained employment. In the course of time, the call of the hills grew too strong, and they returned to the old Bates homestead.  (Taken from the Newton Co History Corner, written by Tom M. In 1880, he and his family lived in Newton Co. GA, in Gaithers District. 

In 1893, in an affidavit to the pension board, L.C. Horton (age 18) and S.A. Ozburn (age 23) stated that they had lived with James Bates and family for the past 3 years[11].

In 1900, James Bates and family lived in Newton Co. Georgia

James C. Bates died on Dec 22, 1904 in Newton Co, GA.

On Jan 10, 1905, his widow Charity applied for widow's pension from Starrsville, Newton Co., GA

On Feb 17, 1906, in an affidavit to the pension board, Charity Bates stated that James had 135 acres of land assessed to him at $675, "but would bring twice as much at a good sale". The land had belonged to her mother, and would be equally divided among her children. He also had a pair of mules worth $200[12]. 

In 1910 and 1920, Charity Bates lived in Newton Co. GA.

On Sep 22, 1937, Charity Horton Bates died. She had lived in Atlanta with her son Sam and his wife Lena Bates while sick, and was also nursed by her granddaughter, Tine McCray.

They moved her back to Covington and she died soon afterwards.

My Grandma Sudie has told me stories of when she was growing up, her family lived with her grandmother Charity Bates for a while. She was born the year James Charlton Bates died.

They were members of Gaither’s Methodist Church, where Charity Bates was a Sunday school teacher. There is a stained glass window there with her name on it.
