MORTGAGE
Matthew Langill to James Kitchin Junior.
Registered 24th December 1845, at 1 o'clock p.m.
on the certificate of K. McLean J.P.
This Indenture made this twentieth day of December in the year of our
Lord one thousand and eight hundred and forty five.
Between Matthew Langill, (Matthew's son), of River John in the County of Pictou,
Yeoman, of the one part, and
James Kitchin junior of River John,aforesaid, Merchant,of the other part.
Witnesseth, that the said Matthew Langill for and in consideration
of the sum of thirty pounds and seventeen shillings lawful money
of the province of Nova Scotia to him paid by the said
James Kitchin at or before the execution of these presents.
The receipts whereof is hereby acknowledged.
Hath granted, bargained, sold, aliened, remised, released, enfeoffed
and confirmed, and by these presents doth grant, bargain, sell, alien.
remise, release,enfeoff, and confirm unto the said James Kitchin , his
heirs and assigns all that certain lot piece or parcel land situate,
lying and being on the west side of River John aforesaid abutted,
bounded and described as follows: viz.:
Bounded Eastwardly by the said river, southwardly and northwardly by
lands owned by William Langill, and westwardly by lands owned by Jacob
Langill, Containing fifty acres more or less.
With all and singular the houses, barns, ways, waters,watercourses,
improvements, privileges and appurtenances thereto belonging or in
anywise appertaining and the reversions and remainders rents issues and
profits thereof and all the estate,right,title,interest,claim, property
and demand both at law and equity of him the said Matthew Langill and
his heirs and assigns, into, out of or upon the said described lot piece
or parcel of land and premises above described, or in any part thereof
together with the premises and appurtenances thereto belonging.
To have and to hold the same and every part thereof with their and every
of these appurtenances unto him the said James Kitchin jr., his heirs
and assigns,his and their only proper and absolute use benefit and
behoof forever provided always and these presents are upon these express
conditions that if the said Matthew Langill his heirs, executors,
administrators and assigns shall pay, or cause to be paid onto the said
James Kitchin junior, his heirs, executors, administrators and assigns
the full sum of thirty pounds, seventeen shillings of lawful money of
the province aforesaid, on the thirteenth day of December next ensuing
the date of these presents with interest thereon (being the same sum of
money and interest as is mentioned in the condition of a certain Bond o
Obligation in writing made by the said Matthew Langill,payable to the
said James Kitchin jr. and bearing upon date with these presents without
and deduction of abatement whatsoever, then these presents in every
clause, matter anything therein contained shall cease determine and
become void, everything herein contained to the contrary
notwithstanding. And the said Matthew Langill doth hereby for himself,
his heirs, executors, administrators and assigns covenant promise and
agree to and with the said James Kitchin jr., his heirs, executors,
administrators and assigns, as follows, viz.;
That at the time of the execution of these presents,
the the said Matthew Langill is, and stands seized of an
absolute Estate of Inheritance, in fee simple of and in the said
described lot, piece or parcel of land,
premises, with the appurtenances herein before described and herein and
hereby granted and conveyed or intended to be, without any condition or
encumbrance whatsoever. And that he hath grant good right, full and
lawful and absolute authority to sell and convey the said lot, piece or
parcel of land and premises, with the appurtenances in manner and form
as they are herein before and hereby granted and conveyed, or mentioned
or intended so to be.
And also that he, the said Matthew Langill, his heirs, executors,
administrators and assigns, and the said lot, piece or
parcel of land and premises with all the appurtenances above conveyed to
the said James Kitchin jr., his heirs, executors, administrators and
assigns , against the lawful claims and demands of all and every person
and persons whomsoever will warrant, maintain and forever defend by
these presents.
I witness whereof the parties to these presents have hereunto their
hands and seal subscribed and set the day and year first above written.

I do hereby certify that I, one of the subscribing witnesses to the
execution of the foregoing Indenture of Mortgage was present and saw the
same executed by the therein named Matthew Langill for the purpose
therein set forth and contained favour to at River John.
