Anastasia Fulton, deceased, Last Will and Testament filed March 5, 1851 by Executor T.D. Fulton to J.M. Ross, Ordinary of York District. Recorded in Book of Wills, p. 228.

Page 2 - The Will

S. Carolina / York District. In the name of God, Amen.

I, A.S. Fulton of the State and district aforesaid being sound in mind but debilitated in body and knowing the certainty of death do constitute this my last Will and Testament.

First I will and bequeath to my son James W. Fulton my little grey Horse and one Horse Waggon and Harness together with thirty Bushels of corn I have at James Bryon’s. The balance of my property to be sold and equally divided with my six children, viz, Horatio S. Fulton, James W. Fulton, T.D. Fulton, E.P. Featherston, A.C. James and the Heirs of D.A. Fulton. I also will that my Executor pay to the heirs of Rachel O. Wheeler one dollar.

As I had heretofore spoken of giving my son Horatio my Black boy Joseph, and should he still desire to have the boy Joseph, that is to constitute his part of my Estate and the balance divided with my five children James, Theodore, Arabella, Elaliah and the Heirs of Daniel A. Fulton. After my Funeral expenses and debts be paid my Executor will proceed to act as above directed. I do hereby appoint T.D. Fulton Executor of this my last will and testament. Signed, sealed this 18th day of Feb in the year of our Lord 1851.

Page 3 - Proof of Will and Appointment of Executrix

Here the magistrate (Ordinary) J.M. Ross proves the will of Anastasia Fulton on March 5, 1851, naming Theodore D. Fulton as Executor. He is to have the appraisals done by May 5, 1851..

Page 4 - Order for Sale

The first half of the document is the request by T.D. Fulton to the courts for permission to conduct a sale of the property of A.S. Fulton as directed in her will. Petition signed March 5, 1861.

The second half is the order to conduct “a public sale on the 29th of March at the late residence of the dec’d” and to sell “such portions of her estate as she by her last will and testament divided to be sold, on a credit until 1 January next with interest from the sale for all sums exceeding $2, and for $2 and under cash. Purchasers at said sale to give bond and good security for the purchase money.”
The order was signed by J.M. Ross on March 5, 1851.

Page 5 - Warrant of Appraisement

The Ordinary authorizes T.D. Fulton to get an appraisal of the goods of A.S. Fulton from B.Y. Wheeler, Beard, W.L. Harris, S. Sadler, and J.S. Moore. Signed Mar 5, 1851.

Then W.L. Harris, J.S. Moore and S. Sadler agree to take on the appraisal. Note that it mentions that Anastasia was late from Yorkville.

Note: Included in the original list of possessions, but not in the bill of sale, are 1 Horse (valued $25) and 1 waggon (valued $5). These have presumably been given already to James as per the will. There is never any reference to the “Black Boy Joseph” and it is doubtful that he went to Horatio (as mentioned in the will) since the property was divided 6 ways. Did Joseph die before Anastasia?
