James Langill, Lewis' son, to Alexander McKenzie
Registered 18th June 1844 at 4 o'clock p.m. on the oath of C. McLennan
This Indenture made at River John this sixth day of May in the year of our
Lord
one thousand, eight hundred and forty-four between
James Langill, Lewis' son, of River John, in the County of Pictou, farmer, and Sarah, his
wife of the part
and Alexander McKenzie of River John aforesaid, in the
County of Pictou aforesaid, Esquire, of the other part.
Witnesseth that the said James Langill and Sarah, his wife, for and in
consideration of the sum of
eighty pounds, seventeen shillings and six pence currency of the province of Nova Scotia
to him in hand paid at or before the sealing or delivery of these presents
the receipt whereof is hereby
acknowledged.
Hath grant, bargain, sell, remise, release, enfeoff and
confirm unto the said Alexander McKenzie,
his heirs and assigns forever a
certain lot or parcel of land situate lying and being
on the south side of
the River Road leading from the River John to Tatamagouche in the County of
Pictou
bounded on the north side by said road, on the east by lands
belonging to William Langill,
on the south by lands in the possession of
Thomas Wilson and others and
on the west by lands belonging to Lewis Tattrie
containing seventy-five acres more or less.
For a further description,
reference being had to the Deed of the same premises conveyed by
Lewis
Langill to said James Langill and being the whole of the farm on which the
said James Langill now resides.
To have and to hold the said lot and premises with all the building and
improvements thereon
or therewith belonging or in any way appertaining to
him the said Alexander McKenzie,
his executors, administrators and assigns
against the lawful claim of all and every person or persons
to warrant and
defend the said Alexander McKenzie,
his heirs, executors, administrators and assigns in the peaceable and quiet possession
of the above conveyed premises
for ever.
Provided always and the true intent and meaning of the parties to
these presents are that if the said James Langill,
his heirs, executors or
administrators shall well and truly pay or caused to be paid the said
Alexander McKenzie his heirs, executors, administrators or assigns the just
and full sum
of eighty pounds, seventeen shillings and six pence above
mentioned with lawful interest thereon
with one year from the date of these
presents as the same is secured by a promissory note
from the said James
Langill to the said Alexander McKenzie bearing even date herewith,
then this
present Deed of Indenture and every clause, matter and thing herein
contained to cease, determine and become of none effect.
In witness whereof the said James Langill and Sarah, his wife,
have hereunto
severally their names, subscribed and seals affixed the day and year first
above written.

Received on the day of the date of the foregoing Deed of Mortgage the full
consideration money therein mentioned.
