Text of Levi Gardner’s Will

In view of the uncertainty of Life, the certainty of Death, and of the importance whilst in life and health, of disposing of all secular affairs preparatory to that last great change, I, Levi Gardner, of the township of York, in the county of Medina, and the state of Ohio, being of full age and of sound mind and memory, do Make, Ordain and Establish this my last will and testament.

Item First. It is my Will that all my just Debts and funeral expenses be paid from my Estate.

Item Second. I give, devise and bequeath unto my beloved wife, Lydia Gardner, in lieu of her dower, during her lifetime, all my estate, personal and real, of every name and description whatsoever, which I may have at my decease – the said real estate herein devised and bequeathed is known and distinguished as being seventy-five acres on the west part of lot number nineteen in tract one, called also the Chapman Tract in said Township of York aforesaid.

Item Third. I hereby give and devise and bequeath unto my son, Amos Gardner, all the estate in remainder that may remain of my said estate, both personal and real and of every manner and description, after the decease of my said wife, Lydia, On his, said Amos, paying within two years, after his coming into possession of said property. To each of my other children One Hundred Dollars that is to say to my son, Levi Gardner Junior One Hundred Dollars, to my son Reubin Gardner, One Hundred Dollars, to my son William H. Gardner One Hundred Dollars, to my son James One Hundred Dollars, to my daughter Keziah Vandorn One Hundred Dollars, to my daughter Adaline Fenn One Hundred Dollars, to my daughter Sarah Branch One Hundred Dollars, to my daughter Marietta Abbot One Hundred Dollars, to my son Julius Gardner One Hundred Dollars, all payable within two years after the said Amos shall come into the full possession and enjoyment of the said estate personal and real as aforesaid.

Fourth. I do hereby nominate and appoint my said wife Lydia as Executor of this my last will and testament and hereby authorize and empower her to execute the same without entering into bond as required by the statute in cases not so provided for.

Fifth. I do herby nominate and appoint my said son Amos Gardner as Executor of such part of this my said last will and testament as shall remain unexecuted at the death of my said wife.

In testimony whereof I have here unto set my hands and seal this fifteenth day of June A.D. 1852.
